【国会报道】政府未签署联合国难民地位公约 . 流落大马难民处境堪虞 Posted: 28 Jun 2011 07:59 AM PDT For blog post with similar content in English, please click here. 首相署部长纳兹里指出,持有合法难民证及遵守大马法律的难民,一定不会被控上庭,除非对方做出犯法的行为。他今日在下议院回答行动党沙登区国会议员张念群的问题时,如此指出。 然而,沙登国会议员张念群却举例,一名在大马的缅甸难民上星期向澳洲的报纸控诉,大马志愿警卫团去年3月到他所居住的公寓展开逮捕行动,同时也逮捕了另外6名持有合法难民证者的难民。志愿警卫团更把他们的难民证抢走,并把他们送入监狱,导致不谙马来文的他们坐牢了3个月及被鞭3下。 纳兹里说,大马虽没有签署1951年联合国难民地位公约,但是大马还是规定他们的福利必须受到保障,因为他们生活在大马的国土上,因此上述情况不是大马对待难民的方式。不过纳兹里承认,他并不了解张念群所指事件的详情,不过可以肯定的是,若遵守大马的法律,持有难民证的难民是不会被惩罚的,除非他们抵触大马的法律。 另外他表示,根据联合国难民事务最高专员公署(难民署)截至2011年5月的数据显示,大马共有8万3千573名拥有“难民”地位的难民,及1万36名寻求庇护者。 他说,基于大马没有签署上述难民公约,难民不是强制性接受健康检验,不过根据1951年费用法令209条文,难民可享有比外国人便宜50%的医药费。 转载自《星洲日报》 【光明日报】首相署部长辩称由于未签公约 ‧ 大马没难民 (吉隆坡28日讯)首相署部长拿督斯里纳兹里表示,大马并未签署1951年联合国难民公约,所以大马并没有所谓的“难民”,或强制这些人进行身体检查的条例。 “不过,联合国难民署与非政府组织合作,为这些人提供身体检查,在这方面,马来西亚政府不曾否认,他们可以在本地诊所获得这些服务,并可以获得比外国人少收50%的折扣。 “ 他于周二在国会下议院回答民主行动党沙登区国会议员张念群询及大马难民人数及健康的问题时说,根据联合国难民署统计,截至今年5月,共有9万3609名有必要受到关注的人,其中8万3573人是“难民”,另1万36人是申请庇护者。 (More......) |

In addition, they can be caned as a form of punishment. Kap Lian's account of his arrest, incarceration and punishment, the first by an actual holder of a refugee card, raises new questions about the Australian government's guarantee that no asylum seeker it sends to Malaysia will be abused under its proposed refugee swap deal. Malaysia and the United Nations High Commissioner for Refugees insist protections of asylum seekers have improved substantially in recent times. In a significant development, it was announced on Thursday that the feared volunteer corps, known by its Malay acronym RELA, has ceased operations against irregular migrants since March. But Mr Kap Lian's nightmare occurred when the UNHCR was supposed to have an arrangement with the police and immigration authorities that any genuine asylum seekers would not be detained, let alone punished with caning. |

Posted: 28 Jun 2011 06:57 AM PDT ~ by Haider Yutim KUALA LUMPUR, 28 JUNE, 2011: Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz told Dewan Rakyat today that the government has never denied the rights of refugees despite not sigining under the United Nations High Commissioner for Refugees (UNHCR). According to him, based on UNHCR, up till May 2011 there are 93,609 persons of concern to UNHCR in which 83,573 of them are qualified to be called refugees and 10,036 of them are asylum seekers. “Since Malaysia is not a member of the 1951 Convention relating to the Status of Refugees, refugees are not required to undergo health screening,” said Nazri addressing a question by Serdang MP Teo Nie Ching on whether health screening is compulsory for refugees in Malaysia. However, he said that UNHCR with the collaboration of NGOs such as ‘A Call To Serve’ caters medical examination to those refugees. “The government has never denied the rights of the refugees to get medical examinations in local medical centers,” Nazri said. In fact, he told that they also get 50 percent discount which is different from the charges imposed to regular foreigners based on Act 209. Teo also told of an incident revealed by an Australian newspaper that happened on 11 March 2011, where 20 Burmese refugees were detained by Rela (Ikatan Relawan Rakyat) members. She said the Rela members stormed into the apartment of Mr Kap Lian and 20 of them were picked up where six of them had UNHCR cards. According to sources, they were taken to prison despite showing the cards, in which they were trialed. Teo said neither of the detainees know how to speak or understand Malay which resulted in them being sentenced to three months jail and caned three times. (More......) |
