Najib,resign or dissolve parliament?

With the whole country now being put to shame in having a Prime Minister involved in international money laundering scandal, it is time that ordinary Malaysians be given an opportunity to speak up and there is no better way than returning to the People to decide whether to continue with him as the leader of the country or otherwise.
Never in the 53-year history of Malaysia had our prime ministers been implicated in illegal international money laundering activities. Najib is the first one to have been so implicated.

As such, in light of the US DOJ's legal action which carries a criminal implication, Najib should either resign as the Prime Minister or seek new mandate from the People whether he should continue to act as the Prime Minister. If Najib chose not to resign, he should at least have the decency to call for a general elections to seek a fresh mandate from the People.

In Lim Guan Eng's case, in light of the criminal prosecution against him, there have been calls on Lim Guan Eng to resign as the Chief Minister. DAP's stand is that, the prosecution against him is a political persecution and that Lim Guan Eng is not in the position to influence the investigation or prosecution of his case. As such, there is no need for him to resign.

However, to respect the People's wishes, we have decided to return to the people of Penang to seek new mandate to govern. 

It is not a matter of whether there is a need or otherwise to have the Penang State Elections now. It is also not a matter about saving Lim Guan Eng. It is also not a matter about whether the Pakatan will have a bigger victory or otherwise. The rationale to have the Penang State Elections is that in light of Lim Guan Eng's criminal prosecution, the People of Penang should be given the chance to decide whether they still want him continue to lead the State or otherwise. 

There are conflicting views about whether Lim Guan Eng should resign as the Chief Minister or otherwise. Both have their arguments. At least, with the Penang State Elections, the Penang voters get the chance to decide.

We also call upon Najib to dissolve the Parliament and let Malaysians decide his fate as the Prime Minister of the country.

Sesco asked to explain how it calculates arrears

KUCHING: DAP state chairman Chong Chieng Jen wants Sesco to explain how arrears are calculated as yet another account holder has been charged exorbitant arrears.
He told a press conference yesterday that account holder Chong Siaw Khian was unhappy that Sesco was charging him arrears for two accounts of his.
For Account 1, Sesco alleged there were arrears totalling RM6,917.50 due to a defective meter that caused Sesco to lose RM7,467.50 in revenue last year. The meter was replaced in October 2012.
Sometime this year, Sesco alleged Account 2 also had arrears, again due to a defective meter. The arrears totalled RM6,387.54 while loss of revenue stood at RM6,937.54. That particular meter was last replaced in October 2013.
Noting similarities between Siaw Khian's case and previous ones, Chieng Jen believed the arrears had been derived arbitrarily.
"In the last few years, Sesco has been very zealous in changing meters and then demanding arrears caused by alleged meter defects.
"We found out that the Meter Department is given a target to meet every year, and their bonuses depended on it. This makes us very worried as to how they calculate arrears in order to meet their target."
Chieng Jen, who is also Bandar Kuching MP and Kota Sentosa assemblyman, cited a similar case where the High Court trial had concluded and was awaiting judgement.
"Same case. After meter was changed, there was no change in monthly consumption, yet there were arrears," he said.
Chieng Jen said if the High Court judge ruled in the account holder's favour, he must impose that Sesco provides a reasonable formula for calculation of arrears.
He added that he had written an official letter to Sesco to seek an explanation for Siaw Khian's case.
"We will wait for their response before deciding what to do next," he said, adding that Sesco's letter to Siaw Khian did not mention meter tampering but mentioned having 'detected irregularities'.

乱算电费又一宗 Sesco再向人民开刀

(古晋27日讯)又一古晋市民,在更换电表后接获砂电力公司不合理的追算电费单。

古晋市民张肇坚今向古晋市国会议员张健仁投诉,砂电力公司在2013年10月更换了他店屋3楼的电表,两年后于2016年正月出信指称旧电表有问题,因此,在2013年换电表之前的36个月,该电表少记录了6387令吉的用电,该事主也因此而少还了6387令吉的电费。

事主今日在张健仁的陪同下,出示他从砂电力公司所得到的,其过去几年每个月的用电记录。 该记录非常清楚的显示,更换了新的电表之后,该新电表所记录的用电量,不但没有增加,反而比旧电表所记录的少了70%。

该用电记录显示,换电表之前,该事主的平均每个月的用电量是180令吉,但是,换了新电表之后,他的每月平均用电量则只是50令吉。 以下是更换电表前后8个月的电费:

张健仁代表事主致函给砂电力公司,质疑砂电力公司的追算电费的计算法。

"换电表之后,若电费有增加,那还可说是旧电表有问题少记录了所用的电。 但是,今天这项投诉者的情形是,换了新电表之后,新电表所记录的每月电费很明显的下降很多。 这证明旧电表过去都是记录多了,不是记录少! 因此,砂电力公司不只不应该向有关事主追算少还的电费,反而应该退钱给有关事主!"

也是哥打圣淘沙州议员的张健仁指出,这几年来,砂电力公司非常落力的在换电表,然后就出信指称旧电表有问题,要他们的顾客还几千甚至几万令吉所谓的"旧电表因有问题而少记录到的电费"。

张氏说,砂国阵政府在州议会所通过的《电力供应法令》,赋予砂电力公司权力可以在电表有问题的情况下,随意指说其顾客"少还了一笔数目",在法庭上,电力公司的顾客就必须证明他们没有少还该笔数目。 这种法令的条文,根本就是在给予砂电力公司一柄'上方宝剑',任由砂电力公司鱼肉砂州人民。

张氏透露,砂电力公司在2011年举债150亿令吉,用来建水坝和电缆。 如今,这一部分的债卷已经到期需要偿还了。 因此,砂电力公司非常落力的向砂州人民'狂开刀'来还债。

他说,他在州议会数次提出有关《电力供应法令》条文的不公平。 但是,非常遗憾的是,砂州政府却蓄意包庇砂电力公司,不愿修改有关条文,也不愿约束砂电力公司的计算少还的电费的无限权力。

"今天砂电力公司之所以能够向砂州人民胡乱开刀,归根究底,就是因为砂州政府给予它太大的权力去肆意剥削砂州人民。 砂国阵这些所谓的'本土政党',就是剥削砂州人民的罪魁祸首。"

张健仁透露,之前他已针对另一宗类似的案件入禀高庭。 在审讯中,电力公司的职员更透露,砂电力公司对他们这些查电表的部门,每年皆有设立一个该部门所必须替公司收到多少收入的目标,他们的年底花红将取决于他们是否能达到那目标。

张氏说,在电力公司有设下这类目标的情况下,它将使人民更加没有保障。 因为砂电力公司的职员,有者极有可能因为了要达到目标拿花红,而胡乱计算那"旧电表因为有问题而少记录到的电费"的数目,逼使砂电力公司的顾客们啃死猫。

"目前,我所处理的有关高庭案件已审讯完毕,在等法官下判。 若法庭判决砂电力公司必须有一个合理的计算方程式,而非可以肆意胡乱计算这'少记录到的电费'的数目,那对成千上万的平民百姓都更加有保障,这也可钳制砂电力公司的一些权力,阻止后者的滥权。"

张健仁:一号官员被查,阿德南还支持国阵?

"大马一号官员"被调查,行动党古晋区国会议员张健仁促首长丹斯里阿迪南沙登重新考虑他对联邦国阵的支持,甚至退出国阵。

他表示,如今美国司法部门已经提呈冻结和一马发展机构有关的资产,并在控状中指有大马一号官员涉及。他认为,所谓的一号官员是谁,相信已经呼之欲出,因此他希望砂首长丹斯里阿迪南沙登履行之前的承诺,重新考虑对联邦国阵的支持。

他称,在全球瞩目下,国阵政府难辞其咎,在铁证如山情况下,砂首长阿迪南沙登应考虑是否继续支持联邦国阵,甚至退出国阵。

他表示:"不要等到国家到了无可挽救的地步,才来考虑是否支持联邦国阵,到时已经为时已晚。"

Chong: Time for Adenan to withdraw support for Najib

Sarawak DAP chief says Chief Minister must act following US DoJ's civil suits and revelations pertaining to 1MDB scandal.

KUCHING: Sarawak DAP leader Chong Chieng Jen said Chief Minister Adenan Satem should withdraw his support for Prime Minister Najib Razak in light of the US Department of Justice's (DoJ) actions last week.
In a press conference yesterday, Chong said the time has come for Sarawak's support to be withdrawn.
"It is clear that the whole world knows about the case of money laundering at the highest levels by Malaysian Official 1. It is not for Adenan to turn a blind eye in light of such strong and clear evidence," Chong said.
Last December, Adenan told the state legislative assembly that he would consider withdrawing the state Barisan Nasional's (BN) support for Najib under certain circumstances.
"If he (Najib) is found guilty in connection with IMDB, I will consider withdrawing our support for him. The man is innocent until he is proven guilty. Right now, he has not done anything wrong.
"I owe my loyalty to Najib. He is the prime minister of Malaysia and head of Barisan Nasional, so I continue to support him," Adenan had reportedly said.
The DoJ had filed civil suits last Wednesday saying that over US$3.5 billion (RM14 billion) was misappropriated from 1MDB.
In its suits, filed in Los Angeles, DoJ said it sought to seize assets "involved in and traceable to an international conspiracy to launder money misappropriated from 1MDB".
The DoJ also alleged offences were committed over a four-year period and involved multiple individuals, including Malaysian officials and their associates, who conspired to fraudulently divert billions of dollars from 1MDB.
It specifically named Najib's stepson Riza Aziz, Low Taek Jho (better known as Jho Low), and Abu Dhabi government officials Khadem al-Qubaisi and Mohamed Ahmed Badawy Al-Husseiny.
Chong also warned Adenan against any delay in withdrawing his support.
"I call upon Adenan not to wait for the whole country to be ruined before deciding to withdraw, or contemplate withdrawing, his support for Najib. Don't wait until the country is ruined beyond repair."
Asked if the withdrawal of Sarawakian support was premature considering Najib has yet to be found guilty of any crime, Chong said that the Attorney-General's office, the Malaysian Anti-Corruption Commission and the police are under Najib's control.
"As long as he (Najib) is in Malaysia, I don't see any chance that he would be prosecuted. Only when he resigns or he is toppled. So long as he is Prime Minister, it looks like in Malaysia, the Prime Minister is above the law," Chong said.
Chong added general elections should be called as soon as possible and that Sarawak DAP would support any decision by Penang's central executive committee to hold a snap election.
"At the moment, people have a sense of helplessness and hopelessness in light of all the international scandals caused by Najib and his administration," Chong said.
"I think this is the most appropriate time. Other than casting the vote, what else can you do?
"With all this dirt exposed in our country, what can you do? You write statements in the press? Is that very helpful? You go to the streets? Demonstrate in Bersih?
"Yes that helps to express your feelings. But does it have a real political impact in the administration of the country?
"It doesn't save the country. The best way is to call for a general election, to let the people have a true say," he said.
Meanwhile, Chong said Adenan must push to increase Sarawak's oil revenues from the current 5 percent to 20 per cent as Sarawak's oil wells are only financially feasible for extraction for another 25 years.
He added that Adenan must not make a "unilateral decision to postpone his demand for an increase in oil revenues, with low oil prices as an excuse".
The Sarawak legislatively assembly unanimously passed a resolution in 2014 to negotiate for an increase in Sarawak's oil royalties.
"I call on Adenan to walk the talk, and not merely make populist statements in Sarawak to Sarawakians about not compromising, about non-negotiation on Sarawak's interest, but at the same time, when he faces the Federal Government, especially Najib, he is compromising our rights," Chong said.
After a Federal Cabinet meeting in Kuching on May 4, Najib, in the presence of Adenan, said there was no discussion on oil royalties as "government revenue is at a critical level" due to low oil prices.
Sarawak held its state election on May 7, with BN winning 72 out of the 82 state seats.

张健仁:勿一直翻历史 争自主权只要3部曲

(本报古晋22日讯)砂民主行动党主席兼哥打圣淘沙区州议员张健仁今日提出三部曲,要求砂政府实际性争取自主权,第一:拥有明确议程,第二:极力争取,第三:由国会通过!

"争取自主权就是这么简单,毋须一再翻查'历史',人活在世上要展望未来,而不是活在历史,一再从MA63(1963年马来西亚合约)翻查历史,这只是在钻牛角尖。"
他解释,当初的合约,经过修改,导致权益失去,当初若非通过法令同意修改,到今日又要讨回来,甚至翻查历史记录去再去争取,这无疑是在钻牛角尖。
巫统分裂有机可趁
他强调,政治讲究实力,趁着有天时地利人和之际,若不加强自主权甚至夺回自主权,就是愧对砂人民的委托!
他认为,砂州务必要掌握目前的政治局势,如巫统四分五裂等,各地诸侯务必趁机夺回更多的自主,而刘镇东所提出的结盟论绝对是可行的方式之一!
"为了砂人民而争取,不管是强迫,或是压制,都要拿回自主权,有了自主权利,就有了行政权。砂州目前政治资本,原因是巫统弱,巫统一再分裂,今天的这个政治局势,砂政府要不要做英雄?要就努力拿回失去的,甚至拿回更多!"
张健仁是在今日出砂民主行动党722砂拉越日"自主、独立、公投"讲座会上主讲时,如是表示。
促政府制定明确议程
他续称,砂州政府必须制定明确的议程,再向联邦争取,若不愿意,就是违反整个争取自主权的意愿。
"我们希望拥有的是明确的主权,而不是行政权,雾里看花,最重要是率先获得税务主权。"
他再次强调,民主行动党上下38国会议员,全力支持下放权力给砂州政府,哪个政党可以同意,就给予支持,而目前只有行动党,接下来,就要向政府施压。
"争取自主权,不需要大费周章,以我以上的三部曲,其实很容易就能达到。"

(古晋23日讯)民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁今早带领行动党党员参与由砂拉越达雅协会所组办"还比尔卡勇一个公正"的集会。 同行者也有行动党实丹宾区国会议员陈国彬。

在致辞中,张健仁表示,谋杀比尔的事件,是一个公开挑战
国家法律和司法的行为。 虽然开枪者已被绳之于法,但是主谋还是逍遥法外。 尤其是在一个"钱是万能"的制度下,许多人已开始怀疑,真正的主谋是否最终会被绳之于法,因为最大的主谋嫌犯是一位有"拿督"头衔的千万富翁。

张氏说,今天的集会不只是一个"还比尔一个公正"的诉求,而也是一个还全民公正的诉求。 

"在我们怀缅比尔的当儿,我们更应该谨记他所代表的精神,即,不惧权贵捍卫土著习俗地的斗争。 我们失去一个比尔卡勇,应该要有更多的比尔卡勇站出来捍卫被剥夺的土著习俗地。"

张氏指出,如果砂州政府的土地政策是公平和公正的话,枪杀比尔的事件就不会发生了。 如果没有国阵朋党泛滥剥夺土著习俗地的政策,比尔也不会被谋杀。

"因此,在大家今天哀悼比尔卡勇逝世和向政府讨回公正的当儿,我们更应该敦促政府修改目前只偏重朋党利益而罔顾土著习俗地地主权益的政策。"

他也说,如果政府还是这样的持续'贱卖'有习俗地权力的土地给其朋党,更多的悲剧将会再继续发生。 

他质疑国阵政府的政策,为何政府需要批土地给大型的种植公司,而同时却忽略那些住在有关土地附近的原住民。 这是极度不公平的土地政策。

最后,张氏强调,"还比尔一个公正"的运动,并不只是单单比尔个人的惨案,而它也涵盖一个全民的诉求,即,还全部的土著习俗地地主一个公正。

“Justice for Bill ” Justice for all NCR landowners

We DAP supports the movement of PEDAS in its fight to demand for "Justice for Bill Kayong".

In the "Justice for Bill Kayong" gathering organised by PEDAS today at the Dataran Pahlawan, Kuching, the Member of Parliament for Stampin, YB Julian Tan and I attended together with a few DAP members.

The murder of the Bill Kayong is a blatant challenge to the authority and rules of law in this country.Though the gunman has been prosecuted in Court but the mastermind of the murder is still at large. In a system where "Cash is King", many are doubtful whether the mastermind of Bill's murder will ever be brought to book, given that the prime mastermind suspect is a very rich businessman with a "Datuk" title.

The gathering today at the Dataran Pahlawan is not only a demand for "Justice for Bill Kayong" but also a demand for "Justice for all". We must not only remember Bill Kayong as a person who fought to defend NCR land but his spirit in the fearless fight against the Rich and Powerful to protect and defend the NCR of the native landowners.

The tragic death of Bill Kayong would not have happened if the State Government's land policy is fair and just. Had there been no rampant alienation of NCR land to the BN cronies and the exploitation and deprivation of the native of their NCR land, Bill Kayong would not have died.

Therefore, while we moan the death of Bill Kayong, we also cry out to the Government to review and change its land policy which prioritise the BN cronies over the NCR landowners. 

If the State Government still persists in "Cheap-selling" land where there are NCR claims to it BN cronies, then sooner or later, more tragedies may happen. 

It is also most unfair on the part of the Government to alienate land to large plantation companies while ignoring the people living in the vicinity of these land.

Therefore, this campaign "Justice for Bill Kayong" has the implication beyond just the late Bill Kayong one person only but covers also a call for "Justice for all NCR landowners".

722 Happy Sarawak Day

The 722 celebration to Sarawak is the equivalent of 831 Merdeka Day to the Federation of Malaya. While the nation has celebrated 831 every year since the formation of Malaysia in 1963, 722 had gone past unnoticed. Not even our State Government in the past has given any recognition to 722. 

We have had 5 Chief Ministers and it is only in the 3rd year of the 5th Chief Minister's tenure that 722,the Independent Day of Sarawak, was given its due recognition. That is not normal and it speaks loud about how the government views the importance of this day.

We all feel proud to be Sarawakians and want the best for Sarawak.

In order to achieve that goal, it is the firm belief of DAP that the Common People of Sarawak must come first. Government policies should give more protection and opportunities to the common people of Sarawak rather than merely benefiting the few privileged ones. 

Sarawak, as it is now, is heading down the path of "the rich becoming richer and the poor poorer". Cash and power seems to rule the day.

On this first official celebration of 722 Sarawak Independence Day, we hope to see a Sarawak where all are equal and the abundant resources of Sarawak is shared by all, not the few chosen ones. We hope to see a Sarawak that has no poverty and that all children has the opportunity and the means to tertiary education.

Lastly, I wish all a "Happy Sarawak Day".
