Defence Close Malaysia Anwar Ibrahim Trial Posted: 12 Dec 2011 04:23 AM PST BBC News Defence lawyers representing Malaysia’s main opposition leader Anwar Ibrahim have made their closing arguments at his sodomy trial in Kuala Lumpur. They urged the country’s High Court to acquit Mr Anwar of all charges, claiming that the man who accused him is a “compulsive and consummate liar”. Prosecution lawyers are expected to address the court on Tuesday. Supporters of Mr Anwar say the case is politically motivated ahead of national elections expected next year. But the government has denied any involvement with the charges or a conspiracy. Mr Anwar is accused of sodomising a former political aide, Saiful Azlam, in June 2008. The allegation surfaced just months after Mr Anwar led the opposition to win an unprecedented number of seats in the March 2008 elections, says the BBC’s Jennifer Pak in Kuala Lumpur. Sodomy is illegal in Malaysia, even among consenting adults. Mr Anwar faces up to 20 years in jail if convicted. ‘Character assassination’ Mr Anwar was imprisoned on separate sex and corruption charges in 1998, and freed on appeal in 2004. In August Mr Anwar said that the latest allegations against him were “a vile and desperate attempt at character assassination” orchestrated by his political enemies. Defence lawyer Sankara Nair told the AFP news agency that a verdict could be expected within a month. A guilty verdict would effectively prevent Mr Anwar from standing in the next polls, he said. “The evidence adduced by the defence has demolished all semblance of truth in the evidence [of Mr Anwar's accuser],” Karpal Singh, another defence lawyer, told the court. But our correspondent says that Mr Anwar’s lawyers believe they have a tough case to prove. The prosecution’s case rests mainly on his accuser’s testimony and DNA evidence allegedly linking Mr Anwar to him. Mr Anwar’s lawyers say the DNA material is tainted. But the judge has already said in court that they found Mr Anwar’s accuser and key DNA evidence gathered against him to be “credible” and “reliable”. Malaysia’s governing National Front coalition, which has ruled the country since 1957, is widely expected to seek a new mandate by mid-2012.

Peguam Anwar: Wujud Keraguan Munasabah, Keterangan Saiful Perlu Dinilai Semula Posted: 12 Dec 2011 03:53 AM PST The Malaysian Insider Barisan peguam Datuk Seri Anwar Ibrahim mendakwa mereka berjaya menimbulkan "keraguan munasabah" dalam kes liwat melibatkan Ketua Pembangkang selain dapat 'mematahkan' keterangan pengadu Mohd Saiful Bukhari Azlan. Dalam hujah penggulungan kes peringkat pembelaan, peguam utama Karpal Singh memfokus ke atas soal kredibiliti Saiful sambil menegaskan keterangan-kerangan saksi utama itu tidak boleh dipercayai. "Kredibiliti SP1 (Saiful) perlu dinilai semula oleh mahkamah memandangkan ia mengambil tempat di seluruhan kes," kata beliau sambil menambah, di akhir kes pembelaan mahkamah harus mempertimbangkan sama ada kes ke atas tertuduh telah dibuktikan melampaui keraguan. "Dapat dikemukakan oleh pembela, berjaya menimbulkan keraguan munasabah ke atas kes pendakwaan," kata Karpal. Karpal menekankan, Saiful ada mengatakan bahawa perbuatan diliwat pada 26 Jun 2006 berlaku dengan "laju dan rakus." Ini menurut Karpal, telah berjaya dicabar oleh saksi pakar pihak pembela Dr Thomas Hoogland, yang mengatakan bahawa seorang yang dalam usia Anwar tidak mungkin boleh melakukan perbuatan yang digambarkan oleh saksi utama. "Apa yang berlaku di lantai bilik tidur berhubung kejadian liwat yang didakwa oleh SP1 tidak ditimbangkan dengan teliti oleh mahkamah ini," kata Karpal. Tambah beliau, Dr Hoogland juga ada mengatakan bahawa Anwar tidak mungkin boleh melakukan aktiviti sedemikian tanpa melalui kesakitan yang teruk ekoran masalah artritis dan kerosakan saraf dialaminya. Oleh itu katanya, keterangan Saiful di peringkat itu menimbulkan keraguan dan tidak boleh dipercayai, sekali gus menjejaskan tuduhan yang dibawa ke atas Anwar.

Hakim Zabidin bersetuju dan mahkamah akan bersidang semula jam 1.30 petang esok. 3.35 petang: Peguam Ramkarpal Singh sekarang mengambil tempat untuk menggulung hujah. 3.25 petang: Sankara percaya Najib terlibat dalam kes Fitnah II dan menyifatkan penglibatan Najib amat jelas kerana 'cap jari beliau kelihatan di mana-mana sahaja di dalam kes ini.' "Pertama, pertemuan di antara Najib dan tertuduh. Kedua, kenyataan Najib yang bercanggah sepanjang perbicaraan berlangsung," kata Sankara yang turut mempertikai keengganan Najib dan Datin Seri Rosmah untuk hadir di mahkamah. "Jika mereka tiada apa-apa untuk disorok, kenapa ketepi sapina," kata Sankara yang juga mempertikai penglibatan bekas Ketua Polis Melaka, Datuk Rodhwan Yusof dalam kes ini. "Atas kapasiti apa Rodhwan berjumpa Saiful? Beliau tidak ada urusan dalam kes ini," katanya. 3.15 petang: Sankara percaya Saiful tidak pernah berada di dalam kondominium tempat kejadian didakwa berlaku. Malah, pendakwa raya juga gagal membuktikan Saiful berada di tempat kejadian. "Apa yang pendakwa raya ada cuma rakaman CCTV yang tidak jelas," kata Sankara yang menyatakan bukti cecair pelincir KY Jelly juga tidak boleh diguna pakai dalam kes ini. "Bukti KY Jelly tidak boleh digunakan kerana ia tidak pernah langsung diuji," kata Sankara. 2.44 petang: Adun Bukit Lanjan, Elizabeth Wong tiba di galeri awam mahkamah.

Papagomo’s Scorpene Trip- Proves UMNO’s Link With Sex Video Conspiracy Posted: 11 Dec 2011 06:20 PM PST I refer to pro-UMNO blogger Papagomo’s trip on the Scorpene submarine KD Tun Razak on Dec 10  2011. Papagomo must have obtained clearance at the highest levels of UMNO and the government in order to be allowed upon the nation’s newest and most expensive submarine. He could not have done so unless he enjoyed close and confidential links with top UMNO leaders, including UMNO Vice-President and Defence Minister Ahmad Zahid Hamidi.    Earlier this year, the blogger had obtained exclusive footage of the ‘Datuk T” sex video, which was fabricated as part of a vicious campaign to damage the reputation of Opposition leader Datuk Seri Anwar Ibrahim. Papagomo who was a key player in the sex video criminal conspiracy has now been proven to be on intimate terms with top UMNO leaders. It can now no longer be doubted that UMNO and the government have been the ‘secret hand’ behind the ‘Datuk T’ sex video conspiracy. ( Another key figure in the conspiracy is Rahim Thamby Chik, who is also an UMNO stalwart and a former UMNO Chief Minister). UMNO’s fingerprints can be seen everywhere in the sex video plot against our country’s Parliamentary Opposition Leader.This incident also demonstrates how UMNO and the government rely upon vulgar mercenaries like Papagomo in order to carry on political warfare against Anwar and the political opposition. UMNO is even prepared to compromise national security by allowing an anonymous blogger to board a sensitive naval craft. It is a disgrace to UMNO, BN and the government that they are on such close terms with a blogger who uses foul and intemperate language and screens pornography on his blog.    It should be remembered that the leader of the oppostion plays a central role in our political system. A wide-ranging criminal conspiracy involving the government, UMNO, police leadership and A-G’s chambers against the Opposition Leader is thus tantamount to a subversive assault upon our democratic system of government. We demand that UMNO and the government immediately reveal the full extent and particulars of  their dealings and relationship with the notorious blogger Papagomo, particularly in respect of the fabricated sex videos; we further demand that UMNO and the government abandon the politics of lies and conspiracy, and engage the opposition in fair debate.    N SURENDRAN VICE PRESIDENT KEADILAN
