Response to Free Malaysia Today article dated 19 October 2012 written by B Nantha Kumar on the Bukit Rajah issue

I refer to the article in Free Malaysia Today dated 19 October 2012 written by B Nantha Kumar.

The article basically makes allegations that I and Dr Xavier Jayakumar have "betrayed the poor " and creates a false picture of  the issue of the struggle for housing by the Bukit Rajah ex-estate workers.  I now set out the facts from the beginning of this struggle so that readers can draw their own conclusions.

From 1993 my law firm has represented about 76 ex-estate workers from Bukit Rajah estate in their struggle against forced eviction by Sime Darby from the estate housing occupied by them. 

One of these 76 workers was Mr. Mathialagan who is now quoted in the FMT article making false and malicious allegations. Sime Darby terminated the workers in phases from April 1992. They then offered the ex-workers low cost five-storey walk-up flats for RM25,000. Many workers accepted and moved out of their estate quarters. 

Some refused saying that they were promised single storey terrace houses NOT flats.  Sime Darby then initiated eviction proceedings in Klang Sessions Court against some of them in 1993.

I defended the workers and managed to delay the inevitable eviction for many years.   Sime Darby then initiated further eviction proceedings against the workers in Shah Alam Sessions Court in 2005. Again my law firm defended them and delayed the eviction from taking place. 

In 2007, Sime Darby started using more aggressive tactics and started demolishing empty houses to make the area uninhabitable to force the workers to move out.  Tenaga and Syabas started cutting water and electricity.  Again the ex-workers came to see me and I successfully initiated an injunction application to stop these hostile actions to evict them.   All these litigation was done in the public interest and for minimal fees to defend poor estate workers from being unjustly evicted in breach of a promise of proper housing. 

Furthermore, Bukit Rajah is not the only group of estate workers I have defended – I have defended many others as well. If the Pakatan Rakyat had not taken over Selangor in March 2008, I am sure that the final outcome would have been that all these poor workers estate homes would have been demolished with no certainty of alternative housing for the workers.  

However after the change of government in Selangor, Sime Darby softened their stand and were prepared to negotiate.  Dr Xavier in his capacity as a member of the State Executive Council facilitated the negotiations.   The negotiations concluded successfully. The ex-workers agreed to accept the offer of a 20' by 70'  single-story terrace house at the price of RM70,000 which when completed under the current schedule at the end of 2013 will be worth at least RM250,000. 

The housing estate would also include a temple and a public hall.  From the price and the value of the house, it is obvious that it was a good deal and why it was accepted by the ex-workers.  On 1st March 2009, letters of offer with details of design and specifications were accepted in writing by 76 workers including Mr Mathialakan who is now making false claims that the workers were promised to be given a 15 acre piece of land.   There was no promise at any time to the ex-workers to give them a 15 acre piece of land.

In the course of the negotiations a 15 acre piece of land belonging to Sime Darby was identified on which the houses were to be built.   The letters of offer dated 1st March 2009 ( also given in Tamil to the 76 ex-workers ) only speak of a 20' by 70' single storey terrace house in a housing estate. No worker including Mr Mathialakan raised a demand for a 15 acre piece of land then.  This was because there had never been such a demand even from them. 

The worker's demand right from the beginning was for single storey terrace houses which they finally secured. The housing estate for the 76 houses and temple and the public hall only require about half of the 15 acres of Sime Darby land to be built. It is for Sime Darby as the land owner to decide how to use the balance.   Mr Mathialakan does not have an iota of evidence to back his false allegations.  His allegations are not just malicious but also totally foolish.  On what basis can he demand that the balance of the 15 acres be given by Sime Darby to the ex-workers?

I will consider legal action against future repetition of such defamatory statements especially if they are published by Free Malaysia Today again.

On Tuesday 23 October 2012, Datuk Donald Lim claimed in parliament that the Selangor state government has not built a single unit of low-cost or medium cost housing during its four years of administration.

He said "Di Selangor sudah lebih empat tahun, sebiji rumah pun tidak dibina untuk rakyat Selangor sama ada kos rendah atau sederhana. Memang ini... " (Hansard 23/10/12)

After being "corrected" in Parliament, Datuk Donald Lim attempted to change his allegations in Parliament with a press conference yesterday.

This time, he alleged that of the 23,637 units of affordable homes planned for Selangor, only 287 have been built. He said that is barely 1% of the total number and hence it is as good as zero built.  He stated that this information is disclosed in the reply by the Selangor State Executive Council to the state assembly sitting in April this year.

We have checked the official response by the State Exco. It is true that "only" 287 units of low-cost units have been completed while 826 are under construction.

However, Datuk Donald Lim appears to have conveniently read only half the response by the state government.  The same reply to the Dewan also stated that 5,526 units of low-medium and medium cost housing have been completed!  The Minister had claimed that there were none built at all!

So out of the total of 23,637 low and medium cost homes planned by the state government, 5,813 has already been completed. This is a commendable 25% completion within a few years of administration. As a civil engineer himself, sure Datuk Lim would know that planning, approving and constructing houses isn't like ordering a plate of char koay teow, where you will be served in 10 minutes.

The 25% is a far cry from the 1% alleged by the Deputy Finance Minister and definitely not "zero" as misled by him in Parliament.

Today, we have made a site visit to Seksyen 3, Bandar Baru Bangi within the Serdang constituency with Bangi ADUN Shafie bin Abu Bakar on one of the soon-to-be-completed 124 units of affordable homes (picture attached). We have made an open invitation to the Selangor MCA Chief to visit the site or any other sites in Selangor since he claimed that he is completely clueless about low-cost and affordable housing projects in Selangor.

The Selangor Government is also building 135 units of affordable homes at Sungai Long (within Serdang constituency) to be completed before the end of the year. Other affordable projects in the state include one in Seksyen U10, Shah Alam, where 536 units will be built.  As an initial step, the state has set the price for affordable houses (800-1,000 sq feet) for middle-income earners at between RM85,000 and RM120,000.  Selangor residents with households between RM2,500 and RM5,000 can apply for it.  Those interested may purchase the application form at Level 5 of SUK Building, Shah Alam at the price of RM5.

We would also like to remind the Minister of 2 further issues. Firstly, the statistics above only covers projects directly under the state government and the subsidiaries it own.  It does not include the thousands of units built by the private sector as mandated by the state government.

Secondly, we would like to emphasize in no uncertain terms that the responsibility to build affordable housing is that of the Federal Government under the Ministry of Housing and Local Government, headed by Datuk Lim's colleague, Datuk Wira Chor Chee Heung.  It is because the Federal Government has failed to fulfil its obligations that the state governments of Selangor and Penang are forced to step in to build affordable homes to ease the burden of the rakyat.

Datuk Donald Lim should hence get his own house in order first before attempting to discredit the Selangor Government under Pakatan Rakyat. He should also stop digging a deeper hole for himself by conceding that he has made a blunder in Parliament and withdraw his irresponsible remark that the Selangor government has not built a single unit of low or medium cost housing in the state.

KUALA LUMPUR, Oct 24 ― The children of senior Barisan Nasional (BN) politician Datuk Jamaluddin Jarjis have an indirect stake in Malindo Airways, a newly set-up airline that has been criticised for the lack of clarity surrounding its financial and safety records, a lawmaker alleged today

Petaling Jaya Utara MP Tony Pua drew the link through a search with the Companies Commission of Malaysia (CCM), which showed that one of Malindo's investors ― Malaysia's National Aerospace and Defence Industries Sdn Bhd (NADI) ― is part owned by DZJJ Sdn Bhd, which in turn lists Jamaluddin's two children as directors [and shareholders].

Pua added that according to CCM's information on NADI, the firm had failed to file is audited accounts from 2007, casting even more suspicion on the state of its finances.

Documents obtained from CCM showed that for the year 2007, NADI reported revenue of RM307.3 million and post-tax profit of RM90.5 million.

It also had RM684 million in current assets and RM496 million in current liabilities in 2007.

He repeated his earlier allegation that NADI's partner in Malindo ― Indonesia's Indonesia's PT Lion Grup, which operates Lion Air ― has also run afoul of the industry authorities numerous times over its failure to comply with safety guidelines.

Pua had previously pointed out that Lion Air is on the list of airlines banned in the European Union since 2007 due to safety concerns.

According to previous media reports, Lion Air has also been denied membership in the International Air Transport Association (IATA). A search on IATA's website confirmed that Lion Air is not a member.

"These issues were raised before but until today, no response has been given," Pua said.

Malaysians are disappointed that Prime Minister Datuk Seri Najib Tun Razak consider the RM40 million donation to UMNO Sabah as proper and appropriate and reject outright the allegations of extraordinary wealth of
Sarawak Chief Minister Tan Sri Taib Mahmud. Taib's former daughter-in-law, Mahmud Shahnaz Abdul Majid, revealed that Taib's son charged RM782,520.55 to just one of his credit cards for the first six months of this year. Shahnaz is claiming RM400 million in their divorce settlement in the Syariah courts as her husband is reputedly worth RM1 billion with RM 700 million of deposits in 111 bank accounts in local foreign countries.

How BN condones such private scandal can be seen by the refusal to come clean on the RM40 million donation originally meant for Sabah Chief Minister Tan Sri Musa Aman but now clarified as meant for Sabah UMNO? Ex-BN MP Datuk Seri Wilfred Mojilip Bumburing claimed that the RM40 million had been remitted to the personal account of an Umno leader whilst former UMNO Supreme Council member and now independent MP Lajim Ukin today claimed that state party leaders never knew that RM40 million was donated to Sabah Umno.

Another case is the extravagant lifestyle of Melaka Chief Minister Tan Sri Mohd Ali Rustam, in which 130,000 guest were feted in an extravagant record-breaking celebration in Malaysia. Until today Ali Rustam has failed to explain who sponsored such a lavish wedding, which Ali Rustam claimed cost only RM600,000?

DAP proposes 6 steps to fight corruption. One, institutionalise public declaration of assets. This has been done in Penang where the Chief Minister and the entire State Exco has made a public declaration of assets that has even been certified by an international accounting firm. If Penang can do it, why can't the Prime Minister and his Federal Cabinet or the Sarawak Chief Minister and his EXCO members do the same?

Two, BN leaders with extravagant lifestyle owning luxury homes, cars and huge personal bank accounts in foreign countries must be dropped. Three, family members must also be barred from being involved in government business to avoid another RM 250 million "cows and condos" National Feedlot scandal. Four, those genuine whistleblowers who expose corruption cases leading to charges in court must be protected instead of being persecuted.

Five, BN must come clean on political donations such as the RM40 million political donation to Sabah UMNO. Finally, open competitive tenders must be implemented. Without open competitive tenders, public projects are directly negotiated and awarded to cronies causing loss of public revenue such as the cheap sale of the Sungai Besi Air Force Base land. Or the RM240 million spent on the Melaka Airport which is grossly under-utilised without any planes but except to fly kites. Perhaps it can be also used to rear cows. Can the RM386 million for 57 KR1M stores in Sabah and Sarawak or RM6.7 million per store be justified? At RM6.7 million per store, are the KR1M stores selling basic necessities like sugar, salt and rice or luxury items like jewellery and designer handbags?

In Penang, open competitive tenders were implemented immediately after the change of government in 2008 and as a result the state government has been able to achieve surplus budgets every year since, with proceeds from the savings going back to the people annually in the form of an "anti-corruption dividend".

Even Housing and Local Government Minister Datuk Chor Chee Heung admitted that corruption cost Malaysia RM26 billion every year. Worse is the Global Financial Integrity Report from Washington estimated that more RM1,077 million of illicit money flowed out illegally from Malaysia from 2000-9.

PR has shown that we are competent in good governance. Based on the 2011 Auditor-General's Report, Penang recorded a 47% increase in revenue or RM192 million from RM 411 million in 2010 to RM603 million in 2011. In contrast Melaka's revenue decreased by 24% or RM84 million to RM272 million.

Penang's surplus increased by 312% from RM33 million in 2010 to RM 138 million in 2011. Whilst Melaka went down by 95% or RM 5 million from RM 5.03 million in 2010 to only RM0.26 million in 2011. Penang's debts went down by 95% whereas Melaka's debts increased by 15% or RM134 million to RM866 million. Clearly PR can manage the economy better than Melaka.

Cara BN menggalakkan skandal swasta boleh dilihat dengan keengganan untuk menjelaskan sumbangan RM40 juta yang asalnya untuk Ketua Menteri Sabah Datuk Seri Musa Aman tetapi sekarang dikatakan untuk UMNO Sabah. Bekas Ahli Parlimen BN Datuk Seri Wilfred Mojilip Bumburing telah mendakwa bahawa RM40 juta itu telah diremit ke dalam akaun peribadi seorang pemimpin UMNO sementara bekas ahli Majlis Tertinggi UMNO dan kini Ahli Parlimen bebas Lajim Ukin mendakwa bahawa pemimpin-pemimpin parti negeri tidak pernah tahu bahawa RM40 juta itu telah diberi kepada UMNO Sabah.

Lagi satu kes adalah kehidupan luarbiasa Ketua Menteri Melaka Datuk Seri Mohd Ali Rustam, di mana seramai 130,000 orang tetamu telah dijamu dalam kenduri kahwin yang memecahkan rekod. Sehingga hari ini, Ali Rustam gagal menjelaskan siapa yang menaja kenduri mega tersebut, yang Ali Rustam mengatakan hanya menelan belanja RM600,000

DAP mencadangkan 6 langkah untuk membanteras rasuah. Pertama, pengisytiharan harta secara terbuka hendaklah diinstitusikan. Ini telah dilakukan di Pulau Pinang di mana Ketua Menteri dan seluruh barisan EXCO negeri telah mengisytiharkan harta secara terbuka, malah diiktiraf oleh firma akauntan antarabangsa. Jika Pulau Pinang boleh melakukannya, kenapa Perdana Menteri dan Kabinet Persekutuan atau Ketua Menteri Sarawak dan barisan EXCOnya tidak boleh buat yang sama?

Kedua, pemimpin-pemimpin BN yang hidup mewah dengan memiliki rumah-rumah mewah, kereta, akaun bank peribadi yang besar di luar negeri harus digugurkan. Ketiga, ahli keluarga harus dilarang daripada urusan perniagaan dengan kerajaan untuk mengelak lagi satu skandal RM250 juta “lembu dan kondo”. Keempat, peniup wisel tulen yang membongkarkan kes rasuah yang mengakibatkan dakwaan mahkamah harus dilindungi dan bukan dianiaya.

Kelima, BN harus berterus terang tentang sumbangan politik seperti sumbangan RM40 juta kepada UMNO Sabah. Akhirnya, tender terbuka harus dilaksanakan. Tanpa tender terbuka, projek-projek awam dirunding terus dan dianugerahkan kepada para kroni, lantas menyebabkan kerugian dana awam seperti jualan murah tanah Pangkalan Tentera Udara Sungai Besi. Ataupun RM240 juta yang dibelanja untuk lapangan terbang Melaka yang tidak digunakan oleh kapal terbang tetapi untuk bermain layang-layang. Barangkali ia boleh digunakan untuk menternak lembu juga. Adakah peruntukan RM386 juta untuk 57 kedai KR1M di Sabah dan Sarawak atau RM6.7 juta boleh diwajarkan? Dengan harga RM6.7 juta setiap kedai, adakah kedai KR1M ini menjual barangan harian seperti gula, garam dan beras ataupun barangan mewah seperti barang kemas dan beg tangan berjenama?

Di Pulau Pinang, tender terbuka telah dilaksanakan sejurus selepas pertukaran kerajaan pada tahun 2008 dan sejak itu kerajaan negeri berjaya mencatat bajet lebihan setiap tahun. Wang yang dijimat pula diberi balik kepada rakyat setiap tahun melalui "dividen anti-rasuah".

Malah, Menteri Perumahan dan Kerajaan Tempatan Datuk Chor Chee Heung sendiri telah mengakui bahawa rasuah di Malaysia merugikan rakyat sebanyak RM26 bilion setiap tahun. Lagi teruk adalah laporan Global Financial Integrity yang berpusat di Washington yang menganggar bahawa lebih RM1,077 juta wang haram telah dialirkan keluar daripada Malaysia dari tahun 2000-9.

PR telah menunjukkan bahawa kita mampu mentadbir dengan baik. Berdasarkan Laporan Ketua Audit Negara 2011, Pulau Pinang mencatat peningkatan pendapatan sebanyak 47% atau RM192 juta daripada RM411 juta pada tahun 2010 kepada RM603 pada tahun 2011. Secara perbandingan, pendapatan negeri Melaka telah menurun sebanyak 24% atau RM84 juta kepada RM272 juta.

Lebihan Pulau Pinang meningkat 312% daripada RM33 juta pada tahun 2010 kepada RM138 juta pada tahun 2011. Sementara itu Melaka telah menurun 95% atau RM5 juta daripada RM5.03 juta pada tahun 2010 kepada hanya RM0.26 juta pada tahun 2011. Hutang Pulau Pinang telah dikurangkan sebanyak 95% manakala hutang Melaka telah meningkat 15% atau RM134 juta kepada RM866 juta. Jelas PR boleh mengurus ekonomi dengan lebih baik berbanding dengan Melaka.

首相拿督斯里纳吉视沙巴巫统所获的4000万令吉政治献金视为正当及恰当,并公然地驳斥关于砂州首长丹斯里泰益玛目不寻常财富的指控,马来西亚人对此感到失望。泰益的前媳妇莎娜兹揭露,泰益儿子单单一张信用卡,在今年6个月内就狂刷了78万2520令吉55仙。莎娜兹的丈夫,因为
据称在国内外111个银行户口存了7亿令吉,共拥有10亿令吉财产,所以莎娜兹透过伊斯兰法庭索取4亿令吉的离婚赡养费。

还有原本要献给沙巴首长丹斯里慕沙阿曼的4000万令吉政治献金丑闻,如今竟然回应说是给巫统的政治献金,国阵怎么可以纵容这些个人丑闻一直存在,而又拒绝公布其献金真正流向?前国阵国会议员拿督斯里威弗烈声称4000万政治献金已经汇入巫统领袖的个人银行户口,如今,另一位国会议员拉京奥津也声称沙巴州党团领袖根本不知道这笔4000万令吉献金已经捐献给沙巴巫统。

另一个生活奢华的例子是马六甲州首长丹斯里莫哈末阿里鲁斯坦,他为儿子婚礼款待13万宾客,莫哈末阿里声称婚宴只需要60万令吉。莫哈末阿里至今还未交代,是谁这么大方赞助这场婚礼?

民主行动党提议六大反贪措施。第一、制度化领袖公开财产。槟州首长及全体行政议员已经公开财产,并由国际会计公司认可。如果槟州做得到,为什么首相及他的联邦内阁或砂州首长及其行政议员做不到?

第二、那些生活奢华、拥有豪华轿车、在国外拥有巨额存款户口的国阵领袖必须被除名。

第三、政治领袖家庭成员必须被禁止涉及政府合约,以避免另一宗2亿5000万令吉的国家养牛中心的"公寓养牛"丑闻。

第四、那些真正揭发贪污丑闻、最终让涉案人士被控的吹哨人必须获得正当的保护而不是被迫害。

第五、国阵必须交代清楚他们的政治献金,例如捐给沙巴巫统的4000万令吉政治献金。

最后,实行公开招标。没有公开招标,政府工程及合约直接颁发给朋党,导致公款损失,例如新街场空军基地被廉价出售。国阵如何解释砂、沙两州即将以3亿8600万令吉或每间670万令吉设立57间一个马来西亚商店?用670万令吉设立一家一个马来西亚商店来售卖像白糖、白米及盐,还是用来售卖像珠宝首饰、设计师手提袋的奢侈品?

在槟州,民联于2008年执政后,我们马上推行公开招标,结果州政府每年财政预算都有盈余,我们将省下的钱通过"反贪红利"的形式每年派回给人民。

就连房屋及地方政府部长拿督曹智雄也承认,我国因贪污每年损失了260亿令吉。更糟的是,华盛顿全球金融廉正报告也指出,2000年至2009年期间,秘密带出马来西亚的黑钱高达1兆770亿令吉。为了少数几个家族的利益,马来西亚及砂州人民还有多少可以损失?

民联已经证明我们的良好施政能力。2011年总稽查报告指出,槟州的税收从2010年的4亿1100万令吉增加到2011年的6亿300万令吉,增加了47% 或1亿9200万令吉。相比之下,马六甲的税收只有2亿7200万令吉,减少了24%或8400万令吉。

槟州盈余从2010年的3300万令吉增加312%,2011年的1亿3800万令吉。而马六甲的盈余减少了95%或500万令吉,从2010年503万令吉减至2011年26万令吉。槟州的债务缩减95%,而马六甲的债务增加至8亿6600万令吉,涨幅为15%或1亿3400万令吉。很明显地,民联在管理经济方面比马六甲更胜一筹。

DAP urges the Federal government to apologise to all Internal Security Act(ISA) detainees, immediately release all remaining ISA detainees and turn Kamunting Detention Camp into a museum as a reminder of the importance of freedom and human rights as well as heal the nation from the trauma of arbitrary detention without trial merely for opposing BN.

25 years ago on 27 October 1987, I was amongst the first victims of Operasi Lalang detained under the ISA by former Prime Minister Tun Dr Mahathir Mohamad. I remember as a newly-elected MP for Kota Melaka, how stunned I was to hear that I was a threat to national security who would cause the country to descend into chaos, ruin and riots if I was not arrested. Then followed the dark days of solitary confinement, endless interoggation and intimidation to force me to recant which I managed to endure, survive and prevail.

106 Malaysians were arrested during those dark days of 1987, including opposition leaders – 16 of whom were from the DAP, including MPs and State Assemblymen – trade unionists, social activists, environmentalists, Chinese educationists and religious workers. Amongst the prominent leaders detained included DAP's Lim Kit Siang and Karpal Singh, PAS Mohamad Sabu and Datuk Mahfuz Omar and Chinese educationists Lim Fong Seng and Sim Mow Yu.

There were also wholesale attacks on press freedom with the closure of three newspapers, the merciless attacks on the independence of the judiciary and the rule of law resulting in the sacking of the Lord President and two Supreme Court judges. All these measures were directed at establishing an elected dictatorship by concentrating powers in the Prime Minister.

However there is a silver lining behind the mass arrests, in that PAS and DAP leaders established first real contact to clear the fog of lies by UMNO that demonised PAS amongst non-Malays and demonising DAP amongst Muslims. This relationship forged behind iron jail bars 25 years ago formed the basis of co-operation between both parties, allowing PR to coaelesce and strengthen to challenge BN for power at the next historic general elections.

Even though Malaysians have succeeded in forcing the Prime Minister Datuk Seri Najib Razak to abolish the ISA, there is a need for a proper closure to this dark chapter in our nation's history. First all remaining ISA detainees must be immediately released and there must be a full apology by the federal government to all ISA detainees.

Second the Kamunting Detention Camp(KDC) should be turned into a museum, just like Robbens Island prison camp in South Africa that housed freedom fighter Nelson Mandela for 27 years. Turning the hated KDC into a museum will serve as a timely reminder of the importance of freedom and human rights as well as heal the nation from the trauma of arbitrary detention without trial merely for opposing BN.

Finally the Security Offences (Special Measures) 2012 Act (SOSMA), the replacement for ISA must be reviewed with repeal of certain sections, to ensure that the ISA is not reincarnated and return in a new form to haunt the next generations of Malaysian as we have endured for the last 54 years.

25 tahun yang lalu pada 27 Oktober 1987, saya menjadi antara mangsa pertama Operasi Lalang yang ditahan di bawah ISA oleh mantan Perdana Menteri Tun Dr Mahathir Mohamad. Saya ingat lagi bagaimana sebagai Ahli Parlimen Kota Melaka yang baru dipilih, betapa terkejutnya saya apabila diberitahu bahawa saya merupakan ancaman kepada keselamatan negara yang bakal mencetus huru-hara dan rusuhan sekiranya saya tidak ditahan. Ekoran daripada itu, saya terpaksa bertahan dan mengatasi hari-hari gelap apabila dikurung sendiri, disoal siasat tanpa henti dan diintimidasi untuk memaksa saya untuk “bertaubat”.

106 pemimpin Malaysia telah ditahan pada tahun gelap 1987, termasuk pemimpin-pemimpin pembangkang – 16 daripada DAP termasuk Ahli Parlimen dan Ahli Dewan Undangan Negeri – ahli-ahli kesatuan sekerja, aktivis sosial, aktivis alam sekitar, pendidik bahasa Cina dan pekerja agama. Antara pemimpin-pemimpin yang terkemuka adalah Lim Kit Sang dan Karpal Singh daripada DAP, Mohamad Sabu dan Datuk Mahfuz Omar daripada PAS dan pendidik bahasa Cina Lim Fong Seng dan Sim Mow Yu.

Serangan juga berlaku ke atas kebebasan akhbar dengan penutupan tiga suratkhabar, serangan bertubi-tubi ke atas badan kehakiman dan keluhuran undang-undang sehingga Ketua Hakim Negara dan dua hakim Mahkamah Agung telah dilucutkan jawatan. Semua serangan ini bertujuan untuk membentukkan negara diktator yang memusatkan kuasa di tangan Perdana Menteri.

Namun demikian, ada juga hikmah di sebalik tahanan beramai-ramai yang berlaku, iaitu pemimpin-pemimpin PAS dan DAP telah mendapat peluang untuk saling kenal-mengenali lantas memecahan fitnah yang ditaburkan UMNO untuk memomokkan masyarakat bukan Melayu tentang PAS dan masyarakat Melayu tentang DAP. Hubungan yang dijalin dalam tahanan 25 tahun lalu telah menjadi batu asas kepada hubungan kerjasama antara dua parti pada hari ini. Ini membenarkan PR untuk bergabung dan memperkuatkan diri untuk mencabar kuasa BN menjelang pilihan raya umum yang akan datang.

Walaupun rakyat Malaysia telah berjaya memaksa Perdana Menteri Dato’ Sri Najib Tun Razak untuk memansuhan ISA, kita masih perlu menutup jilid gelap dalam sejarah negara kita. Pertama sekali, semua tahanan ISA yang masih lagi ditahan harus dilepaskan dengan segera dan kerajaan Persekutuan haruslah meminta maaf kepada semua tahanan ISA.

Kedua, Kem Tahanan Kamunting (KDC) harus dijadikan sebuah muzium, seperti kem tahanan Robbens Island di Afrika Selatan yang pernah menjadi rumah kediaman pejuang kemerdekaan Nelson Mandela selama 27 tahun. Dengan menjadikan KDC yang dibenci itu sebagai muzium, kita akan menukarkannya kepada simbol peringatan kepada peripenting kebebasan dan hak asasi serta memulihkan negara daripada trauma penahanan tanpa bicara yang dilakukan secara rambang hanya kerana menentang BN.

Akhirnya, Akta Kesalahan Keselamatan (Langkah-langkah Khas) 2012 (SOSMA), iaitu pengganti kepada ISA, harus dikaji semula untuk memansuhkan beberapa seksyen supaya ISA tidak akan kembali daripada kubur dan menghantui generasi-generasi rakyat Malaysia yang akan datang, sepertimana kita telah dihantui selama 54 tahun yang lalu.

25年前的1987年10月27日,我成为时任首相敦马哈迪利用内安法令展开首次茅草行动下的其中一个受害者。我当时是刚上任的马六甲市区国会议员,我还记得,当我被告知已经威胁国家安危,如果不被逮捕就会引发社会动荡时,我是如何的惊讶。接着我被逮捕,独自克服黑暗的一天又一天、不间断被审问,也被恐吓逼我"悔改"。

1987年的黑暗年份,共有106名大马领袖被逮捕,他们包括反对党领袖、职工会领袖、社会分子、环保分子、华教人士及宗教员工。其中最著名的领袖包括行动党的林吉祥和卡巴星,伊斯兰教党的莫哈末沙布,华教人士林晃升和沈慕羽。

新闻自由被干扰,3家报馆被停刊,司法和法治被剥权,最高法院院长及两位最高法院法官被革职,所有的行动只是首相要集权在他一人之手,成立一个霸权的国家。

虽然如此,大规模逮捕也让伊斯兰教党和行动党领袖有机会互相认识,粉碎巫统散播的谣言,就是非马来人社会反伊斯兰教党和马来社会反行动党。这25年前结下的情谊已经成为两党今日互相合作的基石,以致民联能以加强结合,在来届大选挑战国阵。

虽然人民已经成功迫使首相拿督斯里纳吉废除内安法令,我们还有必须关闭国家历史上黑暗的一章。首先,必须释放所有还被内安法令扣留者,联邦政府必须向所有扣留者道歉。

第二,甘文丁扣留营应该成为博物馆,就如纪念南非罗本岛监狱作为纪念纳尔逊因争取独立而被扣留27年的博物馆。令人憎厌的甘文丁扣留营作为博物馆,这是提醒人权和自由重要性的象征,将这个国家从只因对抗巫统就被未经审判扣留的创伤中恢复过来。

最后,2012年国家安全罪行(特别措施)法令取代内安法令应该重新检讨,废除一些部分,确保内安法令不会借尸还魂,继续残害马来西亚的下一代,就好像过去54年残害了我们一样。

BN gagal dalam 6 ujian anti rasuah

BN telah gagal dalam 6 ujian anti-rasuah iaitu pengisytiharan harta secara terbuka, pelaksanaan tender tebuka, melarang ahli keluarga daripada urusan perniagaan dengan kerajaan, menggugurkan pemimpin BN yang hidup mewah, melindungi peniup wisel yang tulen dan berterus terang tentang sumbangan politik.

Justeru, Setiausaha Agung DAP, Lim Guan Eng berkata, rakyat Malaysia kecewa kerana Perdana Menteri Datuk Seri Najib Tun Razak menganggap sumbangan RM40 juta kepada Umno Sabah dibuat dengan cara yang betul dan juga menolak dakwaan kekayaan luar biasa Ketua Menteri Sarawak Tan Sri Taib Mahmud. 

Lagi satu kes, ujarnya adalah kehidupan luar biasa Ketua Menteri Melaka Datuk Seri Mohd Ali Rustam, di mana seramai 130,000 orang tetamu telah dijamu dalam kenduri kahwin yang memecahkan rekod. 

“Sehingga hari ini, Ali Rustam gagal menjelaskan siapa yang menaja kenduri mega tersebut, yang Ali Rustam mengatakan hanya menelan belanja RM600,000,” ujarnya dalam ucapan pada Konvensyen Tahunan DAP Melaka di sini, hari ini. 

Sehubungan itu, beliau yang juga Ahli Parlimen Bagan berkata, DAP mencadangkan enam langkah untuk membanteras rasuah. 

Pertama, ujar beliau pengisytiharan harta secara terbuka hendaklah diinstitusikan. Ini, katanya telah dilakukan di Pulau Pinang di mana Ketua Menteri dan seluruh barisan Exco negeri telah mengisytiharkan harta secara terbuka, malah diiktiraf oleh firma akauntan antarabangsa. 

“Jika Pulau Pinang boleh melakukannya, kenapa Perdana Menteri dan Kabinet Persekutuan atau Ketua Menteri Sarawak dan barisan Exconya tidak boleh buat yang sama?” soal Lim yang juga Ketua Menteri Pulau Pinang. 

Kedua, katanya pemimpin-pemimpin BN yang hidup mewah dengan memiliki rumah-rumah mewah, kereta, akaun bank peribadi yang besar di luar negeri harus digugurkan; ketiga, ahli keluarga harus dilarang daripada urusan perniagaan dengan kerajaan untuk mengelak lagi satu skandal RM250 juta "lembu dan kondo". 

“Keempat, peniup wisel tulen yang membongkarkan kes rasuah yang mengakibatkan dakwaan mahkamah harus dilindungi dan bukan dianiaya.

 “Kelima, BN harus berterus terang tentang sumbangan politik seperti sumbangan RM40 juta kepada Umno Sabah.

Akhirnya, tender terbuka harus dilaksanakan,” katanya lagi. 

Beliau menambah, tanpa tender terbuka, projek-projek awam dirunding terus dan dianugerahkan kepada para kroni, lantas menyebabkan kerugian dana awam seperti jualan murah tanah Pangkalan Tentera Udara Sungai Besi.

I do agree with the Minister of Transport that a thorough investigation into this matter and drastic actions must be taken against the person or persons responsible for the failure of the runway lighting. It is premature to hold any particular person responsible before the investigation. However, as the runway is under the care and control of MAHB, therefore, MAHB must take the initial responsibility until the result of the investigation.

The Transport Minister has called for an investigation. He said that no one would be spared and warned of stern action against the “careless party”, be they individuals, local authorities or the airport operator.

Sabah’s Tourism, Culture and Environment Minister Masidi MA Jun said the reputation of MAB and KKIA could be tarnished because of the problem.

There are also unverified reports that renovation works at KKIA are badly behind schedule.

Bekas bendahari MASEU pecah amanah dakwa hari ini

KUALA LUMPUR: Bekas bendahari Kesatuan Pekerja Sistem Penerbangan Malaysia Semenanjung Malaysia (MASEU) hari ini dihadapkan ke Mahkamah Sesyen di sini atas tuduhan melakukan pecah amanah jenayah membabitkan RM1 juta dana kesatuan tersebut pada tahun 2002.

Abdul Gani Mohd Amin, 60, dari Taman Bidara, Selayang bagaimanapun mengaku tidak bersalah.

Hakim Akhtar Tahir membenarkan Abdul Gani dijamin sebanyak RM100,000 dengan seorang penjamin dan menetapkan 2 hingga 5 Okt depan untuk perbicaraan.

Beliau juga mengarahkan Abdul Gani menyerahkan semua dokumen perjalanan kepada mahkamah sebagai syarat jaminan.

Abdul Gani seorang mekanik kanan pesawat didakwa melakukan kesalahan itu di pejabat Syarikat Concentric Series Sdn Bhd di Jalan Medan Tuanku di sini antara 6 Jun 2002 dan 28 Jun 2002.

Dia didakwa mengikut Seksyen 409 Kanun Keseksaan yang membawa hukuman penjara minimum dua tahun dan maksimum 20 tahun, dengan sebatan dan boleh dikenakan denda jika sabit kesalahan..

Bagaimanapun, Abdul Gani terlepas hukuman sebatan jika didapati bersalah kerana faktor usia.

PAS Kawasan Jerlun dengan kerjasama Pusat Khidmat Wakil Rakyat (PKWR) DUN Ayer Hitam dan Pusat Khidmat DUN (PKD) Kota Siputeh telah menganjurkan Ijtimak Korban Perdana 2012 pada 28 Okt 2012 di perkarangan Markaz PAS Kawasan Jerlun, KM 22, Kg Lubuk Pinang. Dalam majlis tersebut, YB Ust Abd Ghani telah menyampaikan  tazkirah berkaitan kepentingan mengadakan qurban dan petikan sejarah Nabi Ibrahim AS yang diperintahkan menyembelih anak kesayangannya, Nabi Ismail AS. Seterusnya YB telah menyampaikan sumbangan daging qurban kepada Pengerusi & Setiausaha MKK untuk dibawa pulang dan diberikan kepada golongan yang berhak di kampung masing-masing.
      
Dalam Ijtimak Korban tersebut, sebanyak 12 ekor lembu telah dibuat korban di mana sebanyak 532 bungkus berjaya diagihkan kepada semua Pengerusi & Setiausaha MKK. Buat julung kalinya inilah pertama kali majlis seumpama ini dianjurkan oleh PAS Kawasan Jerlun, PKWR dan PKD. Acara tersebut bermula seawal jam 7 pagi lagi di mana semua lembu telah dikorban di pusat penyembelihan lembu di Kg Tempayan Pechah dan seterusnya dibawa ke Markas PAS Kawasan Jerlun untuk dibungkus dan diagihkan. Majlis tersebut selesai sekitar jam 12 tengahari dan diakhiri jamuan kepada semua yang hadir.

YANGON - Human Rights Watch, sebuah badan hak asasi manusia, mengedarkan foto-foto yang menggambarkan kemusnahan teruk di sebelah barat Myanmar yang dilanda rusuhan kaum.

Rusuhan sejak awal minggu ini telah memusnahkan 800 rumah dan bangunan serta lebih 60 orang terbunuh.

Foto satelit dikeluarkan Human Rights Watch menunjukkan kira-kira 10 hektar (35 ekar) musnah di Kyaukpyu, bandar tepi pantai di Rakhine.

Kumpulan hak asasi manusia itu berkata kebanyakan penduduk kawasan tersebut adalah etnik Rohingya Islam.

Laporan dipetik BBC berkata, kebanyakan penduduk telah meninggalkan lokasi sasaran yang dijadikan sasaran ke kawasan laut menggunakan bot.

Timbalan Pengarah Human Rights Watch bagi Asia, Phil Robertson berkata, perkembangan itu menunjukkan kerajaan Myanmar perlu mengambil langkah keselamatan dengan segera bagi melindungi penduduk Rohingya di negeri Rakhine.

Dahulu Rakhine dikenali sebagai Arakan.

"Melainkan pihak mula mengenal pasti punca asas keganasan, ia akan bertambah buruk," kata Robertson.

Laporan itu juga berkata, dalam tindakan tegas kerajaan kali ini, beberapa orang bukan Muslim juga ditembak oleh pasukan tentera pihak pemerintah.

Satu lagi laporan menunjukkan sekurang-kurangnya 64 orang terbunuh dalam rusuhan kaum sepanjang lima hari lalu sehingga semalam.

Semalam, enam bandar berhadapan dengan pertempuran. Perintah berkurung dikenakan di beberapa lokasi termasuk Min Mya dan Mrauk Oo.

Ayoyo Samy Vellu, Sendiri Lulus Sendiri Demo Bantahkah?


Demonstrasi yang diketua bekas Presiden MIC, Samy Vellu yang berlakon sandiwara kononnya membantah cadangan projek pembinaan kondominium 29 tingkat di Batu Caves, Selangor berhampiran dengan patung Lord Muruga, semalam, diberitakan tak sampai 300 saja yang turun berikan sokongan!!!!!

Walaupun disebar melalui SMS dan laman sosial beberapa pemimpin parti itu, ia nyata gagal menarik perhatian masyarakat India terutamanya di sekitar kuil tersebut.

Sepatutnya jika diukur dari kata-kata besar berdegar-degar para pemimpin MIC, paling koman, sengkek dan kokak pun 30,000 kaum India/Hindu yang wajib hadir kerana MIC telah mainkan isu agama Hindu tergugat demi meraih simpati dan sokongan. Namun hambar!!!!!

Mengapa boleh jadi sebegini rupa?

Kaum India rata-rata sudah mengetahui projek berkenaan diluluskan Majlis Perbandaran Selayang (MPS) pada 2007 dan paling memedihkan, empat pemimpin Barisan Nasional (BN) negeri sudah mempersetujui pembinaan tersebut.

Inilah yang menyebabkan demo MIC ditolak dan yang hadir kebanyakkannya penyokong parti itu yang datang dari Kuala Selangor dan Kapar yang tidak mengetahui kisah sebenarnya.

Samy Vellu dalam ucapannya yang berapi-rapi membidas pedas Menteri Besar Selangor, Tan Sri Khalid Ibrahim dan Exco Kerajaan Negeri, Xavier Jayakumar kerana terus membenarkan pembinaan walaupun sudah dibantah penduduk setempat sejak lebih lima tahun lalu.

Exco Kerajaan Negeri Selangor Dr Xavier Jayakumar, pula membidas kenyataan pengerusi kuil R Nadarajan yang memutar belit fakta kononnya kerajaan negeri tidak menghalang pembinaan dari diteruskan.

Maka berlakulah sesi tuduh-menuduh yang akhirnya rakyat menjadi mangsa kerakusan pemimpin BN yang tidak mengendahkan bantahan yang dibuat.

Tan Sri Khalid Ibrahim pula sudah mengarahkan pembinaan dihentikan sementara menunggu hasil siasatan penilaian alam sekitar (EIA) yang diluluskan pada tahun yang sama.

Timbalan Menteri Luar, A Kohilan Pillay yang pernah menjadi ahli majlis MPS turut tumpang semangkuk menyalahkan kerajaan negeri padahal dia adalah antara pemimpin MIC yang meluluskan projek itu.

Jika beginilah tindakan MIC menyalahkan kerajaan negeri semata-mata tanpa mengaku merekalah yang bertanggungjawab mengabaikan kebajikan kaum mereka sendiri, jangan terkejut sekiranya parti itu sudah tidak relevan lagi dalam pilihanraya umum akan datang.

SENDIRI LULUS SENDIRI BANTAH DAN TUDUH KERAJAAN PR YANG LULUS!!!!! CUBA NAK HERET ISU AGAMA DENGAN PATUNG LORD MURUGA DAN BATU CAVES TEMPAT PERAYAAN THAIPUSAM DIJADIKAN BAHAN NAMUN WARGA INDIA/HINDU TIDAK TERMAKAN.

INI PETANDA JELAS YANG MENGATAKAN UNDI KAUM INDIA SUDAH BERPINDAH KE BARISAN NASIONAL HANYALAH OMONG-OMONG KOSONG!!!!
