Press statement on amendments to Election Offences Act

Posted: 22 Apr 2012 02:55 AM PDT

Election Offences Act amendments - BN attempt to steal GE 13

Last Thursday, the BN government and their cohorts the SPR clearly demonstrated in unequivocal terms their intent to steal GE 13. They presented a bill to amend the Election Offences Act 1954 to further restrict scrutiny of the voting process by representatives of political parties and make the system more amenable to manipulation.

The original changes proposed included the following:

a. removing the right of political parties to set up booths to assist voters establish their names on the electoral roll and saluran numbers identity of voters before going into polling stations ( called "pondok panas" ) [ section (26)(1)(e) ]
b. removing the right of political parties to have representatives observing the process in the SPR booths inside polling stations ( Barung SPR ) where voters check their names and get their saluran numbers etc [section 26A]
c. amending section 14 (1A) so that the SPR would dictate the time of arrival and departure of polling and counting agents of candidates at polling stations. The current law provided for polling and counting agents to arrive at the time decided by the political parties as long as they stayed at the polling stations for at least 2 hours.

The net effect of these changes would have been to greatly reduce the current scrutiny of the voting process.

Pakatan Rakyat MPs put up strenuous objections to the amendments. Opposition Leader Anwar Ibrahim warned the BN in the closing words of his speech on Thursday morning that these new provisions would be defied by the opposition even if passed by the BN. He said that Pakatan Rakyat would not give up the established rights under the law which aided transparency in the process.

The BN in the afternoon of Thursday then presented fresh amendments to the Bill backing down on (a) and (c) above restoring the status quo.  However they used their brute majority in the House to ram through the amendment removing party representatives observing the process in the SPR Barung.

Opposition MPs argued to no avail that the SPR Barung was initiated by the BN by amendments in 2003 to assist voters to get their electoral and saluran numbers and had been implemented in the 2004 and 2008 elections without any issues. The lame justification put forward by the BN and the SPR was that "this causes difficulties to the election workers". When asked for reports of such "difficulties" none were cited.

Another controversial amendment pushed through was the removal of section 11(1)(c) requiring all printed material during campaign to bear the name of the publisher and printer. Removal of the onerous requirement of naming the printer all the time would have improved the provision as was argued by PR MPs.  However removing it all together has opened the door to a dirtier election where all sorts of defamatory or inflammatory material could be put out without anyone taking responsibility for them.

What was apparent was that the BN and SPR were not interested in presenting the necessary amendments to the law to implement KEY recommendations by the Parliamentary Select Committee on Electoral Reform. Nothing had been done for example on key issues such as access to the media and the question of how a caretaker government. Even the regulations to implement "early voting" which was to replace the so-called postal voting system for army personnel, their spouses and police personnel were not presented to Parliament by the last day of the sitting leaving open the question of whether the BN and SPR were going to implement this key change for GE 13.

These legislative moves by the BN and SPR on Thursday made it clear that their real intent was to make the electoral process less transparent and easier to manipulate. It is clear that BERSIH 3.0 is needed even more than before. BERSIH's demand that the key recommendations of the PSC report must be implemented before GE 13 is central to a free and fair election.

The Election Commission must resign for the legislative fiasco they caused in Parliament on Thursday and for their intransigence in implementing the PSC report and BERSIH demands.

PKFZ: PKA Does Not Need to Pay KDSB

Posted: 22 Apr 2012 12:54 PM PDT

It was disclosed by former Transport Minister, Datuk Seri Ong Tee Keat that the Port Klang Authority (PKA) has continued to pay Kuala Dimensi Sdn Bhd (KDSB) bondholders despite the fact that PKA has filed RM1.6 billion worth of claims against KDSB for breaches of contract, particularly for making excessive, dubious and fraudulent claims, some of which was for works never commenced.  The last payment made was in June and July last year totally RM733.3 million.

PKA insisted yesterday it had paid holders of bonds issued by Kuala Dimensi Sdn Bhd (KDSB) to avoid breach of contract in light of on-going legal cases in the Port Klang Free Zone (PKFZ) scandal.

The defence is an outright lie because there is no contract term which requires payment by PKA to KDSB or its bondholders if the necessary construction works are not completed.  In fact it is the reverse, where a criminal breach of trust offence has been committed if PKA continued to make the relevant payments despite discovering that the works have not been executed or the claims were fraudulent!

It makes absolutely no sense for the Government to insist on making the payment when the Government itself disagrees that work has not been carried out.  The only possible reason for the PKA and the Minister of Transport, Datuk Seri Kong Cho Ha to insist on making the payment is to protect KDSB.  This is to ensure that KDSB does not get into financial trouble with its bondholders.

This is because, as part of the bond agreement's security arrangements, KDSB has issued two letters of undertaking.  The first is for the construction, development and completion of the project on a turnkey basis; and the second, is to cover any shortfall in the amount payable by PKA vis-a-vis payment obligations under the bond after taking into account the credit balance in the Escrow Account.

KDSB has also granted a "Power of Attorney to [the bondholders] as security to ensure that the development works are completed pursuant to the terms and conditions of the agreements which can only be invoked and exercised by [the bondholders] upon KDSB having defaulted under the agreements."

Based on the above letters and power of attorney, it basically means that should the Government fail to make payment for the project to the bondholders due to incomplete works, the bondholders will then demand from KDSB any shortfall in the amount payable by PKA, and on top of that undertake legal action against KDSB for failing to complete the project and for the bondholders to take over the development works of the project.

These actions will obviously mean substantial losses of profit by KDSB, a company owned by Barisan Nasional (BN) backbencher's chairman, Datuk Seri Tiong King Sing.

PKA's claim also contradicts the advice from its legal advisors during the tenure of Datuk Lee Hwa Beng as its chairman who specifically advised withholding the payments to ensure maximum recoverability in the event of fraud proven.

Hence to avoid the above outcome, Datuk Seri Kong Cho Ha has chosen to instruct PKA to make the payments which are "due" despite the on-going dispute and litigation, to ensure that one of the biggest beneficiaries of BN patronage projects remains an on-going concern.

Did Dr Mahathir Forget He Awarded the MEX Concession?

Posted: 22 Apr 2012 12:54 PM PDT

It was reported in newspapers on Wednesday that Dr Mahathir criticised the sale of Maju Expressway by concessionaire owner Tan Sri Abu Sahid Mohamed for essentially selling "what is not his" and making a huge killing in profits as a result.

Tan Sri Abu Sahid Mohamed who owns 96.8% of the highway has only effectively forked out RM60 million for the project, but with the proposed acquisition by EP Manufacturing Bhd (EPMB), he would effectively be making a NET profit of RM1.09 billion.  That works out to more than an astronomical 1,800% return on investment in less than 8 years since construction began in 2004 for MEX.

The rape of Malaysian tax-payers which made a billionaire out of Tan Sri Abu Sahid Mohamed on this exercise alone is simply outrageous and unacceptable because out of his "profit", RM976.7 million was paid for by Malaysian tax-payers.  The grant hence constitutes 74% of the total cost of construction for the RM1.32 billion highway.

According to Dr Mahathir, the Maju Expressway sale appears to be an exercise of making money from government assistance and Tan Sri Abu Sahid Mohamed should explain himself to the public.  "You sell what is yours, you don't sell what belongs to others. It could be as bad as selling APs," Dr Mahathir told reporters, referring to the frowned upon practice of well-connected Bumiputera businessmen making quick profits from nothing more than selling import licences granted by the government.

Dr Mahathir's argument is twisted and illogical on the simple basis that it was he himself who had awarded this lopsided concession agreement to Tan Sri Abu Sahid in 1997 and subsequent revised the agreement and terms of the concession in 2003 prior to his retirement.

Dr Mahathir did not offer a government loan amounting to RM976.7 million to Tan Sri Abu Sahid which will require repayment to the Government.  Dr Mahathir had instead given Maju Expressway a grant of the same amount from the tax-payer's coffers which by definition, did not require any repayment by the concession.

Hence it is extremely rich, coming from our former prime minister to chastise Tan Sri Abu Sahid for making astronomical profits from the government concession, when it is in fact the Dr Mahathir who gave to him on a silver platter!

Whether Tan Sri Abu Sahid sells the concession valued at RM1.7 billion or decides to keep it for the remainder of the concession period ending 2037, he will still be making that ridiculous amount of profit in return for his tiny RM60 million investment.  In fact, if he were to keep the concession, he is expected to collect more than RM7.6 billion in toll over the next 25 years.

Hence whether Tan Sri Abu Sahid sells his concession today to realise RM1.09 billion in profits or to keep it over the next 25 years and realise even more profit is moot.  The issue is simply, the BN government has chosen to award outrageously lucrative concession contracts to its cronies and this practice has continued today with the award of the West Coast Expressway, despite the so-called Economic Transformation Programme by Datuk Seri Najib Razak.

Dr Mahathir Mohamed's crying over spilled milk smacks of hypocrisy and self-righteousness, because it was his Government who awarded these unfair contracts to its cronies enabling them to make ludicrous profits at the expense of the man-on-the-street.  If Dr Mahathir is sincere about not allowing the concessionaires to make these crazy profits, he should support Pakatan Rakyat's position to expropriate MEX per the concession contract at only RM400 million to ensure that the people's welfare is protected.

NEGARA KAYA - KITA MAMPU MANSUH PTPTN - PAKATAN RAKYAT TAWAR PENDIDIKAN PERCUMA

NEGARA KAYA - KITA MAMPU MANSUH PTPTN - PAKATAN RAKYAT TAWAR PENDIDIKANPERCUMA

Petronas punyai keuntungansetahun RM 90 bilion.

Failure Of Any Integrity Pledge To Include A Commitment To Publicly Declare Assets By Government Leaders Would Make Such An Integrity Pledge An Exercise In Futility In Committing Towards Full Public Accountability. (en/cn)

Speech By Penang Chief Minister Lim Guan Eng During The Inaugral Penang 2012 Wesak Day Celebrations In Dewan Sri Pinang On 22.4.2012.

Penang state government celebrates its first ever Penang Wesak Day Celebrations at Dewan Sri Pinang to honour the birth, enlightenment and the passing away of Gautama Buddha 2,556 years ago. Today's event is part of the program of the newly-established Non-Muslim Religious Affairs EXCO portfolio headed by me. Themed 'Patriotism and Religious Harmony for a United Malaysia', the celebration, which will take place two weeks before the actual Wesak Day on May 5, will trace the history of Buddha.

The event is open to all Malaysians and seeks to promote understanding and respect of each other's different religious beliefs. As George Town is a UNESCO World Heritage City, Penang is the perfect platform for a diverse eco-system that allows all religions and cultures to flourish and co-exist in harmony. I wish to thank the Malaysian Buddhist Association under its President Ven Ren Yi and Dato Steven Ooi for working with Komtar ADUN YB Ng Wei Aik to make this event a success.

In accordance with Tripitaka or Triple Gem of Buddha, dhama(Buddhist law) and sangha(monks), running a government must be in accordance with the principles of the rakyat, law as well as good and clean leadership. The people deserve a people-centric government that upholds the rule of law. This is achieved through the Penang CAT governance of Competency, Accountability and Transparency, which have brought tremendous progress to the financial health of Penang.

Penang has achieved record budget surplus every year for the last four years not just in Penang state government but also our local government and state government agencies. Penang recorded the highest budget surpluses in history with RM88 million in 2008, RM 77 million in 2009 and RM33 million in 2010.

Majlis Perbandaran Seberang Perai or MPSP recorded surpluses – 2008 RM 3 million; 2009 RM 15 million and 2010 RM 23 million and RM13.6 million in 2011. Majlis Perbandaran Pulau Pinang or MPPP, it recorded RM20.1 million in 2008; RM48.1 million in 2009 and RM89 million in 2010.

Only with these surpluses, the state government can give cash handouts to the elderly, new born babies, primary, secondary and university students but also undertake many development projects of more roads, drainage and green parks. It is not easy for politicians to have a clean leadership practicing CAT. However just like a lotus flower that grows out of the mud and blossoms above the muddy water surface, we can rise above the muddy water and not dirtied by the mud from which you grow.

For this reason, Penang state government is the first state government to implement open tender, disclose the contents of government contracts and declare the personal assets of EXCO members, including the Chief Minister. For this reason, any Integrity Pledge by leaders must necessarily include a commitment to publicly declare assets. Failure to do so would make this Integrity Pledge meaningless and an exercise in futility to ensure full public accountability.

Penang's clean management and anti-corruption efforts have been praised not only by the Auditor-General Reports every year but also by Transparency International. Even foreign investors have confidence in Penang by making Penang the No.1 or top investment location in Malaysia for the first time in Penang's history in 2010 and repeating that in 2011. For the second smallest state in Malaysia, Penang is proud to contribute towards 30% of Malaysia's FDI from 2010-2011.

Penang Port Sdn Bhd (PPSB) And The Penang Port Commission (PPC) Should Fully Apologise to The Hindu Community for The Disrespect And Religious Sacrilege (en/bm/cn)

Speech By Penang Chief Minister Lim Guan Eng At The "Justice For Sri Lankan Tamils" Ceramah In MPSP Padang In Butterworth, Penang On 21.4.2012 Released On 22.4.2012.

Penang Port Sdn Bhd (PPSB) And The Penang Port Commission (PPC) Should Fully Apologise to The Hindu Community for The Disrespect And Religious Sacrilege In The Demoliton Of The 50 Year Old Hindu Temple/Shrine In Their Premise Without Notice And Pay Full Compensation By Giving Land And Funds For Its Rebuilding.

We gather here to condemn the oppression of Sri Lankan Tamils and oppose the ethnic cleansing of Tamils by the Sri Lankan government. Whilst we seek justice in the interests of humanity for Sri Lankan Tamils, we must also seek justice for the freedom of religion of our local Hindu population.

PPSB and PPC should fully apologise to the Hindu community for the disrespect and religious sacrilege in the demoliton of the Hindu temple in their premise without notice and pay full compensation by giving land and funds for its rebuilding. The 50 year old temple/shrine used by Penang port workers was located in the Prai Bulk Cargo Terminal (BCT) within the property of PPSB was demolished on Friday.

Both PPC Chair Datuk Seri Chua Soi Lek and PPSB Chairman Dato Seri Dr. Hilmi Bin Hj. Yahaya should immediately meet and explain to the port workers and the Hindu community why they permitted this barbaric act to occur. Worse, no notice was given to the workers of the impending demolition.

The Penang state government is shocked by such demolition and strongly condemns this grave injury to the fabric of freedom of religion and insult to the Hindu community. I shall be visiting the site tomorrow with YB Professor P Ramasamy to have a first hand look at the site.

Ucapan Ketua Menteri Pulau Pinang Lim Guan Eng di Ceramah "Keadilan Untuk Rakyat Tamil Sri Lanka" di Padang MPSP, Butterworth, Pulau Pinang pada 21.4.2012 dan disiarkan pada 22.4.2012

Penang Port Sdn Bhd (PPSB) Dan Penang Port Commission (PPC) Harus Meminta Maaf Kepada Masyarakat Hindu Kerana Tidak Menghormati Malah Mencabul Agama Dengan Perobohan Kuil Hindu Berusia 50 Tahun Di Kawasan Mereka Tanpa Pemberitahuan Dan Harus Membayar Pampasan Penuh Dengan Memberi Tanah Dan Juga Dana Untuk Pembinaan Semula.

Comment on Internet Access BLOCKED in MAS! by janed

Posted: 22 Apr 2012 07:00 AM PDT

This is particularly directed to one "Hamid" (believed to be a union head) who in a previous thread had insulted the YB with his comments.

The problem with mas is externally induced.
All was well until Mahdey decided to take mas private with t-judyen, and the airline went downhill……Mas never recovered since then to this date.

a-Jay and Hamid should read one of the previous thread, where it was said that AA has 9000staff and With a turnover of 4,5b, that means each AA staff contribute to 500,000 of income to the company.
Whereas, at mas, with 20000staff and a turnover of 15b, each staff contribute to 750,000 of income to the company.

a-Jay…..THIS SHOWS THAT STAFF AT MAS IS MORE PRODUCTIVE THEN AA STAFF.

Do not blame the staff at mas for the losses. The staff at mas is more productive than AA and the turnover is a lot, so where is the loss…..
The loss, at mas is, political interferences, leading to corrupt practices, and external leakages.
After siphoning out the money, Then as usual, the gomen will say mas is in trouble and will need a bailout and pump in public funds. Gomen takes public money indirectly and as usual the innocent hard working mas staff gets the blame.

Years ago, when we had the chance to get a professional and non bumi ceo, umm-noo made sure that did not happen. the gomen used the opportunity to instil “their” man and screw up the company.

If the TRIO do not want their scandals to be out in the open then don’t do it. Just look after the interest of MAS and its staffs. But they don’t so they must face it, We are determined to expose them further until they cannot walk the street.

As it were they should be mall enough to stop what they are doing i.e. canabalising MAS for the Pariah.

Pariah, what had happened to your Caterham aka EMAS airline? Please go ahead as long as MAS is not involved. We don’t care about the Pariah as long as the Pariah is not in MAS.

Criminal Conflict of Interest
—————————–

Having gone thru yr blog

I find it strange that the

power-that -be in sprm,dpp’s,bnm

did not alert the gomen on the

serious criminal aspect of the

conflict of interest that is

taking place between binafu*ker[bfr]

and MAS.

.

Azman moktar [am] , director of bfr

appointed his staff

-fellow director in bfr -de mf danny

as deputy chief in MAS.

.

And Azman can be said to use his powers

wrongly [abuse of power] to appoint his

company to be consultant when he is the

ceo of kazanah.

Now is this not an offence ? [pca]

.

All this funny bisnis can be traced back

to madey-the pirate king who ‘halal-ised’

the malaysia inc concept. The akta rahsia

is put aside on gomen-private sector relationships!

So sprm , study this seriously and please

tell us how different is this compared to

mat trafik polis who is receiving financial

allowance from the people who he wanted to

summon but did not? [also an example of gomen-public relationship]

.

Suggesetion to mat -mat at sprm:

Stop catching the poor mat trafik or konstabel

for a few dollars of financial gain compared to

the millions that am and mat kelate danny are screwing

gomen with their ruse.

.

Why MH BOD did not take action?

——————————–

.

It would appear that the members of the

BOD are akin to mat/minah/chingkie chong

staying in glass houses!!

So cannot disturb the scene, yes?

look at the sample of the MH BOD characters-

>andy sheng – sister revealed that she was keeping

stocks of andy who do insider trading

> rafidah -de madam a/p

>azman yahya – involved in wau no 1- asset stripping no 1

>legal adviser mat wafi – apparently have said had given

advice in the competion matter but ignored. Whether he gave

advice to bod on the piratisation of mas kitchen , dubious.

This is because he would not likely be around had he

given the right advice the first time around!

[ wafi is apparently also dean at law faculty at uia.

One can imagine what kind of lawyers the uia is producing!]

>Mat nor [md] -legacy from wau no 1 .

also involved in the approval of the abovementioned piratisation.

I hope yb can raise this interesting facet

of the wau episode in parliament.

Pork-barrel fund for bn-umno
—————————–

.

I suspect that the ultimate benefactor of this

MAS restructuring is bn-umno trying to cash

in and at the same time do a scorched-earth

policy on the mas bisnis transferring mas asset

to air-asia which umno will ultimately owned

in the background as a hidden hand. The model

of a pork-barrel fund financing the take -over

of the perak gomen allegedly masterminded by

madey -the great pirate flashes in my mind!

Similar dirty ventures are envisaged should

bn-umno lose control of many states….

This is the result from Deadwood Panamera department. Thoughtless is considered nice word. I will consider it as stupid decision and action plan.

Is this what IT department can do? Is this what you can offer from RM200M annual budget department? That shows the stupidity of yours… Blocking access to external Internet mail.

Stupid people recommend stupid action plan and decided by stupid trio… End up MAS community become stupid, they assumed. Never, MAS community is smarter lah…

Next step, they will recommend to block all access to MHMail from external…. Good luck. This will introduce complexity to MAS business operations or probably disruption.

Since Disasterous IT outsourcing project in 2003 to IBM, Getronics, SITA and TCS, there is nothing that this department had offered to business; even more and more consultants hired. They should be out too…

There are so many postings here, Not a single one has ever been refuted by any of the TRIO. Danny the maid upgraded can only swear invoking Allah’s name by reading the verses in his handphone. But he dared not come out in the open to deny it.

If the TRIO is doing good for MAS why the f..k is there to be worried about outflow of info. Furthermore, if they are good for MAS no staff will attack them. It was because of their selfish interest to please the Pariah and Amok that they are in so much shit now.

That AJ good for nothing idiot is sucking to the Pariah to its hilt. Heard he has extended Shane Nollan appointment. THe good for nothing Irish idiot who was working for Aerlingus and he failed miserably there.

Aj is only good for the Pariah by appointing Pariah’s cronies like Rozman, Azhari Dahlan and Nor Zalida.

How to turn around MAS when you are appointing idiots and charging extreme low fares to AAX. MAS will have to carry the burden.

Now blocking internet. For heven sake, I have Iphone $S and i can do wonders that the idiot AJ can imagine.

Get out of MAS is the only destination for Uncle WAU Md Nor, Danny the maid up-grader and the Pariah’s cronies like Rozman, Azahari Dhalan and Nor Zalida.

The incompetence people like the TRIO will only do this. The TRIO will appoint CONsultant again and pay them million RM to do the dirty job for them. Instead of looking for revenue they are wasting opportunities and MAS fund.

The Re-accommodation exercise is the classic example. Charging AirAsia X fares that a are lower than lowest fares sold online to normal customers. Other airlines must be laughing at the MAS.

ENough is enough. AJ, Md Nor and Amok’s crony Rashdan the Nanny Danny, we will carry on to fight the TRIO until they are out.

The TRIo can no longer fool us. They are just the cronies of the Pariah.
