WHY FEAR INDEPENDENT ELECTION OBSERVERS?

Independent Senator for South Australia, Nick Xenophon, said Malaysian media reports that Australia was seeking to interfere in Malaysia's elections are a "complete misrepresentation, fabrication and distortion of the true position."

Senator Xenophon was handed a personal letter from Malaysian Opposition Leader, Anwar Ibrahim, in Kuala Lumpur last week to hand to Australian Foreign Minister Bob Carr.

The letter sought assistance from Australia for Malaysia's forthcoming general elections to reflect the "true will of the Malaysian people", Senator Xenophon said.

"There was absolutely nothing in that request that could be construed as interference by one nation in another nation's affairs," Senator Xenophon said.

"The reality is that an independent International Observer Group from six nations reported in April this year on the Malaysian electoral system, raising a number of serious concerns on the state of Malaysian democracy."
Senator Xenophon was a member of that Observer Group which included representatives from India, Indonesia, Pakistan, the Philippines and Germany.

"Foreign Minister Carr was quite right to say Australia would not interfere in Malaysia elections. However, how can asking for independent observers be seen as interference in any way?"

"All Opposition Leader Anwar Ibrahim was asking for was for free, fair and clean elections in Malaysia and for Australia – as a neighbour and great friend of Malaysia – to play a role if requested."

Senator Xenophon said he would personally welcome Malaysian interest in Australia's forthcoming Federal election.

"Because Malaysia and Australia are such great friends, I'm sure Australian MPs and the Australian Electoral Commission would welcome scrutiny from Malaysian MPs over our electoral system in the lead up to our general elections next year," Senator Xenophon said.

"Why is the Malaysian Government so nervous about the Opposition Leader’s reasonable request for independent observers from the region?"

 

PAA 2012 Langgar Hak Rakyat Berhimpun Secara Aman

KUALA LUMPUR 23 November: Ketua Umum KEADILAN, Datuk Seri Anwar Ibrahim mempersoal peranan Perlembagaan Persekutuan dalam undang-undang Malaysia kerana seolah-olah menafikan hak rakyat untuk berhimpun secara aman.

"Yang kita bangkitkan ialah isu pokok, iaitu undang-undang tentang Akta Perhimpunan Aman (PAA 2012) kerana ia melanggar hak rakyat," katanya ketika ditemui di perkarangan Mahkamah Kuala Lumpur.

Mahkamah hari ini mendengar hujahan peguam Anwar, Karpal Singh berhubung isu sama ada Seksyen 4(1)(c) dan 4(2)(c) Akta Perhimpunan Aman 2012 bercanggah dengan Perlembagaan Persekutuan atau tidak.

"Dalam masyarakat yang ditadbir oleh undang-undang, mahkamah harus waspada dalam mempertahankan hak asasi dan teliti dalam memeriksa mana-mana larangan," hujah Karpal.
Lanjutan itu, Hakim Kamardin Hashim menetapkan Jumaat depan untuk mendengar hujahan balas pendakwaraya.

Anwar pada 16 Oktober lalu memfailkan permohonan bagi merujuk persoalan perundangan berhubung satu daripada tiga pertuduhan berkaitan perhimpunan Bersih 3.0 terhadapnya.

Pada 22 Mei lalu, Anwar dan Timbalan Presiden KEADILAN, Mohamed Azmin Ali serta Ketua Cabang Rembau, Badrul Hisham Shaharin didakwa di Mahkamah Sesyen kerana dituduh menyertai protes jalanan yang kononnya menimbulkan kekecohan di ibu negara.

Mereka mengaku tidak bersalah terhadap pertuduhan menyertai protes jalanan kononnya bagi maksud membantah perintah Majistret Zaki Ashraf Zubir yang melarang sebarang perhimpunan di Dataran Merdeka serta amaran supaya orang awam tidak hadir, berada atau mengambil apa-apa bahagian dalam apa-apa perhimpunan, antara 28 April hingga 1 Mei 2012.

Mereka didakwa melakukan perbuatan itu di sepanjang Jalan Tun Perak di sini antara 2.30 petang dan 3 petang pada 28 April lepas mengikut Seksyen 4(2)(c) Akta Perhimpunan Aman 2012 yang membawa hukuman maksimum denda RM10,000 jika sabit kesalahan.

Ketiga-tiga pimpinan itu merupakan kumpulan individu pertama didakwa mengikut Akta Perhimpunan Aman yang berkuat kuasa tahun ini.

Himpunan Bersih 3.0 pada 28 April lalu berjaya menarik kehadiran ratusan ribu rakyat pelbagai kaum yang berhimpun serentak di bandar utama di Malaysia dan luar negara.
Ia bertujuan mendesak kerajaan membersihkan sistem pilihan raya dan isu daftar pemilih yang diseleweng Suruhanjaya Pilihan Raya (SPR) sejak sekian lama.
