Isu-isu yang dibangkitkan oleh YB Dr Xavier Jayakumar, ADUN Seri Andalas di Dewan Negeri Selangor ketika Ucapan Menjunjung Kasih Sempena Perasmian Mesyuarat Pertama (Pembukaan) Persidangan Penggal Pertama Dewan Negeri Selangor pada 2 Januari 2013.

Isu 4:  Projek Pencegahan dan Tebatan Banjir di Klang

"Saya berharap Kerajaan Negeri segera melaksanakan projek tersebut yang bernilai RM5.3 juta yang telah diluluskan tahun lepas di 3 kawasan tadahan di Sungai Teluk Gadong, Sungai Aur dan Sungai Puluh di Klang.

Selain daripada itu, saya memohon Kerajaan Negeri untuk menyegerakan pembinaan sebuah kolam takungan di Taman Botanik yang dibina dengan usaha sama syarikat Harum Intisari anak syarikat kepada MMC Gamuda dan pihak Majlis Perbandaran Klang yang sepatutnya siap pada penghujung bulan Julai ini.




Projek ini masih lagi belum berjalan walaupun majlis pecah tanah kolam takungan telah dirasmikan oleh Dato' Menteri Besar pada 18 Februari yang lepas. Kerajaan Negeri hendaklah menyarankan supaya pihak Majlis Perbandaran Klang memberi keutamaan kepada projek ini supaya masalah banjir dikawasan berkenaan dapat diatasi segera.

Saya juga mencadangkan agar pihak Kerajaan Negeri membeli beberapa keping tanah persendirian yang telah dikenalpasti di Batu Ampat dan Taman Sentosa di dalam Dun Seri Andalas bagi pembinaan kolam-kolam tadahan.


Tempat-tempat yang dikenalpasti ini adalah;

Pertama, kawasan di simpang empat di hadapan KFC Taman Sentosa.

Kedua, di Batu Ampat, kawasan seluas 5 ekar berdekatan Sekolah Jenis Tamil Batu Ampat.

Ketiga, kawasan seluas 5 ekar di Alam Impian.


Kertas kerja berkaitan kawasan yang telah dikenalpasti ini hendaklah disediakan oleh pihak Majlis Perbandaran Klang dan Majlis Bandaraya Shah Alam. Sekiranya telah disediakan perlulah dikemukakan kepada Majlis Tindakan Ekonomi Selangor untuk tindakan pembinaan. 

Pembinaan longkang konkrit besar di sebelah kiri dan kanan sepanjang Jalan Kebun bermula dari Batu 3 sehingga bulatan terbesar yang mengubungkan Taman Sentosa, Bukit Tinggi dan Kemuning juga adalah perlu dilakukan.

Kertas kerja telah disediakan Jabatan Pengairan dan Saliran Selangor dan saya minta supaya pihak tersebut kemukakan kepada Kerajaan Negeri untuk tindakan segera.

Dengan adanya kolam-kolam tadahan dan pembinaan longkang konkrit ini, ianya dapat mencegah berlakunya banjir kilat setiap kali hujan lebat di kawasan Taman Sentosa dan kawasan sekitarnya yang menyebabkan penderitaan dan kesusahan terhadap lebih 100,000 penduduk di kawasan berkenaan."

"Saya mencadangkan agar kita mengkaji semula mekanisma yang dilaksanakan di kebanyakan PBT.

Pertama sekali mengenai "harga terendah". Memang pada dasarnya pendekatan mendapatkan "harga terendah" menguntungkan kerajaan, tetapi apa yang berlaku adalah harga terendah tersebut juga menghasilkan  kualiti kerja dan produk yang terendah, tidak sepadan dengan nilai terbaik dengan hormat 'value for money' terhadap wang yang dibelanjakan.



Apa yang terjadi ialah; disebabkan amalan sistem "harga terendah" ini telah menyebabkan hasil kerja tidak memuaskan kerana dalam banyak kerja-kerja pembersihan kawasan contohnya di dalam pakej kerja, ianya tidak termasuk kerja-kerja perkhidmatan dan penyelengaraan seterusnya.

Saya berikan contoh bagi kerja-kerja memotong rumput di dalam sesuatu kawasan. Selepas selesai kerja-kerja memotong rumput dilaksanakan, sisa-sisa rumput tadi dibiarkan berlonggok dan tidak disapu dan di bawa pergi kerana harga terendah tadi hanya melibatkan kerja-kerja 'potong rumput' sahaja.

Jadi saya mencadangkan agar dikaji semula sistem harga terendah tadi atas alasan yang telah saya nyatakan, begitu juga setiap pembayaran perlulah dibuat hanya apabila kerja-kerja yang dibuat telah dipastikan selesai sepenuhnya.

Kedua, saya mencadangkan satu pelaksanaan dasar baru oleh Kerajaan Negeri Selangor yang dilaksanakan di peringkat Kerajaan Negeri dan kesemua PBT iaitu pelaksanaan kuota pemberian kontrak yang baru. 

Dibawah pelaksanaan dasar baru ini, saya cadangkan;

50% kontrak diberikan kepada syarikat bumiputera.

20% kontrak diberikan kepada syarikat bukan bumiputera.

Dan selebihnya 30% dibuka kepada semua.

Dibawah pelaksanaan dasar baru ini, syarat-syarat yang perlu dipenuhi pemohon tender adalah mereka yang telah berdaftar dengan UPEN dan berdaftar dengan Kementerian Kewangan serta CIDB. Kuota ini tidak tertakluk semata-mata kepada kontraktor Kelas F.

Matlamat yang ingin dicapai disini adalah pengagihan kontrak secara lebih adil kepada semua serta mengelakkan gejala perniagaan Ali Baba.

Sekiranya dipersetujui kertas kerja perlu dibuat oleh UPEN dan Kerajaan Negeri menjadikannya sebagai satu dasar yang kemudiannya dilaksanakan di peringkat negeri dan PBT."

Isu 2:  Mencadangkan sebuah Enakmen Melarang Minuman Keras di Kawasan dan Tempat-tempat Awam

"Ini bertujuan memberi kuasa dari segi undang-undang  kepada Pihak Berkuasa Tempatan dan pihak Polis untuk menguatkuasa undang-undang melarang orang ramai meminum minuman keras (arak, bir, alkohol)  secara terbuka di kawasan-kawasan awam seperti di tapak taman permainan kanak-kanak dan kawasan rekreasi, tepi padang bolasepak dan tanah-tanah lapang serta kawasan awam yang lain.
    
Pejabat saya telah menerima banyak aduan dari orang ramai, kumpulan-kumpulan yang meminum minuman keras di lokasi-lokasi berkenaan hingga larut malam dan kemudiannya meninggalkan botol-botol kosong dan pecah berselerakan di tempat tersebut.



Keadaan ini menyebabkan kacau ganggu kepada keharmonian dan ketenteraman penduduk setempat di kawasan berhampiran apabila mereka terdedah kepada bunyi bising dari kumpulan-kumpulan tersebut dari larut malam malah hingga awal pagi.

Keesokan harinya pula kanak-kanak kecil yang datang untuk bermain di taman-taman permainan itu pula akan terdedah kepada botol-botol kaca yang berselerakan dan ini mengundang kepada bahaya kecederaan.

Untuk makluman YB dewan, undang-undang melarang meminum minuman keras di kawasan awam dan terbuka ini telah dikuatkuasakan di negara-negara seperti Australia, Canada, Finland, Hungary, Norway, Poland, Sepanyol dan Amerika Syarikat.
        
Sebagai contoh di Australia terutamanya di South Australia melalui dengan izin "Liquor Licensing Act 1997" (Lampiran South Australia Liquor Licensing Act 1997 Part 10. 131 Muka Surat 93) melarang meminum atau membawa minimuan keras di tempat-tempat awam seperti taman rekreasi dan pantai.

Kita patut mengikuti contoh yang baik seperti ini. Dan penguatkuasaan ini juga mengambil kira sekiranya ada permintaan untuk meminum minuman keras ditempat-tempat awam dan terbuka semasa mengadakan majlis-majlis persendirian, orang ramai hendaklah terlebih dahulu mendapatkan permit kelulusan daripada PBT.

Dengan berkuatkuasanya enakmen ini kita dapat membendung gejala-gejala sosial yang terjadi hasil daripada meminum minuman keras dikawasan awam tersebut.

Saya juga memohon pihak Kerajaan Negeri melarang dan mengharamkan penjualan arak-arak murah dengan izin 'cheap hard liquor'  yang boleh diperolehi dengan mudah dan berleluasa di kebanyakan kedai-kedai runcit, kedi-kedai seh-seh Cina,  dan pasaraya di seluruh negeri.

Arak-arak murah ini mempunyai kadar alkohol yang begitu tinggi dan boleh merosakkan organ dalaman dan tahap kesihatan peminumnya.

Yang begitu membimbangkan adalah pengambilan minuman ini dilakukan oleh ramai di kalangan masyarakat india yang berpendapatan rendah.

Ini menimbulkan pelbagai masalah gejala sosial dan menyebabkan berlakunya banyak kes-kes keruntuhan dan penderaan rumahtangga, dengan izin "Domestic Violence" di kalangan masyarakat india yang tinggal di kawasan-kawasan bandar dan luar bandar. 

Ketika ini kita dapati peningkatan jenayah yang dilakukan secara tidak langsung disebabkan pengambilan arak yang tidak terkawal ini bukan sahaja dikalangan belia malah telah menular masuk ke sekolah-sekolah. Aktiviti gangsterisma terutamanya dikalangan belia india berleluasa, vandalisma dan kerosakan harta benda awam juga boleh dilihat disana-sini.

Saya meminta pihak polis lebih prihatin terhadap jenayah yang dilakukan kerana akibatnya menyebabkan risiko kepada keselamatan orang awam. Saya juga meminta agensi-agensi penguatkuasa yang berkaitan turut memainkan peranan yang lebih proaktif dalam menangangi masalah ini.

Seperti yang saya nyatakan juga, akibat daripada pengambilan cheap hard liquor ini adalah masalah kesihatan organ dalaman seperti kerosakan hati yang boleh menjurus kepada banyak masalah kesihatan yang lain. Ini secara tidak langsung akan menyebabkan peningkatan kos kesihatan serta menyebabkan prestasi tenaga kerja terjejas.

Justeru, satu tindakan tegas perlu kita ambil. Saya mencadangkan supaya kilang-kilang yang menghasilkan dan menjual cheap hard liquor ini diberi masa paling lama 3 tahun untuk meneruskan operasi mereka dan kemudiannya ditutup bagi memastikan tidak ada lagi pengeluaran dan jualan arak murah ini kepada orang ramai. Sekiranya kilang-kilang ini dibiarkan terus beroperasi, begitulah juga gejala-gejala sosial yang berkaitan akan terus menjadi-jadi. 

Pihak berkuasa dan agensi-agensi berkaitan juga mesti terus memantau kedai-kedai yang menjual arak ini dan memperketatkan garis panduan penjualannya."

"Saya berharap Kerajaan Negeri segera menggunakan dana dari hasil simpanan tunai yang sebanyak RM2 Bilion dibelanjakan untuk kerja menaik taraf infrastruktur di kawasan luar bandar dan desa.

Tidak ada maknanya kita menyimpan RM2 Bilion sedangkan banyak jalan-jalan kampung di DUN saya berlubang-lubang besar dan sekian lama tidak diselenggara secara berkala.



Antara sebab berlakunya keadaan sedemikian ialah jalan-jalan kampung ini terletak atau melalui tanah-tanah milik persendirian tetapi telah digunakan oleh orang ramai sejak dari generasi terdahulu lagi.

Lantaran itu berlakulah 'perbalahan' antara pihak Pejabat Tanah dan Daerah atau Pihak Berkuasa Tempatan tentang siapa yang harus bertanggungjawab dalam menyelenggarakan jalan-jalan tersebut disebabkan oleh "kekangan" penggunaan dana kerajaan negeri terhadap jalan-jalan di tanah-tanah persendirian.

Oleh itu saya mencadangkan agar Kerajaan Negeri menghapuskan kekangan ini demi kepentingan orang ramai dan seterusnya dana tersebut dapat disalurkan bagi kerja-kerja naik taraf dan penurapan jalan-jalan berlubang tersebut."

ADUN Cadang Larangan Minum Arak Di Tempat Awam

ADUN Sri Andalas, Dr Xavier Jayakumar hari ini mencadangkan agar satu kerajaan memperkenalkan satu undang-undang baru bagi melarang perbuatan meminum minuman keras di tempat awam.

Menurutnya, enakmen itu bertujuan bagi memberi kuasa undang-undang kepada Pihak Berkuasa Tempatan (PBT) dan polis untuk menguatkuasakan larangan tersebut di tempat berkenaan.

Kawasan awam yang dimaksudkannya itu termasuk tempat-tempat seperti taman permainan, kawasan rekreasi dan padang bola, kata bekas exco itu.

"Pejabat saya telah menerima banyak aduan dari orang ramai tentang kumpulan yang minum minuman keras di lokasi berkenaan sehingga larut malam dan kemudian meninggalkan botol kosong dan juga pecah yang berselerak di tempat tersebut.

"Keadaan ini menyebabkan kacau dan ganggu kepada keharmonian dan ketenteraman penduduk setempat di kawasan berhampiran," katanya.

Katanya, undang-undang seperti itu dikuatkuasa di beberapa negara seperti Australia, Kanada dan Amerika Syarikat yang menghalang perbuatan membawa dan meminum bahan tersebut di kawasan seperti taman dan pantai.

Selain itu, beliau juga menuntut agar kerajaan mengharamkan penjualan arak murah bagi membendung gejala sosial yang menurutnya semakin serius.

"Saya juga mohon kerajaan negeri melarang dan mengharamkan jualan arak murah yang boleh diperolehi dengan mudah dan berleluasa di kedai runcit, kedai perubatan Cina dan pasaraya di seluruh negeri.

"Yang begitu membimbangkan, pengambilan minuman ini dilakukan oleh ramai dari masyarakat India berpendapatan rendah.

"Ini menimbulkan masalah gejala sosial dan menyebabkan banyak berlakunya kes jenayah dan penderaan rumah tangga di kalangan masyarakat India yang tinggal di kawasan bandar dan luar bandar.

"Pihak berkuasa dan agensi-agensi berkaitan juga mesti terus memantau kedai yang menjual arak ini daripada menjualnya," katanya lagi.

Beliau berkata demikian semasa membahaskan titah Diraja di Dewan Undangan Negeri di Shah Alam hari ini.

Dalam Persidangan Dewan Negeri Selangor pada hari ini saya telah membentang dan mencadangkan supaya sebuah enakmen yang melarang minuman keras di tempat-tempat awam dikuatkuasakan di Negeri Selangor.

Enakmen seperti ini telah pun dikuatkuasakan dikebanyakan negara seperti Australia, Canada dan Finland bagi membendung aktiviti meminum minuman keras secara terbuka di tempat-tempat awam kerana mengundang kepada kacau ganggu terhadap ketenteraman awam serta kerosakan harta benda dan punca kepada masalah sosial.

Melalui penguatkuasaan enakmen ini, Pihak Berkuasa Tempatan dan pihak Polis boleh menguatkuasakan undang-undang melarang orang ramai meminum minuman keras secara terbuka di tempat awam. Mereka yang didapati bersalah kemudiannya dikenakan denda dan hukuman yang sepatutnya.

Isu berkaitan yang saya tegaskan juga adalah penutupan kilang-kilang yang mengeluarkan arak-arak keras murah (cheap hard liquor). Umum diketahui arak-arak jenis ini mengandungi kandungan alkohol yang sangat tinggi yang mendatangkan banyak masalah kesihatan terutamanya kepada organ-organ dalaman.

Selain masalah kesihatan, masalah keruntuhan rumahtangga dan penderaan juga adalah akibat daripada pengambilan arak-arak jenis ini. Kita tidak boleh nafikan bahawa kadar jenayah terutamanya dikalangan belia yang juga telah menular disekolah-sekolah meningkat akibat pengambilan arak terutamanya arak keras murah yang mudah diperolehi dan dijual secara berleluasa.

Realiti yang saya lihat pada hari ini, pengeluaran dan penjualan arak-arak dari jenis ini hanya membawa kepada kehancuran sosial dan masalah kesihatan. Oleh itu saya telah mencadangkan supaya kilang-kilang sedia ada diberi tempoh paling lama 3 tahun kemudian operasinya dihentikan. Pihak berkuasa dan agensi berkaitan juga perlu terus memantau dan mengetatkan undang-undang sedia ada berkaitan pengeluaran dan penjualan arak-arak keras murah ini.

Justeru, satu tindakan tegas dan segera perlu dilakukan yang akhirnya dapat menjadikan Enakmen Melarang Meminum Minuman Keras Secara Terbuka di Tempat-tempat Awam serta penutupan kilang-kilang arak keras murah (cheap hard liquor) ini menjadi kenyataan.

That Omar Ong is one of the main players under Tingkat Empat. He is appointed as AirAsia director not for nothing. You can see AirAsia has safety issue with DCA and Air Operation Certificate was given for 6 months only. What happen after that? All is well.

This Tingkat Empat boy must be wiped out from the political as they have done too much damage. Why is Najib keeping this Omar Ong? The earlier he get rid of this fellow the better for the PM.

Since the pariah had to eat the humble pie to come to MAS, it must pay the market rate for all maintenance works. MAS must impose the same conditions as in Singapore with no discount or credit term. It must be treated like any customers. AJ must get a auditor in to audit the Botak. We know who is Botak. We must prevent the Botak of taking us for a tide.

MAS must not be stupid like what had happen ed where the brainless AJ sign an agreement to ferry AAX passengers with below market rate for the fares. MAS cannot be stupid twice.

Of course, he is the number 1 Spin Doctor with the help of the BK Sidhu of Star. He has been caught many times for saying one thing and do something else at a later date. He is relying on bullshitting to get by. Lets see how long he can carry on spinning.

YB you hit the nail on the head again. Thank you for keeping us MAS staff informed of the new development. We will resume to keep an eye on the Botak head – the only one shit left in MAS. Al-Ishal Ishak had left after changing MAS logo from blue and red to just pale blue. Enough of the AA remnant in MAS.

It was clear why Tony had to eat up his words where said AA will not send its plane to MAS for maintenance. The same goes when he said that AA will not move to KLIA2 when it is completed. then moving AA HQ to Jakarta because AA was buying up Batavia Air of Indonesia. It was all about spinning or bullshitting at best.

The issue now is MAS top management must examine all contracts signed by the Botak with AirAsia with regards to maintenance and ensure that they are based on current market rate and that using the hangar not in detrimental to MAS own interest.

Is the market convinced by MAS’s turnaround strategy?

Analysts in Malaysia may be convinced.

What about analysts in other countries?

What is special about MAS when the economics of the global aviation industry haven’t changed, despite the latest optimistic forecast from IATA?

Closer to home, MAS is facing competition from regional behemoth SIA which is rapidly bulking up by announcing billion dollar orders for Airbus and Boeing aircraft.

Compared to which, MAS’s own re-fleeting plans look distinctly pigmy-sized.

I am curious. How do people know that ST Aerospace does not have the capacity to carry out heavy maintenance on AirAsia’s A320 fleet?

Are they privy to the internal workings of ST Aero and do they have insider knowledge of it’s capacity constraints, if any?

It would be interesting to get comments from the Airbus regional office in Singapore.

Menanti Pelaksanaan Janji Datuk Seri Najib – Usul Memansuhkan Akta Hasutan 1948

Hampir setahun lalu, pada 11 Julai 2012, dalam sebuah majlis makan malam Pejabat Peguam Negara, DS Najib Tun Razak telah mengumumkan keputusan kerajaan bahawa Akta Hasutan 1948 akan dimansuhkan dan digantikan dengan suatu rang undang-undang yang dikenali sebagai Akta Keharmonian Nasional.

Lanjutan daripada ucapan beliau juga dimuatkan pengakuan bahawa "umum menganggap Akta Hasutan 1948 sebagai alat Kerajaan untuk merencatkan tindakan dan pandangan yang tidak sealiran dengan kerajaan. Walaupun anggapan sedemikian adalah tidak berasas sama sekali, kita perlu menghapuskan persepsi tersebut. Lantaran itu, peruntukan-peruntukan baru ini tidak akan menghalang rakyat untuk mengkritik kerajaan dan pentadbiran keadilan."

Malangnya, umum masih ternanti-nanti pelaksanaan kata-kata Datuk Seri Najib, malah terkedu dengan tindakan undang-undang ke atas aktivis serta ahli politik Pakatan Rakyat, menggunakan Akta Hasutan pasca PRU 13 yang pada awalnya diganding dengan tawaran peribadi "Pendamaian Nasional."

Penahanan Haris Ibrahim, YB Tian Chua, Datuk Tamrin Ghafar, Adam Adli, Dato Husam Musa – kesemuanya menggunakan Akta Hasutan secara siasatan serta pendakwaan terpilih (selective prosecution), sementara personaliti dan institusi lain yang parah meniup api kebencian seperti Datuk Mohd Noor Abdullah, Datuk Ibrahim Ali dan Utusan Malaysia dibiarkan tanpa sebarang tindakan mahupun siasatan hanya mendedahkan hipokrasi pentadbiran Datuk Seri Najib Tun Razak.

Justeru, menyambung pengumuman Datuk Seri Najib yang tidak mampu dilaksanakan, saya telah mengusulkan sebuah Rang Undang-Undang Ahli Persendirian iaitu Rang Undang-Undang Hasutan (Pemansuhan) 2013. Langkah ini diharap dapat menamatkan era penyalahgunaan Akta Hasutan 1948 menerusi pemansuhannya sekaligus dalam usaha melaksanakan islah dan reformasi yang tulen demi Malaysia yang lebih baik. Rang Undang-Undang untuk memansuhkan Akta Hasutan 1948 telah saya hantar ke pejabat YBhg Setiausaha Dewan Rakyat semalam.

Akta Hasutan 1948 adalah merupakan sebuah warisan peninggalan kolonialis British -yang mewujudkan akta ini di Tanah Melayu sedang rakyat rancak membincangkan masa depan sebagai sebuah negara yang bebas dan merdeka; tatkala pejuang-pejuang anti-penjajah seperti Dr Burhanuddin al-Helmy, Ahmad Boestamam dan yang seangkatan dengan mereka hebat menyemarakkan semangat merdeka.

Umum pasti bertanya, mengapa pihak Kerajaan belum menepati janji untuk memansuhkan Akta Hasutan 1948? Setahun sudah berlalu, dengan hakikat bahawa tanpa Akta Hasutan, sudah wujud undang-undang sedia ada yang mencukupi dalam menangani usaha-usaha untuk mendatangkan mudarat kepada masyarakat. Secara khusus, seksyen 505 Kanun Keseksaan, Seksyen 499 Kanun Keseksaan yang berkait fitnah jenayah (criminal defamation) serta Seksyen 233 Akta Komunikasi dan Multimedia 1998 memadai dalam menangani cabaran sedia ada – asal prinsip utama adalah tidak sekali-kali menyalahgunakan undang-undang sedia ada demi kepentingan politik.

Akhir kata, saya pasti Datuk Seri Najib Tun Razak akan melakukan apa yang mungkin untuk memastikan Rang Undang-Undang Hasutan (Pemansuhan) 2013 berhasil menerusi laluan perbahasan di Parlimen oleh mana-mana speaker pilihan Barisan Nasional, dan seterusnya persetujuan kesemua Ahli Parlimen yang bernaung di bawah Presiden UMNO dan Barisan Nasional. Mandat popular 47 peratus BN mengharuskan Datuk Seri Najib meneliti permintaan PR yang mewakili 51 peratus mandat popular rakyat Malaysia, apatah lagi bila menyahut pelaksanaan janji beliau sendiri.

Menurut Pesuruhjaya PAS Terengganu antara nama yang dipertimbangkan adalah terdiri daripada anak tempatan dan menolak cadangan pihak media yang menyebut tentang Ustaz Azhar Idrus sebagai turut disebut-sebut untuk menjadi calon.

YB Haji Mohd Abdul Wahid Endut berkata, banyak pihak yang mahu bertanding pada PRK Kuala Besut, namun katanya, oleh kerana kerusi tersebut pernah ditandingi oleh PAS, Pakatan Rakyat akan memberi laluan kepada PAS.

"Ustaz Azhar Idrus dia orang (Kawasan) Ladang (Kuala Terengganu) bayak maklumat yag kita terima dia tak minat untuk bertanding politik ini, antara nama yang naiknya (disenaraikan) adalan nama anak tempatan,

Beliau berkata demikian dalam sidang media yang diadakan di pejabat PAS Terengganu, di Taman Sri Intan, Jalan Sultan Omar di sini hari ini, pada Isnin 1 Julai.

Beliau menegaskan tidak timbul soal untuk memboikot pilihanraya kecil tersebut sebagaimana yang dicadangkan oleh Setiausaha Agung DAP, Lim Guan Eng semalam.

Haji Wahid yang juga ADUN Wakaf Mempelan berkata, jentera telah disusun bagi menghadapi pilihanraya tersebut termasuk melantik Timbalan Pesuruhjaya I PAS negeri yang juga ADUN Paka Ustaz Satiful Bahri Mamat sebagai Pengarah bagi Jawatankuasa Operasi bagi negeri Terengganu.

Democracy is dead in Malaysia

If Umno Baru have nothing to fear and the Election Commission (EC) claims that it is independent, why were they afraid to use indelible ink in previous elections?

Both Umno Baru and the EC want to bury this indelible ink story quickly. Don't let them. The use of the indelible ink is the single, most important factor that would have ensured the defeat of Umno Baru in the polls. Effective indelible ink will prevent people from voting multiple times.

Both the EC and Umno Baru have lied; if they claim to be fair and to have done nothing wrong, they should have a re-run of the election. Who has the RM7.1 million? Did we buy some of the most expensive food colouring in the world?

Gerrymandering and the other tricks which Umno Baru and the EC employ to cheat are effective up to a point, but with indelible ink, the police, the army, the illegal immigrants, the Umno Baru agents and the pseudo foreigners holding Malaysian ICs will not be able to cast their votes several times and so ensure a win for BN.

NONEBoth Umno Baru and the EC have, for successive general elections, prevaricated over the use of indelible ink, or found last-minute excuses not to use it. In GE13 they simply tampered with the product and told bare-faced lies about the ink.

In 2008, the use of indelible ink in GE12 was stopped at the last minute. At a forum on 'Free and Fair Elections: Reality or Illusion?' in Kota Baru in January 2012,  the former EC chairperson Abdul Rashid Abdul Rahman claimed that the EC was banned from using indelible ink in GE12 because it contravened Article 119 of the federal constitution.

PAS vice-president Husam Musa had challenged this and said that Abdul Rashid had announced on national television then, that the ban was for security concerns. Abdul Rashid had claimed that various people had obtained a similar ink and were using it to trick rural Malaysians into staining their fingers before voting.

Husam said: "This means that Rashid was made to lie to the people," and added that in 2007, the Fatwa Council had approved the use of the ink.

Former minister in the Prime Minister’s Department Mohd Nazri Abdul Aziz confessed that it was he who had prevented the use of the indelible ink prior to the 2008 general election.

He cited constitutional concerns and the worry that Muslims would be unable to perform the proper ablutions for prayers. He denied Husam's claim that the Fatwa Council had endorsed the use of indelible ink in the 2008 general election.

Chronology of lies

Then, like now, Umno Baru and its puppets cannot come up with one single lie.

On April 30, 2013, a week before the May 5 elections, soldiers were allowed to cast their votes first. One soldier claimed that he was able to wash the ink off his fingers, six hours after he voted.

On May 1, complaints about the indelible ink prompted EC secretary Kamaruddin Mohamed Baria to say that tests had shown that fingers painted with ink from shaken bottles lasted longer than the ink from bottles which had not been shaken.

The following day, May 2, Kamaruddin dismissed reports that the ink was washable. He stressed that traces of the ink could be seen with a magnifying glass and that officers would be supplied with magnifying glass for checking the presence of ink.

Kamaruddin said his staff had found handling the indelible ink nerve-wracking and consequently failed to follow instructions on its proper use and application. He criticised the people who had complained about the washable ink as having 'ill intentions' towards the EC.

In an interview with the Straits Times of Singapore on May 12, EC chairperson Abdul Aziz Mohd Yusof claimed that silver nitrate in the ink was dangerous, and that the Health Ministry had warned about the possible damage to kidneys and risk of cancer.

Meanwhile, a mainstream paper claimed on May 29 that several people had been harassed for lodging police reports on the indelible ink.

On June 6, Health Minister Dr S Subramaniam scotched Abdul Aziz's claim and denied issuing a report about the harmful risks to health from silver nitrate.

On June 17, Abdul Aziz then blamed God for the poor performance of the ink. The ink had been tested prior to GE13 and he said: "On the much-awaited day, the power of Allah is greater when the ink could disappear after being washed several times. Where is the mistake?" [sic]

On June 21, the EC vice-chairperson Wan Ahmad Wan Omar said a special internal team would be formed to discover if the ink had suffered from internal sabotage.
He said, "There are many forms of EC staff, and we do not know their intention. Hence, the need for an in-depth investigation to find the truth.

"Could the indelible ink not last long because of its quality or is it the fault of the EC officer who applied it or are there elements of sabotage? We are puzzled as to why the ink does not last long."

On June 26, Shahidan Kassim, the Minister in the Prime Minister’s Department, said the ink was actually food colouring. He said, "No chemicals were used in the ink, they were instead replaced with food colouring ingredients which were approved."

Shahidan declined to reveal the name of the company which had supplied the ink for "security reasons".

Investigations by Rafizi Ramli, the MP for Pandan, revealed that the EC contract for the supply of the indelible ink had been given to a company owned by a Singaporean.

Rafizi alleged that the company had no experience in this line of work, nor did it have the necessary funds, and had been forced to obtain a loan, from a Kampang Baru businessman, for the RM7 million needed to purchase the ink.

Wan Ahmad told an online portal on June 26, that silver nitrate is not a chemical but a metal. He could not carry out his job at the EC responsibly and now aspires to be a chemist; but seems to have a dearth of knowledge as a chemist.

Meaningless politics

On  June 27, the Federal Territories Minister Tengku Adnan Tengku Mansor said that Malaysia is "not a Third World country" and so does not need indelible ink in its elections. He said that Parliament agreed to its use because "the opposition wanted it".

Tengku Adnan is wrong. It was the rakyat who wanted the indelible ink as part of its clean and fair election demand. Ku Nan also claimed that chemicals in the ink were not good for the health of the people. He said, "The chemicals were reduced because the government cares for the people."

We already know from Shahidan that there were no chemicals in the ink. So who is telling the truth?

By June 28, various NGOs were demanding details of the supplier of the ink.

Despite the lies and furore surrounding the indelible ink, Wan Ahmad said that the ink would be used in the Kuala Besut by-election in Terengganu.

Malaysia does not have a free press, an independent EC, judiciary or police force. Our civil service is corrupt and ineffective and we have no idea how our tax money is being spent.

In other words, politics in Malaysia are meaningless, although our leaders pat themselves on the back for having the "best democracy in the world".

Allegations abound that since former premier Dr Mahathir Mohamad won his first election, he has bribed or fudged the results of each election.

Successive BN governments have continued this practice of cheating and instead of the government of the day looking after our interests, Malaysian governance is like a lopsided game, where a handful of individuals fight for their own interests.

Rural and conservative voters are swayed by traditional values and stability. They are not convinced by personal freedom and liberal thoughts.

Democracy is dead in Malaysia. Umno-Baru leaders only use the concept of democracy as a tool to swindle the rakyat. Individuals in BN use democracy to increase their personal profit and enhance the party's dominance, which is not unlike the politburo of the Chinese Communist Party who enjoyed benefits which were denied to the rest of the country.

Indelible ink, which will last for more than a week, will restore democracy to Malaysia and smite the foes of the rakyat.

No RCI on GE13 & May 13 racial riots

KUALA LUMPUR: The government has rejected a proposal for a royal commission of inquiry (RCI) on the 13th general election amid pressure from the British government and local opposition leaders to probe fraud in the May 5 polls. Minister in the Prime Minister's Department Shahidan Kassim, citing Section 118 of the Federal Constitution, said a win by an MP or state assemblyman could be questioned only through an election petition to the High Court.
Shahidan said this in a written parliamentary reply to Segambut MP Lim Lip Eng, who asked whether the government would initiate RCIs on the general election, the May 1969 riots and deaths in custody and abuse of police power.
Recently, the British Minister of State, Foreign and Commonwealth Office, Hugo Swire, called for full investigations of "allegations of irregularities made by the opposition parties and civil society groups" in Malaysia.
The past two months have seen Pakatan Rakyat leaders leading a massive nationwide protest to pressure the Election Commission into resigning over its alleged mishandling of the recent polls. Each component party in the opposition pact has filed election petitions, but their leaders have expressed doubt that they would win the cases due to the high burden of proof required.
Shahidan also dismissed the need for an RCI on custodial deaths and police abuses.
He noted that the Enforcement Agency Integrity Commission (EAIC) had already set up a task force to look into the matter, using provisions under the EAIC Act 2009 (Act 700).
"The Royal Malaysian Police Force is considered one of the agencies under Act 700," he said. According to Section 28 of that act, the EAIC can probe any enforcement agency under the act for abuse of power if there is significant public interest."
He said an RCI on the 1969 race riots was also unnecessary because the tragedy occurred too long ago and remedial action had been taken. "Among [the remedies] was the establishment of the Muhibbah Council to encourage harmony among members of society and the setting up of the National Unity Department to manage and implement policies and activities to inspire inter-racial unity," said Shahidan.

Astounding discovery of unique flora and fauna at Bukit Kiara

IT WAS not just another walk in the park for 28 participants of Malaysian Nature Society's inaugural (MNS) "Walk with Nature at Bukit Kiara" programme. Led by Selangor MNS Flora Group head botanist Lim Koon Hup, the participants were briefed on the flora and fauna found along the walk. "The participants were very inquisitive throughout the walk as they did not know much about even the common plants and trees.
"It is not only interesting to learn about the greenery but also the role they play in the eco-system and how it benefits people and animals," he said.
Segambut MP Lim Lip Eng, who also took part in the walk, signed a green pledge to help expedite the gazetting of Bukit Kiara.
MNS vice-president Henry Goh said the objective of the walk was to highlight the importance of maintaining the bio-diversity for present and future generations to enjoy. "We also want to ensure green lungs are preserved to off-set and absorb the ever-increasing carbon emissions due to development. It is important to have a healthy balance between development and conservation of our depleting national forests.
"In 2007, the Cabinet agreed to gazette 189ha of Bukit Kiara as a public park. Several ministers and top government officers have also made statements to this effect. However, it is puzzling that despite all the assurances, nothing has been done for the last six years.
"The Friends of Bukit Kiara and its coalition partners comprising NGOs and RAs have over the years, written and also held meetings with the relevant authorities and government agencies but nothing concrete has materialised," he said. Goh said as the turnout was good, MNS will organise more walks into Bukit Kiara to showcase the many "nature treasures" which could still be discovered within Bukit Kiara.
Taman Tun Dr Ismail (TTDI) resident Fariza A. Jalil said she was mesmerised with what nature has to offer in Bukit Kiara. "The authorities must gazette Bukit Kiara fast or else more destruction might take place. It is a threat to the environment and where will the animals go? It will be very sad to see all the beautiful flora and fauna slowly fade away," she said.
Another resident, Rahmat Hussien, who has been visiting the park for over 30 years, said he had never explored the trails. "I never knew that Bukit Kiara has a natural treasure trove. The flora and fauna found here are very beautiful and picture- perfect," said the avid photographer who came with his friend Harinto Rashid to take photographs in the park.
Katie Low from Australia, who is visiting a relative here, also joined in the walk after hearing about it. "It is a good way to spend a Sunday morning," she said.
After the walk, several participants also helped to plant trees in the park.

Need a Royal Commission to probe the Lahad Datu incident

This morning, the Deputy Minister Datuk Wan Junaidi explained to the House the incursion incident at Tanduo, Lahad Datu, Sabah. However, it is still a mystery. Honestly, Malaysians want to know how the army and the police let a band of Suluks cause havoc in our country. As the Government cannot answer many questions, we propose setting up a Royal Commission to get to the bottom of the incident.

Now, Malaysian Anti-Corruption Commission (MACC) wants to investigate the purchase of the ink. Frankly, it must show that it is fair in various aspects. Then, we can wait for the findings.
