What more does MACC want or need from me?

If MACC refuses to act on my complaint on the award of the Kapit Jalan Song/Sg. Yong (Pakej B) project to Impian Zaman Sdn Bhd, just tell all Malaysian about its true intent, and stop giving excuses for not taking action on the matter.
I have given the particulars of the project involved, how much over-priced the government is going to pay for the project (at least by RM20 million), the incredibility of a RM1 million capital company undertaking a RM119 million project, the unusual secret conversion of "open tender" to "selected tender".
What more does MACC want or need from me?
Is MACC expecting me to provide them some bank accounts and transactions of the company involved? That would be against the law. If I were to give the bank accounts statements of the company involved, I would be charged under the Personal Data Protection Act, 2010 or Banking and Financial Institutions Act, 1989 (BAFIA).
PKR's Member of Parliament Rafizi is an example. He exposed the infamous cow-condo scandal but at the end, he was charged under the provisions of BAFIA.
I am sure the MACC deputy chief commissioner (operation), Datuk Seri Mohd Shukri knows the provisions of the law which prohibit any person from disclosing or even in possession of another person's bank account information.
It is only the MACC or the Police who has the legal means to access to such information. So, why ask me for these information when the MACC knows full well that it is against the law for me to produce such information.
As such, I am puzzled by the repeated calls by MACC for me to produce further information on the matter.
Is MACC setting a trap for me to step into or is MACC truly serious about investigating on the matter?
I also wish to tell the MACC officer, whatever in my possession, I have already disclosed in the press. There is no additional information. It is for the MACC now to use its statutory power to get more information, if it is minded to investigate the matter. However, it the MACC officer is still minded to visit me in my office, they are most welcome.

反贪委员会是否有意要调查这个工程的整个过程,还是要设陷阱诱我上当?

(古晋22日讯)古晋市国会议员兼哥打圣淘沙州议员张健仁质问马来西亚反贪委员会,到底有没有意愿要调查加帛省桑路(B段)建路工程的投标程序,还是要设陷阱控告他。
张健仁今天回应马来西亚反贪委员会副局长Datuk Seri Mohd Shukri时,如是表示。
根据今天报章报道,反贪委员会副局长Datuk Seri Mohd Shukri 要求张健仁提供反贪委员会更多有关该工程的资料。
张健仁表示,他所知道的,他都在报章上公布了,如,工程名称、政府被"干捞"至少2000万令吉、100万令吉资本的公司做1亿1190万令吉工程的荒谬性以及不寻常的"公开招标"被偷偷改为"邀请性招标"。
"这些资料已足够让反贪委员会展开调查。反贪委员会还要我给他们什么资料? 难道要我也提供有关公司的银行户口资料?"
张健仁表示,如果他真的提供给反贪委员会有关该公司的银行户口资料,他本身将是第一个被提控上法庭的。 因为,在《2010年个人资料保护法令》和《1989年银行和金融机构法令》,除非当事人有给予书面批准,其他人不可拥有或向第三者透露有关当事人的任何资料,包括银行户口资料。 公正党国会议员Rafizi就是一个榜样,他暴露牛公寓丑闻,但是,他最终却被政府以《1989年银行和金融机构法令》的条文提控上法庭。
张健仁相信Datuk Seri Mohd Shukri也非常清楚有关法令的条例。只有警方或反贪委员会有法律的权力去调查这家公司银行户口及其他资料。
"不要说我没有这些资料,就算有,我也不会给反贪委员会这些资料。因为,在没有当事人的书面同意下,只有警察或反贪委员会可以合法的得到这些资料。"
张氏称,调查的权力在反贪委员会手上,要不要调查也是由反贪委员会决定。 因此,反贪委员会的官员不需继续在报章上惺惺作态,假意向我索取资料。
张氏质疑,到底反贪委员会是真的有意要调查这个工程的整个过程,还是要设陷阱诱他上当?
"我再次强调,我所有的资料,都已在报章上公布了。其他的资料,反贪委员会可以自己去找,我也无可帮忙。 不过,反贪委员会的官员若还是要到我办公室谈有关工程事项,我无任欢迎。"

‘Remove Awang Tengah to curb illegal logging’

Sarawak Chief Minister Adenan Satem must remove his Second Resource Planning and Environment Minister Awang Tengah Ali Hassan if he is really serious in curbing illegal logging activities in the state, said Sarawak DAP Chief Chong Chieng Jen.

"If Adenan is serious about curbing illegal logging activities, he has to remove Awang Tengah, otherwise the forest officers see his retention as a sign of weakness on the part of the chief minister," said Chong when asked to comment on Adenan's warning to enforcement and forestry officers against taking bribes over illegal logging.

Chong said that Awang Tengah, who was appointed by the then-chief minister Abdul Taib Mahmud had been there for the last 10 years and he was seen as not doing anything on illegal logging.

The second minister had been "sleeping" on his job, he added.

On the seizures of logs, Chong, who is the MP for Bandar Kuching and the state assemblyperson for Kota Sentosa, said that he had seen photographs taken on the logs that were seized for the past three months.

Those were small logs which had no commercial value and there were only good for pallets, he said.

 "Those seizures are not true... it was only for show and the message is since you want to catch the illegal logging we let you catch some.

"I don't see pictures of big logs being seized," Chong (left) said, pointing out that if Adenan was really serious about curbing illegal logging activities he had to do something drastic such as removing his second minister.

In the November sitting of the state assembly, a number of DAP lawmakers had asked Adenan to remove Awang Tengah as he was  not effective against illegal logging, resulting in the loss of hundreds of millions of ringgit in terms of revenue.

The rampancy of illegal logging activities came to light after Adenan took over as chief minister on Feb 28, 2014 from Taib who relinquished the chief ministership after helming the state administration for more than 33 years.

In the past few months Adenan had been meeting with enforcement officers, timber tycoons and timber operators and telling them that he was serious about corruption and illegal logging activities.

Last Thursday, Adenan told enforcement and forestry officers over dinner that he might need the assistance of the Malaysian Anti-corruption Commission if illegal logging activities still persisted.

Expressing his frustration with some forestry officers, Adenan, who is the First Resource Planning and Environment Minister, said that despite that Sarawak having one of the best detection systems to monitor logging activities, illegal logging activities continued to rampage the state forests and national parks.

High-tech detection systems, but...

He said that the state's detection systems were accessible to satellite photos and topography and mapping system, and yet the officers were unable at the touch of a button to determine areas with licensed operators and those of illegal logging.

"This must be due lack of expertise apart from weak enforcement and corruption among forestry officers," he said.

He said some forest officers did not even know the boundaries of timber concessions and companies operating within their areas, while some chose to accept bribes to guarantee their safety against illegal operators carrying weapons.

He admitted that stories of corrupt practices amongst enforcement officers were not rumours, adding that illegal logging activities had gotten worse that even national parks were encroached and found it very suspicious when officers were unaware of their surroundings.

He said: "We have started war against illegal logging and smuggling of logs. Sarawak forest is our treasure. Like all treasures, we should take great care and love our forests.

"I mean what I said... don't mess with me," he  told forestry  officers and other diners.

Awang Tengah was one of those present.

只充公价值不高木桐,疑取缔如作秀

(本报古晋19日讯)行动党古晋区国会议员张健仁怀疑,砂州政府所谓的严厉对付非法伐木只是"作秀",因为在许多取缔行动中,被充公的只是商业价值不高的木桐。
他在今午被询及砂州首席部长丹斯里阿迪南沙登在对付非法伐木一事上的行事作风时称,首长未将相关的州内阁部长撤换,显示其要真正杜绝非法伐木活动的决心并不坚决。
与此同时,张健仁也认为,在过去的多项取缔非法伐木行动中,有关当局所充公的木桐,都是是一些商业价值不高,体积不大的木材,因此他怀疑,所谓的严厉对付非法伐木只是在作秀。
"被充公的只是低商业价值的木材。"

电力局追讨数额离谱 5899电费 怎么算?

据了解,事主刘纯铭是在2009年1月搬入峇哥路一住宅区双层排屋。到了2010年3月,砂电力局前来更新电表,并再3个月后,向他追讨过去14个月,共5899令吉的电费,再加上行政费及新电表费,事主总共得缴交6449令吉20仙。
同时也是哥打圣淘沙区州议员的张健仁表示,未更换电表前,事主每月电费大约是90令吉,更换电表后,电费增加至145令吉左右。若以此差距计算,事主每月大概也只是少还了50多令吉,追算14个月至多也只是700多令吉,岂有高达5000多令吉之理?
求情不受理
事主较后曾多次向砂电力局求情,但不得要领,因此张健仁在12月9日代他致函电力局,该局隔天(10日)也回函表示会关注此事,但没想到在11日,砂电力局却中断了事主住家的电流供应。
"这是滥用权力的表现,电力局虽有权力中断电流,但在上述事件中,却于理不合。"
有鉴于此,张健仁于今日下午陪同刘纯铭向消费人仲裁庭投诉此事,但也被告知,基于条例问题,该投诉或许无法在消费人仲裁庭受理。他说:"若真如此,我们将把此事带上法庭。"

加帛省桑路(B段)工程, 国阵“邀请性招标”模式,使纳税人白还2000万令吉

(古晋18日讯)加帛省桑路(B段)建路工程,国阵"邀请性招标"模式,使纳税人白还2000万令吉。

民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁透露,在今年2月初,政府在报章上刊登广告,公开邀请承包商投标加帛省桑路(B段)(CH.5+460 to CH.17+560)的建路工程。 在短短的半个月时间,总共53家承包商计算及呈上他们的标书。 排除最高和最低价的投标数额,51家承包商的投标数额是介于RM82,857,153 to RM141,290,530。

"但是,在这些承包商完全不知情的情况下,财政部私下取消该工程的公开招标程序,把它改为'邀请性招标'并指定10家由财政部所列出的公司为受邀请投标的承包商。"

张健仁表示,当他在国会提出质问为何"公开招标"被偷偷换为"邀请性招标",财政部给予的回答是,'该工程需紧急完成,而且需由财力和技术强大的公司去执行该项工程'。

张氏说,虽然政府给予的官方答案是该工程需紧急施工,但是,原本公开招标3月11日就截止的,却因为这种偷天换日的改换招标程序,结果,该工程却拖到今年11月17日才批出。 获得工程的"受邀请"公司是一间叫Impian Zaman 私人有限公司,而政府则是以高达1亿1983万令吉的高价批该工程给这间公司。

张健仁指出,政府以如此高价批该建路工程给这间公司,违反3大正常原理:

1.   在之前公开招标下投标的众多公司中,有17家承包商的投标数额是少过1亿令吉的,另外则有15家承包商的投标数额是少过1亿1983万令吉的。 这32家承包商的平均投标价是9900万令吉,比政府给予Impian Zaman 私人有限公司的价格少2000万令吉。  为何政府要多还2000万令吉给予这间由财政部所指定的公司?

2.   在这32家承包商当中,也有许多是有雄厚财力和强大技术的公司,有者甚至是挂牌公司。 为什么这些价钱又较便宜、背景又更强的公司都没有被列入"被邀请"的名单?

3. 根基马来西亚公司注册局的搜查显示,该Impian Zaman 私人有限公司的已缴资本只是100万令吉。 而且,它是属于一间所豁免向公司注册局呈报公司财政报告的私人公司。 一间100万令吉资本的公司,如何去承建一个价值1亿1983万令吉(比它的资本大超过100倍)的建路工程?

张健仁说,因为这种朋党运作,政府所需付出承建该加帛省桑路(B段)建路工程的价格暴增20%(2000万令吉)。 2000万令吉纳税人的钱,也就这样轻易的转为国阵朋党的私利。

张氏谴责纳吉,一边说要减少给予人民的津贴及增加向人民征税,另一边,他所掌管的政府部门却继续用人民的钱进行官商挂钩的把利益和纳税人的钱,送给国阵朋党公司。

张氏也说,目前我国正面对自1997年亚洲经济风暴以来最严峻的考验,因为:
1.   国际油价下跌逾40%,使我国政府收入下跌逾15%;
2.   政府欠债已高达史无前例的5690亿令吉;
3.   马币下跌至1美元兑3.5令吉或2.68新币对1令吉,而市场预算马币将继续下滑。
4.   最近所公布的2012年马来西亚黑金外流高达1711亿令吉。 以人均计算,马来西亚黑金外流情况是全球第一,即,中国(人均黑金外流US$183.91), 印度(人均黑金外流US$47.65), 俄罗斯(人均黑金外流US$856.16), 墨西哥(人均黑金外流US$774.81), 马来西亚(人均黑金外流US$1,646.36);
5.   政府减少甚至取消许多日常必需品的津贴;及
6.   政府将落实消费税,向广大贫穷人士征税。

张健仁也透露,行动党之前曾向马来西亚反贪委员会呈报这间偷天换日的"公开招标"变"邀请性招标"事件,但是反贪委员会拒绝调查。 这再再证明,马来西亚反贪委员会只不过是纳吉的"马仔",而不是一个真正要落实廉洁施政文化的执法单位。 反贪委员会是不会去调查由纳吉掌管的财政部。


"这起事件很明显的告诉人民,我们所还的每1令吉税,有20%去到的国阵朋党的口袋。 只要国阵一日还是马来西亚的政府,这种朋党作业模式还是会继续下去。 最终,人民将被逼越还越多的税来维持这些朋党的利益。"

In early February, 2014, an open tender was initially called for the construction and completion of the said Pakej B, Jalan Song/Sg.Yong, Kapit project.  Newspaper advertisement inviting contractors to submit their tenders were published.  A total of 53 contractors submitted their tenders for the said project. 


Taking away the highest and the lowest tender prices, the tender prices submitted by the remainder 51 contractors ranged from RM82,857,153 to RM141,290,530.

Unknown to the contractors who have submitted the tenders, by a letter dated 19-2-2014, the Ministry of Finance cancelled the open tender process and applied the "selected tender" process whereby only 10 contractors were selected by the Ministry of Finance.

The reasons given by the Ministry for the secret conversion of the open tender to selected tender process were that the project needed to be carried out urgently and by contractors with strong financial and technical standing.

Despite the so-called "urgency" of the matter, the contract was finally awarded to one of the 10 selected companies, ie. Impian Zaman SdnBhd on 17-11-2014, 8 months after the supposed closing date of the cancelled "open tender" process.  The company was awarded the said Pakej B Jalan Song/Sg Yong, Kapit project at the price of RM119,830,000.00.


There are three (3) glaring improprieties of the award of this Pakej B, Jalan Song, Kapit project:

1.       There are 17 contractors who submitted tender prices below RM100,000,000 and 15 more contractors who submitted tender prices below RM119,800,000 for the project.  The mean (average) tender prices of these 32 contractors is about RM99,000,000, which is RM20 million less than the award price for Impian Zaman Sdn Bhd.  Why did the government want to pay an extra RM20 million more for the said project?

2.       Amongst these 32 contractors, there are also established contractors, and even a public listed company.  Why were these contractors excluded from the "selected list"?

3.       Impian Zaman has only RM1,000,000 paid-up capital.  It is also a exempt private company where there is no need to file its financial account with the Companies Commission of Malaysia.  How can a company with only a paid up capital of RM1,000,000 paid-up capital undertake a RM119,830,000 construction work which is more than 100 times its paid-up capital.


The bottom line is:  At this crony price of RM119,830,000 for the said Pakej B Jalan Song/Sg Yong, Kapit project, the project costs has escalated by 20% (or RM20 million) compared to if the project were to be awarded by open tender.  At least RM20 million of the tax-payer's money has just gone to enrich the BN crony.

It is most unfair to the People that when Najib is talking about cutting subsidy for the people and increasing tax on the people to support the Government's coffer, his ministry is still dishing out lucrative and over-priced contracts for the benefits of the BN cronies at the expense of the people.

At this juncture, the country and its people are facing one of the toughest times since the 1997 currency crisis because of:
1.       A more than 40% drop in international oil prices reducing the overall Government's revenue by approximately 15%;
2.       Government debt has increased to an unprecedented level of RM569 billion;
3.       The Ringgit has depreciated to RM3.5 to US$1 and RM2.68 to S$1 and is expected to continue depreciate;
4.       The recently announced illicit money outflow from Malaysia is still at an alarming level RM171.1 billion for the year 2012. 
In per capita sense, our illicit money outflow tops the world: China (US$183.91 per capita), India (US$47.65 per capita), Russia (US$856.16 per capita), Mexica (US$774.81 per capita), Malaysia (US$1,646.36 per capita);
5.       The Government has reduced subsidy on many essential goods for the people; and
6.       The Government is introducing the GST to tax the poor to increase its revenue.


We DAP has, earlier on, lodged a report on the secretive conversion of "open tender" to "selected tender" of this project with the Malaysian Anti-Corruption Commission, but the MACC refuses to investigate.  It is proof that the MACC is more of a figurative "lapdog" of Najib than an enforcement body to inculcate integrity in the system.  That is why it will not investigate the Ministry which Najib heads even where there is glaring improprieties.

The people must remember, for every Ringgit of tax money that we pay, at least 20% has gone to enrich the BN cronies.  This has gone on for decades and will continue so long as BN is the government.  At the end, the Rakyat will be forced to pay more tax to finance the financial interests of these cronies.
