Double Standards And Selective Prosecution By BN Again (en/cn)

Double Standards And Selective Prosecution By BN Again As Many Companies That Have Committed More Serious Financial Irregularities Are Not Given The Same Attention As That Given To Suaram And Clearly An Act Of Political Revenge To Distract Attention From The Alleged Scorpene and National Feedlot Corporation or Cows And Condos Scandals.

The recent onslaught against Suaram continued when Domestic Trade, Co-operatives and Consumerism Minister Datuk Seri Ismail Sabri said that human rights advocacy group Suaram would soon face prosecution for its "confusing" and "misleading financial accounts". According to press reports, the Companies Commission of Malaysia (CCM) is supposed to have made a recommendation yesterday to the Attorney-General's office to press charges against Suara Inisiatif Sdn Bhd, a company linked to Suaram, for unexplained financial irregularities.

This is a clear case of double standards and selective prosecution by BN again as many companies that have committed more serious financial irregularities are not given the same attention as that given to suaram and clearly an act of political revenge to distract attention from the alleged Scorpene and National Feedlot Corporation or Cows and Condos scandals.

Why is a privately-funded human rights NGO being selectively victimised over supposed financial irregularities, when there are a multitude of high-profile and scandalous cases of alleged corruption and mismanagement of public funds such as the RM500 million "commission" for the purchase of two Scorpene submarines and the RM250 million National Feedlot Corporation scandal? No Minister ever talked of investigating the accounts of the companies involved in the two alleged scandals.

Besides the double-standards and obvious duplicity, this selective persecution against Suaram once again reveals the BN government's penchant for punishing the whistle-blower. Just as how PKR Election Strategy Director Rafizi Ramli was arrested for revealing bank account details that led to the charges against NFC Chairman Dato' Seri Mohamed Salleh Ismail, Suaram appears to have been victimised for its role in publicly highlighting and assisting in the Scorpene corruption trial in France.

After all,Suaram's accounts have been audited and submitted routinely every year. Even Suaram leaders have publicly declared that they have nothing to hide. As Suaram was formed in 1989, why take action only now but not for the previous 23 years? Is it an act of vengeance over Suaram recent highlighting of the acquisition Scorpene submarine scandal that goes all the way to the top leadership of BN?

国阵实行双重标准及选择性检举,他们如此"关注"大马人民之声的财务违规问题,却没有对付其它犯下更严重财务违规的公司,这很明显是一项政治报复行动,也是为了转移全国对Scorpene潜水艇及公寓养牛丑闻的视线焦点。

当局对大马人民之声的检举行动将会持续,当国内贸易、合作社及消费事务部长拿督斯里依斯迈尔说,大马人民之声将因其"混乱"及"误导性的账目"而被提控。

根据媒体报道,大马公司注册局昨天本来应该向总检察署建议,将向Suara Inisiatif Sdn Bhd(与大马人民之声有关的公司)提出检举诉讼,因为该公司出现财务违规问题。

很明显地,这是双重标准及国阵的选择性检举,他们如此"关注"大马人民之声的财务违规问题,却没有对付其它犯下更严重财务违规的公司,这很明显是一项政治报复行动,也是为了转移全国对Scorpene潜水艇及公寓养牛丑闻的视线焦点。

为什么私人资金资助的人权非政府组织,会因为财务违规而面对选择性迫害?而那些涉及公款遭贪污、滥用的丑闻却不了了之,如:购买两艘Scorpene潜水艇的5亿令吉佣金、2亿5000令吉的公寓养牛丑闻?甚至没有任何部长提及要调查这些公司的账目。

除了双重标准及明显的不诚实,当局对于大马人民之声的选择性迫害再一次揭露国阵政府倾向惩罚吹哨人。正如公正党选举策略主任拉菲兹在揭露国家养牛中心的银行账目后被逮捕,这宗丑闻最终导致该中心主席拿督斯里莫哈末沙列被提控。这一次大马人民之声被迫害,看来是因为他们高调协助法国的潜水艇贪污案审讯。

再说,大马人民之声的账户每年都被稽查及呈交。就连该组织领导已经公开宣示他们没有隐瞒任何事情。大马人民之声成立自1989年,为什么过了23年,现在才对付他们?这难道不是为了报复大马人民之声高调揭发Scorpene潜水艇采购丑闻,已经直逼国阵的高层领导?

Building Human Talent And Reversing The Brain Drain Is Critical To Arresting The Decline In Malaysia’s Global Competitiveness . (en/cn)

Some newspapers highlighted Talent Corporations's success in getting 30% of 130 Malaysian specialist doctors in Taiwan to consider and think about coming home in 3 years. How can Talent Corporation regard as a success when not a single specialist doctor in Taiwan has confirmed 100% their return home immediately but are only willing to consider and think about coming home in 3 years time?

Clearly Malaysia's failure in reversing the brain drain and getting them to come home plays a huge part in Malaysia's drop in the Global Competitiveness Index 2012-2013 to 25th spot from 21st last year. Malaysia needs to focus on the 3 critical success factors of upgrading technological readiness especially in internet connectivity, improving public safety by containing crime escalation and building human capital formation to arrest the decline in Malaysia's global competitiveness.

This decline is not simply a failure of the Prime Minister Dato Seri Najib Tun Razak's Economic Transformation Programme(ETP) but also a failure to recognise that clinging on to failed policies will not provide the solutions to our problems. As Albert Einstein said, "Using old solutions, especially failed ones, to solve new problems is insane". The time has come to discard failed policies of crony capitalism, Approved Permits for vehicles and subsidies for profit-making companies.

In Jakarta, the City Mayor has just announced free wifi would be available on main roads and highways. As digital intelligence is of critical importance in the internet connected world, providing free wifi in public places would provide a much needed boost. There is no reason why free wifi in public places can not be done throughout Malaysia, if it can be implemented in Penang Or is Malaysia going to be behind not just Jakarta but also Indonesia eventually?

Regarding Malaysia's technological readiness, the report notes three areas that require improvement, namely: international internet bandwidth in kilobits per second per user (ranked 83rd), broadband internet subscriptions per 100 population (68th) and mobile broadband subscriptions per 100 population (64th). This contributes to the low level of technological readiness despite the country's focus on promoting the use of ICT.

The common perception of an increase in crime negatively impacted Malaysia’s ranking with a drop in the rankings related to crime such as the business cost of crime and violence; organised crime; and reliability of police services. Clearly the drop in crime index poses many questions about the reliability in the compilation of statistics and that the final determinant of public safety is not determined by statistics but ultimately whether the people feel safe.

Even the Ministry of International Trade and Industry has admitted that negative perceptions about crime has had an adverse impact on investors and international community alike as do not feel safe. The time has come for both the Home Ministry and the police to stop being in denial but focus solely on fighting crime instead of allowing the police to be used as a tool to serve the political interests of BN against the legitimate opposition PR in Malaysia.

Unless Malaysia succeeds in stopping the ruinous exchange of human talent with unskilled foreign workers, Malaysia's hopes to escape the middle-income trap and join the ranks of high-income economies will remain a pipe dream. Perhaps Malaysia should not just learn from Jakarta, but also China which attracts back its human talent from USA by paying them comparable salary rates, provide housing accomodation and most important of all equal opportunities of career advancement.

With 2 million Malaysian leaving the country since 1957, Talent Corp would not only fail to attract them back but would see more Malaysians leaving unless more incentives can be given. There must be transparency such as open competitive tenders and public declaration of assets that avoid conflict of interest.

Unless the 3 critical success factors are dealt with, especially retaining and attracting new human talent, Malaysia's hopes of becoming a high-income developed economy by 2020 will remain a pipe-dream that will be recycled every election year.

马来西亚的全球竞争力下滑,不只是因为首相经济转型计划的失败,也是科技准备、打击罪案及人力资源栽培政策的失败。

一些报章突出人才机构成功让台湾130名专科医生中的30%人才慎重计划3年内回国。人才机构怎么能说这是一项"成果"因为事实上没有一名大马籍台湾专科医生100%确定他们将会马上回国,而只是愿意考虑及计划3年内回流。

很明显地,马来西亚在招揽人才回流方面已经失败,这也是为什么马来西来在2012年-2013年的全球竞争力指数从去年第21位,下滑至第25位。马来西亚需要注重三个成功因素,提升科技就绪度特别是网络的连接、改善治安降低罪案、栽培人力资本,以解决马来西亚日趋退步的全球竞争力。

这项退步不只是首相拿督斯里纳吉的经济转型计划的失败,也是因为当局者看不到坚守失败的政策无法从根本上解决我们的问题。爱因斯坦说,"不断地延用旧方法、特别是失败的方法来解决新问题是疯狂的。" 是时候放弃朋党资本主义的失败政策、汽车入口准证、赚钱公司的津贴。

雅加达市长最近宣布他们将在主要公路及高速公路提供免费无线上网。数码智慧的网络通讯时代是非常重要的,在公共场所提供免费无线上网非常受落。如果槟州做得到,我们不明白为何政府不能全马各地公共场所提供免费无线上网?还是马来西亚不只会落后雅加达,甚至是印尼?

有关马来西亚的科技就绪度,报告中指出三个需要改善之处:国际宽频每个用户、每秒千位元排名第83;每百名人口的固定宽频订户率排名第68,以及流通宽频网络订户排名第64名。尽管我们一直在极力推广科技资讯工艺,这些都是科技就绪率低的原因。

我国的罪案率一直被公认为有增无减,在报告中,与商业、暴力、组织性及警方可靠性有关的罪案排位下降。很明显地,罪案指数下滑不禁让人怀疑,有关数据统计是否可靠?毕竟公众安全问题不是由数据决定,最终是人民是否觉得有安全感。

就连国际贸易及工业部都承认,罪案率的负面印象让投资者及外国人士觉得不安全。内政部长及警方不应该再否认,而应该专注于打击罪案,而不是让警方沦为国阵政治利益服务的工具,用来对付合法在野民联。

White Paper On Cheap Land Sales Of At Least 4,000 Acres By The Previous BN Government Will Be Issued Based On The Probe By A Special EXCO Committee Headed By Chow Kon Yeow. (en/cn)

The Penang State EXCO at its meeting on 12.9.2012 has agreed to issue a White Paper on cheap land sales of at least 4,000 acres by the previous BN government based on the probe by a special EXCO Committee headed by Penang State EXCO member for Local Government and Traffic Management Chow Kon Yeow.

The terms of reference decided by the State EXCO for the probe on cheap land sales are as follows:-

1. Identify cheap land sales conducted without open tender, price sold and to whom it was sold;

2. Analyse the sale process as well as whether the land sold was developed according to the original purpose of sale'

3. List out the weaknesses and the financial opportunity losses forgone incurred by the state government as a result of the cheap land sales as well as recommend measures to ensure that such wrongful practices do not recur.

Cheap land sales or even land given for free by BN government came into focus when BN alleged that the sale of 1.1 acre piece of land in Taman Manggis for a private hospital project to promote medical tourism in Penang, was sold below market value even though it was conducted by open competitive tender. The highest bid offered was accepted at RM 232 per square feet which was higher than the value given by Jabatan Perkhidmatan Harta dan Penilaian, under the Finance Ministry.

Not just BN but Gerakan has lost all honour and credibility when BN Penang Chairman Teng Chang Yeow can not prove his claims that four of my EXCO members, my political secretary and myself had personal interest in the hospital project. Unlike the over 4,000 acres sold by the previous BN state government, the present state government only sold over 100 acres of state land to raise funds to build 18,000 units of affordable housing.

Can BN Explain Why PR Land Sales Of Over 100 Acres Can Raise RM 1.1 Billion Whereas BN Cheap Land Sales Of 4,000 Acres Is Only Half Of RM 1.1 Billion?

When limited land sales by PR state government under open competitive tender can being questioned, BN's cheap land sales of over 4,000 acres must be fully answered. Can BN explain why PR land sales of over 100 acres can raise RM 1.1 billion whereas BN cheap land sales of 4,000 acres is half of RM 1.1 billion? Chow Kon Yeow would look into the more than 4,000 acres of state land or identify even more land that were sold cheaply or without open competitive tender such as:-

a) In the Tanjong Tokong Reclamation, under Agreements dated 1990 & 1999, the developer was given the right to reclaim and develop 980 acres of land off Tanjong Tokong at the price of RM 1 per square foot!(RM 42.7 million)

b) 750 acres of land in Batu Kawan was sold in 2004 at between RM3.05 to RM 4 per square feet.(RM 112,058,100)

c) As for the Jelutong Expressway, under Agreements dated 1997, 2002 & 2003, the developer was given the right to reclaim 325 acres of land in exchange for constructing the Jelutong Expressway at an estimated cost of RM300 million and cash payment of RM25.4 million. In other words, the total cost is RM325.4 million for 325 acres or the cost of reclaimed land at Jelutong Expressway is RM 1 million per acre or over RM 20 per square feet. What's more the developer can pay RM 25.4 million over 10 years from 2005 up to 2015 – surely a record for length of payment period.

d) 80 acres of prime land in Pulau Jerejak was sold to Urban Development Authority(UDA) without open tender on 15 January 2001 for a lease period of 60 years at only RM 3.72 per square feet.(RM12.9 million)

e) 1,600 acres of reclaimed land off Butterworth was given to Rayston Consortium(Butterworth) Sdn Bhd or Rayston for free. Rayston only had to pay RM 50 million for relocation of squatters and build a highway which they are recovering the cost through toll collections.

f) 18.7 acres land in Midlands Court and over 4 acres in Prangin Mall was sold by tender but not to the highest bidder. Instead for both sites, the 2nd highest bidder was selected.

g) 500 acres of reclaimed land awarded without open tender for the now aborted Penang Outer Ring Road(PORR) project. LIM GUAN ENG

槟州行政议会于2012年9月12日同意,将依据地方政府及交通管理委员会主席曹观友为首的特别行政议员委员会,针对前朝国阵政府廉价出售4000英亩土地一事,发表一份白皮书。

州行政议员所决定的廉价售地的调查委员会调查范围为:

1. 确认没有公开招标的廉价售地买卖,出售价格以及谁是买家;

2. 分析买卖过程,以及有关土地是否已经根据出售条件进行发展;

3. 列出廉价售地买卖为州政府造成的后果、财务机会损失,同时,提出建议不再让这种错误的做法再发生。

国阵政府廉价售地、甚至免费赠地最近成为焦点,他们首先指民联州政府通过公开招标,以低于市场价,出售山竹园1.1英亩地段来发展槟州医疗旅游。最高价得标者出价每平方尺232令吉,比财政部属下的资产评估局所估的市价还高。

当国阵主席邓章耀无法证明槟州四名行政议员、我的政治秘书以及我本身,在有关私人医院计划涉及私人利益,不只是国阵,就连民政党已经名誉扫地。不像前朝国阵州政府的4000英亩土地,现任州政府是出售100英亩州土地是为了筹集款项,兴建1万8000 个可负担房屋。

国阵能不能解释,为什么民联仅出售100英亩土地却可以筹措11亿令吉,而国阵廉价出售4000英亩土地,却只收到11亿令吉的一半?

既然民联政府通过公开招标,出售有限的土地被质疑,那么国阵必须交待廉价出售4000英亩土地一事。国阵能不能解释,为什么民联仅出售100英亩土地却可以筹措11亿令吉,而国阵廉价出售4000英亩土地,却只收到11亿令吉的一半?曹观友会调查上述廉价出售或未经公开招价售出的4000英亩甚至更多的州政府土地,例如:

a) 丹绒道光填海地在1990及1999年的合约中,前朝政府让发展商以每平方尺1令吉的价格,在丹绒道光进行填海发展980英亩的土地。

b) 在2004年,峇都加湾750英亩以每平方尺3.05至4令吉的价格出售。

c) 日落洞高速公路在1997年、2002年及2003年的合同中,前朝政府让发展商以2540万令吉及一条价值3亿令吉的日落洞高速公路,进行填海发展 325.4英亩的土地。换句话说,日落洞高速公路的325英亩地段总值3亿2540万令吉,或 1英亩100万令吉,或每平方尺20令吉。更何况,发展商可以用10年(2005年至2015年)偿还2540万令吉,这么长的偿还期,肯定破了偿还期限记录。

d) 木蔻山80英亩的土地于2001年1月15日在没有公开招标的情况下以每平方尺3令吉72仙,出售给城市区发展机构(UDA),租凭期为60年。

e) 免费赠送Rayston Consortium(北海)有限公司1600英亩的北海填海范围。Rayston 只需要缴付5千万令吉的填海费,以及承建一条大道的费用而已,而这些费用,也可以靠收过路费赚回的。

f) 为什么在Midlands Counrt 及柏兰宜广场地段的18.7英亩经过招标却不是最高价者得。而是把土地出售给第二高价的竞标者。

g) 在没有公开招标的情况下,将500英亩填海地合约颁给槟州外环公路计划。
