KLIA 2: Did Malaysia Airports Mislead the Government?

The top management of Malaysia Airports Holdings Bhd (MAHB) must be held accountable for withholding crucial information on cost in the decision to shift site of the new low cost terminal, KLIA2 to the Government

On 14th December 2011, I had a press conference to explain the key reasons why the cost of the new "low cost terminal" KLIA2 had increased drastically from the originally estimated RM1.7 billion in 2007 to RM3.9 billion last year.

The underlying reason was the shift of the airport from the originally proposed northern site (KLIA North) to the current western site (KLIA West) which is under construction. The shift of the site has caused the cost of construction to bloat because KLIA West was already identified as unsuitable for the construction of an airport due to it being a peat swamp. This is increased the cost by at least RM1.2 billion.

In addition, the shift to KLIA West has resulted in the need for a 3rd runway costing RM270 million as well as a 2nd control tower costing an estimated RM300 million, which would not have been required had the new low-cost terminal be built in KLIA North.

MAHB made the briefest of response to my allegations on the same day, by claiming that I had referred to the old master plan which was no longer valid. MAHB said that the "National Airport Master Plan (NAMP) 2008 has super-ceded by the KLIA Master Plan (1992)."

The answer begs the question because my allegation is exactly that the NAMP's decision to shift KLIA2 to the new site from the original site, KLIA North recommended in the 1992 KL International Airport Master Plan had caused the drastic increase in the cost.

In fact based on MAHB's own presentation to the Finance Ministry as late as 6th July 2007, MAHB had reconfirmed that the KLIA North was the best option available to build the new KLIA2. MAHB had argued that the advantages of KLIA North include:

  • Efficient operations since the aprons are well connected to either Runway 1 or 2.
  • Ample land available for future expansion
  • Good access to the area via the perimeter highway
  • Proposed site complement KLIA as an Integrated Hub for low cost carriers and legacy airlines
  • And it complies to KLIA Master Plan 
MAHB also presented a 3-phase expansion programme where the new low cost terminal at KLIA North will be able to meet the increase in passenger traffic from 15 million to 25 million to 45 million per annum.

However, in a separate presentation to Finance, Home and Transport Ministry officials on 15 April 2008 on the NAMP, the MAHB made a 360-degree turn by recommending KLIA West as the new site for the new low-cost terminal. Based on the presentation documents and the minutes of the meeting, MAHB has failed to highlight the fact that the new KLIA2 will cost substantially more due to reasons already identified in the 1992 KLIA Master Plan.

The 1992 Master Plan had clearly stated that "the western part of the site mainly comprises saturated marine clays with an overlay of peat material… The combination of the drainage problems and the type of material means that the western part of the site has poor bearing qualities and is not suitable for airport construction without undertaking significant engineering measures to improve load bearing capacity… Even after these measures have been undertaken there is likely to be some settlement of the ground and the area should be allowed to consolidate for a period prior to being used for airport construction."

Hence despite knowing full well that the KLIA West is unsuitable for airport construction and will incur substantially higher cost, MAHB has intentionally chosen not to disclose this crucial information to the relevant Ministry officials. This has resulted in the lack of objections to the shift of the new low-cost terminal to KLIA West. As a result, MAHB which is a 54% subsidiary of Khazanah Bhd, has caused the cost of KLIA2 to bloat by more than RM2 billion at the expense of the taxpayers.

The MAHB top management must be held fully accountable for the unacceptable increase in cost especially in the light of their being economical with the truth on the cost of construction with the Government. They must explain why is it that within a few months from July 2007 to March 2008, the "best" site for the new KLIA2 can be suddenly shifted from KLIA North to KLIA West.

Dato' Seri Kong Cho Ha, as the responsible Minister in-charge must ensure that heads must roll for the RM3.9 billion KLIA2 fiasco. The Minister to date has failed to make even a single comment on the issue, which clearly demonstrates that he is shirking his responsibility to look after the public interest.

Dato' Seri Zahid Hamidi must stop the scurrilous allegations that I am a "tool" for a foreign country in repeated attempts to deflect his Ministry's lack of transparency and accountability

Chinese newspapers carried the story that Dato' Seri Zahid Hamidi has accused me of being a "tool to a former professor who has become a professor in a foreign country" on 2nd January 2012. He has added that "the foreign country is the puppet-master of a particular party in Malaysia". He has even claimed that he has documentary proof to validate what he has said.

I have obtained the full transcript of the comments made by the Defence Minister on 1st January, and the relevant accusation is as follows:
"Saya fikir Tony Pua ni adalah seorang yang menjadi alat saja seorang bekas professor yang telah menjadi professor di university di luar negara, dan negara itu memang menjadi dalang kepada sebuah parti di negara ini. Saya fikir asal politik di Malaysia biar dibentuk oleh ahli-ahli politik Malaysia. Jangan pernah menjadi dalang daripada mana-mana negara . Saya tidak menuduh tapi saya ada dokumen-dokumen dan bukti-bukti untuk mengesahkan apa yang saya katakana ini."
The is the second time the Defence Minister had implied that I am a foreign agent. In March 2011, Dato' Seri Zahid Hamidi was reported in Utusan Malaysia to have said:
"Dia [Tony Pua] dulu ditangkap di Singapura, dibawa ke mahkamah, tetapi sebab hubungan dia mungkin baik dengan pejabat tertentu di sana, beliau dilepaskan (dan) tidak dapat jadi ahli Parlimen (di sana)"
As I've responded last year, I've never even been fined for jay-walking in Singapore, what more being arrested and charged in the court of law in the island city.

All these scurrilous accusations arose as a result of the continued pressure placed on the Defence Ministry to be transparent with its military equipment purchases, especially in the light of a poor assessment by Transparency International (TI). The TI scored Malaysia at only 4.5 points out of a maximum of 12, or only 37.5%, well below the failure mark. This was the score given in the inaugural "Transparency of Defence Budgets Report" launched on 19 November 2011.

Director of the International Defence and Security Program for TI in United Kingdom, Mark Pyman, who launched the report in Subang Jaya said "Malaysia ranked far below other countries (for this), where the budget lacked details and no audits were undertaken of the secret programmes."

Malaysia is ranked alongside Afghanistan, Rwanda, Georgia and Azerbaijan in the report, well below other countries such as Bangladesh, Indonesia and Papua New Guinea. The results of the research indicate that approximately 14 per cent of the countries under review in this study scored high and these are primarily developed countries with strong democratic systems in place.

Treason as accused by the Defence Minister is a crime of the highest order in Malaysia and is punishable by death. The accusation by Dato' Seri Zahid Hamidi is as serious as it is outrageous, and such contemptuous behaviour is completely unbecoming of a Minister.

Given the severity of the allegations that I am compromising the nation's security, I challenge Dato' Seri Zahid Hamidi to come up with the so-called "documentary proof" that I am a "tool" of a professor in a foreign university and charge me accordingly. However, if the Minister fails to furnish the proof, then he should immediately withdraw the remarks and make a public apology for making such unfounded statements.

It appears that Dato' Seri Zahid Hamidi does not realise that he is being fed with fictitious stories from his chief intelligence officer, Papagomo – who had recently enjoyed the unrivalled privilege of sailing in the country's first submarine. Papagomo is also the source of the scurrilous allegations against Penang Chief Minister Lim Guan Eng's son recently who was wrong victimised as having sexually assaulted a female student in his school.

It is extremely worrying that the country's Defence Minister is relying the country's intelligence from a blogger who is an obsessive liar without any morals and ethics. In fact all Malaysians should be terribly concerned that our Defence Minister who wields great powers, can be so gullibly compromised by a writer of unbelievable and outlandish fiction.

Dato' Seri Zahid Hamidi displays the worst traits of a minister who is arrogant, ignorant and shockingly forgetful.

I read with great surprise that Dato' Seri Zahid Hamidi has once again reiterated his "invite" to me to meet him with regards to the cost increase over the acquisition of 6 naval patrol vessels from RM6 billion to RM9 billion. I feel extremely honoured because this is the third invite in 4 days!

His first invite made via the press was on 29th December, followed by another on 31st, and another yesterday, on the 1st January of the new year – all of which were published in Bernama. He need not have made so many invites, he had me at "hello". I had immediately after reading his first invite, publicly responded that Pakatan Rakyat MPs, Nurul Izzah Anwar, Dr Dzulkefli Ahmad and myself are more than happy to take up his offer of clarifications on 30th December.

Unfortunately, despite his eagerness to meet me, our Defence Minister appears to be very poorly informed and does not read the news. So, I repeat again here, that we accept the invite from the Minister to offer clarifications and look forward to his honourable office to make the necessary arrangements for our visit.

What was however more shocking was his claim that I've never dared to face him over the controversial acquisitions even in parliament, and insinuated that I was a coward for raising the issue only during political ceramahs.

He said "when I answered his question in Parliament, [Tony Pua] was not present to hear my reply, but continued to harp on the matter in political ceramah. He is brave only before the opposition crowd but chicken out when asked for a face-to-face meeting."

The above is utter and complete nonsense as I was present in Parliament and even debated heatedly and extensively with him when he was replying in Parliament on these issues twice in March 2011!

When he was responding to the question from Segambut MP Lim Lip Eng on the 8th March 2011, I was there and chastised the Minister for un-ministerial behaviour for asking my colleague to "go back to kindergarten". (Hansard pg 5 – 9 http://www.parlimen.gov.my/files/hindex/pdf/DR-08032011.pdf)

In a more extensive subsequent debate on 21 March, when the Minister was directly reply to my questions raised in parliament, he had even threatened to sue me for defamation. I had stood my ground and debated extensively with the Minister over the procurement of 6 naval patrol vessels and 257 armoured personnel vehicles. (Hansard pg 34 - 54 http://www.parlimen.gov.my/

Hence Dato' Seri Zahid Hamidi's allegations that I was not present in Parliament exposed just how forgetful and absent-minded he is. Even worse, it shows that our Defence Minister does not check his facts before making statements.

Given his absent-mindedness, I would further like to remind the Minister that he had twice in Parliament in March last year confirmed that the price for the 6 patrol vessels have not been finalised and a budget ceiling of RM6 billion has been set.

On 8th March 2011 in Parliament, Dato' Seri Zahid Hamidi had said "pada masa ini pihak kerajaan masih belum memuktamadkan harga. Sejumlah RM6 bilion telah diperuntukkan sebagai siling dalam
Rancangan Malaysia Kesepuluh dan sebahagian akan melimpah ke Rancangan Malaysia Kesebelas dan mungkin hingga ke Rancangan Malaysia Kedua Belas." (pg 6). He repeated the same on 21 March 2011 in Parliament (pg 52).

However, the Defence Minister now has the cheek to say in his latest statement to Bernama that "the cost of procuring assets for the national defence inventory will not exceed the ceiling set by the government", when it has increased by 50% from RM6 billion to RM9 billion in less than a year!

All of the above points to the fact that we have a clueless defence minister who is arrogant, forgetful, ill-informed and ignorant. The manner in which budgets are so easily exceeded will only increasing the likelihood of realising Dato Idris Jala's greatest fear, that Malaysia may be bankrupt by 2019.

KEPALA BATAS, 4 Jan: Kemunculan bekas pemain gitar bass Kumpulan XPDC, Azuar Md Tasi atau lebih popular dengan panggilan Zua pada Konsert hiburan 'Jelajah Orang Muda (JOM) Geng Kita' di Pulau Pinang baru-baru ini berjaya menarik ratusan anak muda ke program PAS itu.

Program anjuran Jawatankuasa Kemajuan dan Keselamatan Komuniti Rantau Panjang dengan kerjasama Dewan Pemuda PAS Kawasan Kepala Batas dan Negeri itu berjaya menarik golongan pemuda khususnya peminat rock untuk duduk bersama dalam program tersebut.

Selain Zua, program tersebut turut menampilkan pemuzik undangan SUS9 yang pernah menjadi johan sempena Pesta Pulau Pinang tahun 2002 vokalisnya Jefri.

Pengarah Program, Nor Azman Ishak ketika ditemui gembira dengan sambutan yang diberikan terutamanya golongan muda terhadap pendekatan Dewan Pemuda PAS Negeri Pulau Pinang itu.

"Pada masa depan program sebegitu akan diteruskan supaya anak muda yang jiwa mereka terlalu cintakan muzik tetap bersama PAS.

"Dulu mungkin timbul perasaan tidak selesa kerana bimbang PAS tidak dapat menerima
golongan seperti mereka, " jelasnya.

JOM diadakan seharian di Dun Penaga di mana pada sebelah paginya program mengayuh basikal diadakan mengelilingi beberapa buah kampung di Pasir Gebu, Penaga.

Acara sukan juga diadakan di padang awam Pasir Gebu yang mana acara yang paling dinantikan ialah persembahan seni silat serta tomoi.

Selain itu klinik gitar juga turut diadakan di dewan berkenaan pada sebelah petang yang dikendalikan sendiri oleh Zua.(harakahdaily)

Kota Raja, 4 Januari 2012 - Parti Keadilan Rakyat Cabang Kota bersama-sama sayapnya, Wanita dan Angkatan Muda Keadilan telah memberikan komitmen 100% untuk turun ke Mahkamah Tinggi Jalan Duta pada 9 Januari ini untuk memberi sokongan kepada Ketua Umum, Dato Seri Anwar Ibrahim yang menghadapi perbicaraan Fitnah liwat II.

Satu taklimat pada malam semalam telah diadakan kepada kesemua ahlijawatankuasa Cabang, Wanita dan Angkatan Muda Keadilan Kota Raja yang akan hadir memberikan sokongan.

Taklimat diberikan oleh Ketua Cabang, YB Dr Xavier Jayakumar, Timbalan Ketua Cabang, YB Shuhaimi Shafiei, Ketua AMK, Saudara Azmizam Zaman Huri dan Ketua Wanita, Puan Rozaina Hamzah.

Taklimat yang diberikan mengulas lanjut berkenaan hak-hak untuk ke mahkamah pada 9 Januari nanti mengikut perlembagaan, menjaga keselamatan diri dan mengelak dari diprovokasi oleh pihak-pihak tertentu serta bergerak secara aman.

SHAH ALAM: Pakatan Rakyat Selangor mempelawa Menteri Pembangunan Wanita, Keluarga dan Masyarakat Datuk Seri Shahrizat Abdul Jalil menyertai perhimpunan kempen 'Bebaskan Anwar 901′ di perkarangan Mahkamah Tinggi Jalan Duta, Kuala Lumpur pada 9 Januari ini.

"Tidak terkecuali kita juga menjemput (Perdana Menteri) Datuk Seri Najib Tun Razak menyertai perhimpunan ini. Shahrizat dan Najib juga ada hak untuk berhimpun," kata Setiausaha Publisiti DAP Jenice Lee Ying Ha dengan nada agak sinis.

Beliau yang juga ahli dewan undangan negeri (Adun) Teratai berkata demikian berikutan kenyataan Shahrizat semalam yang berkata perhimpunan itu sebagai tidak wajar diadakan kerana akan menimbulkan kekecohan semata-mata.


Shahrizat juga mendakwa perhimpunan itu adalah perhimpunan haram dan boleh mengancam keselamatan orang awam.

"Jika polis jalankan tanggungjawab dengan penuh disiplin maka tidak akan timbul sebarang masalah," kata Jenice Lee pada sidang media Pakatan di sini hari ini.

Ujar beliau, "lihatlah pada Himpunan Bersih 9 Julai dan kes pelajar di Perak bukan para demonstran yang membuat kecoh tetapi ada individu tertentu yang membuat kecoh. Kita banyak pengalaman mengenai hal provokasi ini."

Turut hadir Ketua Penerangan PKR Shuhaimi Shafie dan Ketua Penerangan PAS Saari Sungib.
Kebangkitan rakyat

Shuhaimi, ketika ditanya pemberita, sama ada Pakatan akan memohon permit untuk perhimpunan itu berkata, sepanjang rekod permohonan permit untuk mengadakan ceramah, ia tidak pernah dikeluarkan oleh polis.

"Perhimpunan ini sesuatu yang spontan. Kebangkitan rakyat tentang kes Anwar. Belum pun diadakan perhimpunan, polis dah keluar kenyataan kata jangan datang maka kami tak nampak ia akan diluluskan," kata beliau yang juga Adun Seri Muda.

Menyentuh mengenai persiapan perhimpunan, Shuhaimi berkata terdapat empat kawasan untuk mereka berkumpul nanti tetapi beliau enggan mengulas lanjut mengenainya.

Sementara itu, Saari menjelaskan bahawa ahli-ahli PAS enggan menyertai Himpunan Sejuta Umat tahun lalu kerana perkara itu telah diputuskan oleh pucuk pimpinan parti.

Presiden PAS Datuk Seri Hadi Awang, menganggap Himpunan Sejuta Umat sebagai agenda Umno bertujuan untuk mencetus permusuhan di antara kaum, kata beliau yang juga Adun Hulu Kelang.

PETALING JAYA 03 JAN: Soal siapa yang akan menjadi Perdana Menteri di dalam kerajaan Pakatan Rakyat sekiranya Datuk Seri Anwar Ibrahim dihalang dari bertanding tidak timbul kerana muafakat yang kukuh di antara parti komponen.

Sebaliknya, Anwar berkata, jika PR dan rakyat tetap mahunya sebagai Perdana Menteri, soal kelayakannya bertanding tidak relevan kerana dia masih boleh dijadikan Perdana Menteri.

Anwar menjelaskan bahawa jika berlaku senario di mana PR menubuhkan kerajaan pusat selepas pilihanraya umum ke-13, seorang pemimpin dari PR boleh menjadi Perdana Menteri sementara dan mengembalikan kelayakan bertanding kepada beliau.

Beliau berkata ini berlaku di dalam kes negara Turki, di mana Perdana Menteri sekarang, Recep Tayyib Erdogan, dihalang daripada bertanding semasa partinya AKP (Parti Keadilan dan Pembangunan) memenangi pilihanraya umum pada 2002.

"Siapa yang pegang sementara itu bukan perkara pokok. Sepertimana beberapa pemimpin PR kata kalau kita pilih Anwar dalam atau luar penjara bukan soalnya. rakyat sokong maka dengan izin Allah ia akan berlaku."

Beliau berkata demikian di dalam temubual Fokus Berita semalam.

Anwar tidak akan layak bertanding pilihanraya sekiranya mahkamah menjatuhi hukuman di dalam kes liwatnya pada Januari 9.

Seorang hilang kelayakan bertanding dalam pilihanraya selama satu penggal sekiranya dia dihukum tidak kurang dari setahun penjara atau denda dua ribu ringgit.

Tambah Anwar, soal siapa calon Perdana Menteri Pakatan Rakyat bukan perkara perlu dirunsingkan kerana Pakatan Rakyat membawa dasar bersama yang jelas.

"Hubungan saya dengan tuan guru hadi dan tok guru nik aziz terlalu baik. kami saling mempercayai, saling memohon nasihat dan pendapat.

"Saya tidak fikir ada masalah. Kalau ada muafakat esok siapa yang harus jadi pemimpin sementara dari PKR atau PAS, DAP tidak menawarkan mana-mana calon, saya tidak fikir itu satu masalah."

PR dijangka menurunkan lebih ramai muka muda dan profesional kali ini berbanding pilihanraya umum lalu.

Bahkan sudah ada tokoh individu menawarkan diri dan badan-badan bukan kerajaan turut menyarankan calon tersendiri untuk membantu Pakatan Rakyat.

"Kes yang saya hadapi ini sudah hampir tiga tahun. Sejak saya didakwa kita sudah jangka muslihat untuk melemahkan Pakatan Rakyat.

Maka oleh yang demikian kita memulakan beberapa langkah dan persiapan menjangkakan (muslihat) ini dan Alhamdulillah kita sudah hampir selesai.

Anwar yakin pemenjaraan beliau di tangan pemerintah Barisan Nasional tidak akan mengugat kerjasama PAS-DAP.

"Apakah ia akan jadi longgar andai Anwar dipenjara? Saya tidak percaya kerana hal ini (pilihanraya, dasar bersama) telah ditandatangani oleh pemimpin ketiga-tiga parti."

Anwar berkata, harapan Pakatan Rakyat menakluki Putrajaya cerah kerana mereka telah membuktikan yang mereka mampu mentadbir dengan baik di Kelantan, Kedah, Pulau Pinang dan Selangor.

Tambahnya rundingan tentang strategi pilihanraya dan pembahagian kerusi antara PAS, DAP dan PKR sudah hampir selesai.

Bahkan Pakatan Rakyat kini lebih bersedia untuk mengancam kedudukan pemimpin-pemimpin kanan Barisan Nasional walau tanpa beliau selaku tonggak dalam PRU-13 nanti.

Jentera ini dikendalikan pemimpin ketiga parti oleh Azmin Ali (Ahli Parlimen Gombak), Anthony Loke (Ahli Parlimen Rasah) dan Dr Hatta Ramli (Ahli Parlimen Kuala Krai).

Urusetia dikendalikan oleh wakil ketiga-tiga parti. Walau ada sedikit gambaran seolah-olah saya memainkan peranan yang besar, sebenarnya ia adalah rangkaian pemimpin bekerja seabgai satu pasukan.

Majlis Peguam: Himpunan 901 Dibenarkan Perlembagaan

SHAH ALAM, 3 JANUARI : Isu berhubung himpunan 901 sempena dengan pengumuman kes fitnah Liwat ke atas Datuk Seri Anwar Ibrahim (DSAI) sama sekali tidak bercanggah dengan undang-undang negara malah dibenarkan oleh Perlembagaan.

Ini kerana himpunan yang bakal diadakan itu sekadar perhimpunan untuk memberi sokongan kepada DSAI yang dibicarakan semenjak hampir 3 tahun lalu berhubung konspirasi untuk mengaibkan Anwar di mata rakyat oleh musuh-musuh politik beliau.

Menurut Presiden Majlis Peguam, Lim Chee Wee tidak tertulis di mana-mana perlembagaan pun bahawa kehadiran sebagai tanda sokongan kepada tertuduh di mahkamah adalah satu kesalahan.

"Mahkamah adalah tempat terbuka kepada orang ramai untuk hadir mendengar perbicaraan.

"Malah orang ramai mempunyai hak untuk hadir ke mahkamah apa lagi untuk memberi sokongan kepada tertuduh selain mendengar keputusan yang akan diberikan," ujar Lim memberi ketika dihubungi TV Selangor.

Lim turut memberitahu bahawa jumlah yang akan hadir ke perhimpunan itu nanti bukan satu isu untuk dijadikan alasan pihak berkuasa bahawa perkara tidak diingini akan berlaku.

"Sebaliknya jika pihak polis memberi kerjasama mengawal keadaan, saya tidak melihat sebarang masalah untuk rakyat yang prihatin berhimpun memberi sokongan kepada sesiapapun yang mereka ingini," tegas Lim yang dihubungi melalui panggilan telefon.

Berhubung dakwaan seorang menteri bahawa Majlis Peguam menjadi alat politik, Lim pantas menjelaskan itu bukan isu yang perlu dibangkitkan.

"Kami tidak menyebelahi mana-mana pihak atau individu. Sebagai pengamal dan penegak perundangan kami cuma berminat pada asas perundangan iaitu keadilan yang menjadi hak setiap manusia," katanya lagi.

Lim turut membangkitkan sikap 'Double Standard' pihak berkuasa dalam menangani isu-isu seperti ini bilamana perhimpunan yang membabitkan PKR seringkali diprovokasi dengan isu keselamatan.

"Sikap double standard ini sangat mendukacitakan malah menjatuhkan karisma, keupayaan dan professionalisme pihak berkuasa polis dalam menjalankan tugas mereka.

"Sambutan Tahun Baru dihadiri oleh puluhan ribu rakyat dibolehkan dan dapat berlaku dengan baik hasil kerjasama pihak berkuasa juga. Tapi mengapa pula kes seperti ini yang tidak pun melanggar mana-mana undang-undang dijadikan isu?," soal Lim kembali.

Lim dengan positif juga menyatakan bahawa mereka yang akan hadir 9 Januari ini pasti terdiri dari golongan yang cintakan perundangan yang adil dan tidak akan sesekali mencetuskan huru-hara walau apapun keputusan mahkamah seperti yang cuba digemburkan sesetengah pihak.

"Saya harap orang ramai akan hadir memberikan sokongan kepada DSAI. Himpunan ini penting bukan sekadar membela DSAI semata-mata sebaliknya penting kepada orang awam juga berkenaan sistem perundangan negara yang semakin parah.

"Hadirlah beramai-ramai untuk menunjukkan bahawa rakyat hari ini sudah bosan dan jemu dengan konspirasi dan fitnah seperti ini dan rakyat menolak sebarang ketidakadilan dan kezaliman yang berlaku," ujar Lim lagi.

Kenapa Keputusan Perbicaraan Anwar Penting Untuk Setiap Rakyat Malaysia

Pada 9 Januari 2012, Mahkamah Tinggi Kuala Lumpur akan menyampaikan penghakimannya dalam perbicaraan kes liwat Ketua Pembangkang, Anwar Ibrahim. Keseluruhan prosiding telah  dikutuk dengan meluasnya sebagai perbicaraan bermotif politik, yang seringkali digunakan rejim-rejim kukubesi untuk menghancurkan musuh-musuh politik mereka. Tetapi Anwar memiliki rekod panjang untuk tidak semudahnya menyerah kalah. Beliau telah mengisytiharkan bahawa apa jua keputusan pada 9 Januari ini, beliau tidak akan menyerah. Sebelum ini penjara tidak dapat mematahkan atau mendiamkan suara Anwar, semestinya juga tidak sekarang.

Tetapi apa yang dipertaruhkan di sini lebih daripada sekadar kebebasan peribadi pemimpin pembangkang. 54 tahun yang lalu, rakyat negara ini telah dijanjikan bahawa tanah air mereka yang baru merdeka akan bebas dan demokratik; dan hasrat rakyat itu telah diungkapkan dalam perundangan tertinggi negara, iaitu Perlembagaan Persekutuan. Janji ini telah dengan sengaja dimungkir oleh gabungan politik yang memerintah negara ini sejak hari tersebut sampailah ke hari ini.

Badan kehakiman yang bakal memutuskan penghakiman ke atas Anwar Ibrahim pada 9 Januari,  gagal untuk menegakkan kebebasan asasi yang terkandung dalam Perlembagaan dan membenarkan pihak Eksekutif untuk menginjak-injak hak-hak asas Rakyat. Oleh yang demikian, lebih setengah abad, rakyat telah menderita akibat undang-undang menindas, rasuah berleluasa dan penyalahgunaan amanah jawatan awam untuk keuntungan dan memperkayakan diri sendiri. Rakyat ialah pemilik tanah air ini yang sebenar-benarnya. Namun rakyat hanya menjadi peminta belas ehsan di pintu Putrajaya, di mana para pemimpin Umno/ BN dan mereka yang bergantung kepada kuasanya memerintah rakyat.
 

Lawan kepada rejim Umno adalah pakatan pembangkang yang diterajui Anwar, yang mana paksi tujuannya untuk memansuhkan kesemua perundangan menindas dan anti-demokratik serta mengembalikan kebebasan berperlembagaan kepada rakyat; untuk menamatkan kerugian besar-besaran akibat rasuah; dan untuk memastikan agihan kekayaan negara yang saksama dan adil. Kini Umno cuba untuk menghalang perjalanan hebat rakyat Malaysia ke arah kebebasan dengan cuba membunuh secara politik Anwar Ibrahim melalui sistem pengadilan yang berat sebelah dan mudah dipengaruhi.

Inilah sebabnya kenapa 9 Januari begitu  amat penting untuk setiap rakyat Malaysia. Pendirian Anwar untuk tidak tunduk terhadap suatu sistem yang zalim, memberikan kekuatan dan harapan baru kepada rakyat dalam menghadapi kekuasaan penindas yang zalim itu, malahan mengukuhkan keyakinan rakyat untuk menuntut perubahan dan reformasi. Justeru, iannya merupakan saat-saat kemuncak dalam pertempuran untuk jenis negara dalam mana ingin kita hidup, serta jenis nilai-nilai yang kita mahu wariskan kepada generasi Malaysia akan datang. Apapun jua keputusannya pada 9 Januari ini, kita dapat mengambil hikmat bahawa tidak lama lagi akan tiba pula giliran Rakyat untuk menyampaikan penghakiman terhadap kerajaan zalim dan menganiaya ini.

Najib the puppet Prime Minister

Marching into 2012 Najib Abdul Razak is still not perceived as a strong leader by the masses. It is the  perspicacity of the masses that his many personal, social and economic debacles will keep haunting him until the next general election – widely believed to be held before June 2012.
Race relations in the country is not getting any better and evidently religion is widely seen as a convenient gizmo used by UMNO to divide the people. Above and beyond, shady characters among some UMNO and Barisan Nasional (BN) politicians , abuse of taxpayers' money,  and the ineffective economic strategies of the government have failed to convince the masses.
Almost four years of BN at the helm after the March 2008 general election has not seen much clout in UMNO or Najib to shove the country to the right track. Their popularity seem to slide.
Many social and economic woes relating to race relations, religion and the economy have since alienated the masses. Corruption is perceived as too rife among those having power and authority but more often than not these are swept under the carpet for political reasons.
They only receive the crumbs
The recent RM100 and RM500 one-off payments to students and the poor respectively have been perceived by the masses as trying to 'bribe' for votes in facing the next general election. Even the purported 1Malaysia RM5,000 loan to the poor to invest under a national unit trust scheme is not going to electrify the people into voting for BN.
To an aid recipient in Kedah, he is not full of praise for the government: "This matters least, as the money given to the people is not from UMNO's own pocket but it's taxpayers' hard-earned money. We have to edify the people on this political strategy of UMNO. For now, just accept the money as it's the people's money, not UMNO's or BN's. When it comes to voting, this is totally going to be a different issue."
The people sense that the amount of money given to the poor by the government is just pittance that could not even make ends meet in time of high inflation in the country now. "This 'bribe of sort' is for short-term delight," says a farmer in Kedah. "The government has not come up with any concrete long-term plan to reduce inflation and bring down the cost of living to help the poor." He adds, "Increasing the pay of those already earning big salaries is not going to help reduce the price of food. Only the rich are seen to be given huge incentives and rewards to become richer. The poor are becoming poorer, as they only  receive the crumbs."
What is more interesting to the inquisitive minds of the masses is the quality of leadership the country has to offer.  The buzz among  voters is, '"Who is actually running the country now?" This is the question asked by many within and outside UMNO and BN. Everyone knows that officially Najib is the PM. But Najib has been perceived as a leader who could not steer the country free from Mahathir's influence. "As long as Anwar is around, Mahathir will not give up harassing Najib's administration.  He fears that UMNO and BN will lose big in the coming general election with Pakatan's increasing popularity," says a young voter in Kerian.
To see Najib tumble
The people are beginning to see Mahathir's role in Najib's administration is not receding but mounting.  Apparently, Abdullah Ahmad Badawi was squeezed out from his post as Prime Minister in 2009 by the maverick politician, Mahathir. Could the same happen to Najib if he decides not to 'listen' to Mahathir? Mahathir is still influential in UMNO politics not because he is too good a politician but there are factions within UMNO who would want to see Najib tumble. "But if Najib and UMNO tumble, BN has to close shop," says a political observer.  "Pakatan will form the next government." Mahathir is thus perceived by some political observers as the right man who can decide Najib's fate and possibly give more hope to the many other UMNO aspirants to climb up the political ladder.

The buzz is that before Najib decided on his Cabinet line-up, he was somewhat 'warned' by Mahathir that Khairy Jamaluddin – the elected UMNO Youth leader – should be excluded from the Cabinet. True as envisaged, when the Cabinet line-up was announced, Khairy was excluded. Perhaps this must be the first time in the history of UMNO where its Youth leader has not been given any Cabinet post. "With that move by Najib, Khairy's political fate is sealed," says an UMNO lawmaker. To some political observers, even Khairy's performance as a Youth leader is dismal: "He does not have the right charisma as a leader. The next general election would most probably see him not contesting at all."  The political murmur is that Khairy will lose his post as Youth chief in the next UMNO elections much to the delight of Mahathir.

Not only that, the hum was that Mahathir signalled to Najib that all Abdullah's men should also have been thrust aside from the post Abdullah Cabinet line-up. Shahrir Abdul Samad – being a fine politician – and realising the consequence, made a pre-emptive move. He decided to tender his resignation as a minister even before the new Cabinet line-up was announced. He nattily backed out before the axe fell on him. He could have sensed that the new Cabinet was going to be a Mahathir-charted Cabinet.

But when Najib had the courtesy to include some of Abdullah's men in, the whispers were Mahathir murmured that the Cabinet was still filled with some 'tainted' characters. Najib had no choice, as he saw some of these UMNO hardliners as his loyal supporters. Being a nebbish Najib needs them to 'brawl' for him against the Opposition for his controversial roles in many of the grim accusations on him by the latter. He is wary that he is not a political pugilist. Neither is he the pugnacious type. He is perceived by the people more as a 'play-safe' politician or prime minister unlike the belligerent Mahathir.
Flip flop policy
Abdullah in 2006 cancelled the famed half-crooked or curved bridge project into the Tebrau Straits to replace half of the Causeway that connects Johor Baru and Singapore. The project was mooted by Mahathir during his tenure as prime minister. When the iniquitous half-bridge was again cropped up by Mahathir during Najib's time, the latter was rather quiet on the issue. Possibly, he must have known that the project was just unviable.  Mahathir was again unhappy about this, as he is still adamant that the project must proceed. Najib has since been silent on this whole issue. The bridge project has stalled. The government lost RM740million of taxpayers' money for this cock-up.
Abdullah scrapped the double-tracking railway project from Johor to Padang Besar which would have cost RM14billion during his time as PM. Najib showed no enthusiasm on this project either. Instead the railway project is now being designated only from Ipoh to Padang Besar and the delay has cost the government RM12billion just for this short distance.  Mahathir is riled, as he feels that had the project taken off very much earlier, just with an additional amount of RM2billion the double-tracking would have connected Johor Baru and Padang Besar.
The use of English to teach Science and Mathematics (PPSMI) – Mahathir's brainchild is being dropped by Najib's government. Mahathir has been reported to have disagreed with the idea of dropping this plan that he implemented in 2003. Being averse to controversial issues, Najib smartly tossed 'the hot potato' to Muhyiddin Yassin to do the unpopular decision to scrap the policy. Muhyiddin has now ended up becoming a very unpopular education minister. This issue has dented his political career, but Najib is posing a chic silent on the matter. The dust has yet to settle and parents are not happy with this flip flop policy in education. BN is expected to lose more votes because of this issue and Mahathir is aware of this.
Muhyiddin is obdurate that the policy has to be totally scrapped. RM5billion ringgit of taxpayers' money was wasted on the PPSMI  which lasted for only nine years before it came to naught. Had this been in another democratic country the whole cabinet members would have resigned and many leaders would have been sent to the political dungeon.

Personal baggage

The campaigns leading towards a few by-elections during Najib's premiership washed a lot of his dirty linen in public. ''Enough mud-slinging at me and smearing my name," Najib was reported to have said during one of the crusades against the Opposition. Unfortunately, Najib is  not perceived by the people as a leader free from personal baggage and this is not a good omen for UMNO and BN. To the political observers, Mahathir is more eager to save UMNO than to indulge on personal problems of UMNO leaders.
In by-elections where Najib was quite reluctant to tramp Mahathir was seen more ready to tread. But, if Mahathir was to be seen going to the field jousting against the Opposition without Najib to be seen, what would the people perceive of the latter then? Despite Mahathir's help, UMNO lost a few by-elections and this badly bruised Najib's image.
At that point of time, Najib was cagey when BN lost a few by-elections to the Opposition and Najib ended up becoming the punching bag for the Opposition as well many of his foes within UMNO. "Najib, who grew up in a political aristocratic family would naturally play out-of-harm's-way politics. The most he would do is to have his people fight for him. But he has failed to realise that others cannot keep on doing the 'stunt' for him. Being the PM, the millstone will still hang around his neck," says a political observer.
Mahathir to salvage his image
Mahathir's presence was quite noticeable during  the Bukit Gantang and Bukit Selambau, by-elections in 2009. Najib – the incoming PM at the time – was practically kept away from the scenes. Mahathir went to the ground trying to salvage UMNO and BN but was stung taut by the 'mountain bees' at both the constituencies and both the seats finally went to Pakatan – PAS and PKR. 

Mahathir as a 'retired general' after leading the country for 22 years with relative success cannot live in peace seeing UMNO crumbling under Najib despite BN winning a few by-elections thereafter. Najib seems  to be losing more support currently by depending on Mahathir to salvage his image. Mahathir perhaps seems to be unhappy to see Najib more into building his image rather than focusing more on economic development for the country.

Mahathir must also be wary that if the ride is tough for Najib, he will let his other Cabinet ministers do the traverse for him. Najib has been silent on many issues – specifically the PPSMI and the RM250million loan given to a company whose owner is the spouse of a Cabinet Minister.  The cattle project was set up in 2008 when Abdullah was the prime minister. Khairy was at first adamantly defending the company but later on when more evidence cropped up on the alleged 'abuse' of the government-loaned money to the company he too went on a silent mode.
A puppet of this class
Knowing Mahathir, he does have some syatria (warrior) blood of the Keralites in him and he will go on fighting even after his war flag has fallen to the ground.
In the traditional wayang kulit (puppet show), the Tok Dalang (performer) pulls the puppet strings skilfully from behind to captivate the views and minds of the people watching the show on the white screen. Najib may prefer not to be a puppet of this class. But being perceived as a weak leader from within his team and also by his political nemeses he cannot afford to ignore Mahathir – the Tok Dalang. One flawed move Najib makes, he will be in trouble and would meet the same fate as what happened to Abdullah.
Najib, like all heads of government, aspires to be an independent prime minister but the thorn that is pricking his conscience from an 'obvious hand' is too much for him to bear. Unfortunately, he seems at times not being able to withstand it, but out of no choice the battle against his conscience has to go on for his political survival.
"To Najib, the advice is to let his own conscience decide what he wants to do as a prime minister. He should stand by his principles. He does not have to be shoved to the edge by anybody. It may be bitter though, but this is the pill he has to swallow in order to be respected or else it will affect his image as prime minister. But then he is seen as not too forceful a leader." says a senior UMNO member.
Next person to lead UMNO
Words are going round asking, "Who is the Prime Minister now? Najib or Mahathir?" Most people already have a vague answer to this question, for now. Najib to the masses has been implicated time and again for being a puny jouster and fingers are pointing at Mahathir who is pulling the string. But Najib is Mahathir's choice after Abdullah. Indeed, Mahathir should have first tutored Najib to be a 'fighter' before the latter could be put on the altar. Mahathir was in a haste to push Abdullah out of the scene and thus the appointment of Najib as PM.
Mahathir will keep Najib on his toes until the next general election. Najib realises that if he decides not to listen to the 'self-appointed advisor' to him, he will be in trouble. This is the least that he wants to face before the next general election. But if he keeps on listening to Mahathir, his political nemeses will brand him as a PM without his own stand.
If UMNO and BN fail in the next general election – which is more likely, Mahathir will call for Najib's resignation as prime minister like what he did to Abdullah at one time. Hope Mahathir lives long to see the fate of Najib after the next general election. Mahathir can, after that, decide who should be the next person to lead UMNO.
