Chua Soi Lek Should Stop Questioning Malay Rulers's Prerogative

Speech by Dr Boo Cheng Hau, DAP Johor State Chairman at Yong Peng DAP branch dinner on 27 April 2012 held at De Jiao hui, Yong Peng, Johor.

 
 MCA President Dr Chua Soi Lek has repeatedly belittled DAP for letting go Perak Menteri Besarship to PAS' Nizar Jamaluddin when DAP had the majority of seats within Pakatan Rakyat during 10 month PR rule in Perak.



 Dr Boo emphasized that it is the Malay Rulers' prerogative to appoint a Menteri Besar letting it be a Malay or Non-Malay. Even though the Malay Sultanate States' constitutions state that a Menteri Besar must a Malay muslim unless with exceptional assent by the Malay ruler of the respective state.

DAP respects the constitutional framework, and Chua Soi Lek himself should stop questioning Malay Rulers prerogative in appointing Menteri Besars and consult a constitutional law expert on the issue.



 Chua Soi Lek has attempted to stir up racial sentiment without respecting the constitutional framework and demonizing  PAS as an extreme political party at the expense of distorting the state Constitution.


I personally welcome PAS Vice President Salahuddin Ayob to return and contest in Johor.



His presence definitely would boost PR standing in Johor. Salahuddin Ayob so far is one of the most experienced PR leaders in Johor. He is an open minded leader from PAS and I am sure he will contribute to PR's effort in marching towards Nusajaya.


As reported by today's The Star, Chua Soi Lek is more interested in positions sharing in the PR, Chua Soi Lek should stay out of PR internal matters and ask what MCA has contributed to the welfare of Johor People.






He has repeatedly despise Malay rulers prerogative in appointing Menteri Besars without a deep understanding of Malay State Constitutions which were agreed by UMNO, MCA and MIC at the time of independence. Chua Soi Lek should stop exploiting on the Constitutional issues that are created by MCA itself.

Press Statement by Dr. Boo Cheng Hau, Johor State Assembly Opposition Leader issued on April 26 2012, in response to Johor State Assembly Speaker Dato' Mohd Ali Hassan's claim that both Johor State Standing Order Committee and Privileges Committee will have their meetings in Grand Continental Hotel, Kuala Terengganu on April 28, and it is against parliamentary conventions to do so. 

As was reported in the Nanyang Siang Pau Johor Edition on 22 April, Dato' Ali Hassan accused me of stirring up an unnecessary issue as he has the ultimate power to decided where the meeting should be held.

Nonetheless, any Speaker's decision must be in line with parliamentary conventions and constitutional spirit. 
I would like to stress that the Commonwealth Parliamentary Practice and Conventions must be observed by the Johor State Assembly and more considerations should be given for its lawmakers' to speak out.

It is not in line with the Commonwealth Parliamentary Practice for the Johor State Assembly to have its proceedings outside its precinct including its select committees especially outside the boundaries of Johor State itself.

And it is improper to have Johor State Assembly's Privileges Committee and Standing Order Committee to have their proceedings in Kuala Terengganu, the capital city of another state as Johor State Government is not a Government-in-exile. 

The move to have Johor Select Committees meeting in another state could be interpreted as a self-inflicting insult to the Johor State's sovereignty. The Johor Speaker Dato' Mohd Ali Hassan is urged to give explanation on why the Johor State Assembly fails to observe the said parliamentary convention. 

I also urge Johor State Speaker Dato' Mohd Ali Hassan to review his decision to call meeting of both committees in Kuala Terengganu. As far as the sovereignty of the Johor State is concerned, these meetings should be held within the precinct of Johor State Assembly and within the boundaries of the Johor state itself.

Furthermore, it is inappropriate to held meetings in Kuala Terengganu, another state's territory, to curb freedoms of Johor lawmakers to enquire and debate about Johor State Government policies and development in the state itself.

Among the amendments to be made in the upcoming Standing Orders is relieving the State Government in answering unanswered oral questions whereas previously all unanswered oral questions must be given written answers. 

In the current situation, only 10% of oral questions are answered during the State Assembly sittings. If the new ruling is put in force, that means 90% of oral questions would be struck out by the ruling itself. That leaves Johor lawmakers very little space to check on State Government's implementation of policies and their excesses.

Apparently, Johor will be the first legislative in the country to make such amendment in its Standing Orders to relieve the Executive from answering lawmakers' questions. By doing so it proves that the Johor Barisan Nasional Government has become more and more autocratic by refusing to hear people's voices.

Other autocratic amendments include cutting the number of backbenchers in delivering adjournment speech from 5 to 3 per session. 

And previously the opposition members were already barred from delivering adjournment speech. After the amendment being made, adjournment speeches will be only allowed 2 out of 4 sittings per year while previously all 4 sittings were allowed for backbenchers to give adjournment speeches.

I would like to emphasize that the adjournment speech is an important process for both Barisan Nasional Backbenchers and the opposition members to check on any possible abuses by the Executive branch of the government.

I would like to condemn all the new amendments proposed as autocratic which also show Barisan Nasional's lack of confidence in its own Government by subjecting it to the due process of checks and balances through scrutiny by the legislative.

All these amendments mark the deepening of the dark ages in Johor democracy. They shall be opposed by all conscientious Johoreans and Malaysians. 

柔佛州在野党领袖巫程豪于2012年4月26日发表文告,针对柔佛州议会议长拿督阿里哈山,于4月22日南洋商报报道中,指责巫程豪之前挑起不必要的课题,指柔佛州议会的两个特选委员会:特权委员会和议会常规委员会,计划在本月28日假瓜拉丁加奴开会,违反议会惯例。

巫程豪强调说,议长虽然最后决定权决定议会的事项,当任何决定必须符合议会常规和宪法精神,而议员在议会内和议会属下任何委员会的发言权,必须受到尊重。

柔佛州州议会在议会范围以外,以及其特选委员会在柔佛州范围以外召开会议,已经不符合英联邦国会议会常规,更何况柔佛州议会属下的特权委员会以及议会常规委员会,在老远的他州首府开会,犹如是流亡政府,有辱柔佛州的主权,因此,州议长必须向柔佛的子民解析,为什么议长没有遵守有关议会和宪法惯例。

巫程豪呼吁柔佛州议长拿督阿里哈山检讨在他州召开柔佛州特权委员会以及议会常规委员会的决定,以示尊重柔佛州的主权。在丁州改写议会常规,来钳制人民代议士在议会中表达民生的问政权益,包庇州政府不回答议员问政的问题。

其中修改的议会常规包括任何口头问题在议会中,没有回答者,将自动报销,州政府将不必回答。巫程豪说,在一般议会中,仅有10% 口头问题得以口头回答,那意味着在议会常规修改后,90%议员的问题将不受理会,这违法了议会民主,走向更专制的政府。

之前,每次议会休会时,有5名议员么以发表每人10分钟的休会演辞,而在野党议员之前已经被杜绝发表休会演辞,但该议会常规委员会却建议修改常规,规定每期休会演辞仅限3名州议员,并限制仅有每年度议会开幕和提呈财政预算案时,一年两度议会时才有休会演辞。

巫程豪形容修改有关议会常规专制,侵蚀柔佛州议会民主,也在马来西亚第一个立法议会设下违反民主的做法。在议会中发表休会演辞是向州政府问政的重要一环,国阵政府百般限制议员发言,进一步问政,证明柔佛州国阵政府对自己的施政缺乏信心,而柔佛州议会民主将随着议会常规'进一步限制议员问政,进入黑暗时代,巫程豪谨此呼吁具有良知的柔佛州子民关注此事。
