Background Facts of the Matter

By an Agreement dated 8-3-2014 between the State Government of the one part and Standard Parade Development Sdn Bhd (SPD) of the other part, the State Government agrees to sell 267.15 acres of State Land opposite MJC New Township, Jalna Baru Kawa, Kuching (Lots 128, 5489, 5490, 5491, 2301, 2304 and 5279 all of Block 225 Kuching North Land District) (hereinafter called "the Said Land") to SPD at the price of RM115 million.

At such price, it is only RM430,000 per acre, when the market price of land in the vicinity is approximately RM2,000,000 per acre.

Other salient facts of the said Agreement are as follows:

The price of RM115 million will be paid by SPD in kind, with 2 orphanage building in Lawas and Mukah and 1 SABATI building at Jalan Bako.
Upon SPD signing the Building Agreement for the 2 orphanage buildings and commence construction for the SABATI Building, the State Government shall, within 21 days, issue title of document to the Said Land to SPD.

Basically, SPD needs only to incur a minimal sum of less than RM500,000, and it can get the title to the 267.15 acres of land worth at least RM500,000,000.

After I exposed this shoddy land transaction, Adenan Satem (the new Sarawak Chief Minister), in the April 2015 DUN sitting, openly challenged me in Dewan Undangan Negeri to look for a purchaser who is willing to pay RM550 million or more for the Said Land and that he promised he will then cancel the Agreement with SPD.

PURCHASER A to buy the Said Land at the price of RM620 million

So far, there are 3 purchasers who have indicated their willingness to buy the Said Land at more than RM550 million. Their conditions are that the State Government must first approve their proposed development plan. Otherwise, they are fearful that the State Government may later makes things difficult and impose ridiculous terms to frustrate their proposed development of the Said Land.

Today, I have in hand from the first of the 3 purchasers (whom I will refer to as "Purchaser A") the proposed development plan and offer to the State Government.

The proposal by Purchaser A to the State Government are as follows:

The Purchaser A will perform all the obligations on the part of Standard Parade Development Sdn Bhd (SPD) to perform under the Agreement dated 8-3-2014 between the Government of the State of Sarawak of the one part and SPD of the other part.

IN ADDITION

The Purchaser A will pay to the State Government, 10% of the proceeds of sale of the property (including condominiums, apartments, shoplots, shopping centres, hotels) built in accordance with the Proposed Plan attached herewith together with the List of Property to be Built Thereon. The total estimated proceed of sales based on the current market price is approximately RM4.9 billion.

Therefore, the State Government will get an estimated minimum RM490 million (10% of RM4.9 billion) in cash payment upon completion and sale of the property. If the property prices increases over the years, the Government will receive more from the agreed 10% proceeds of sales.

The Purchaser A will, at its own costs and expenses, build ONE primary school and ONE secondary school for the Government. The estimated value of the two schools is approximately RM15,000,000.

The Proposed Development Plan referred to in Item 2 above includes the building and completion of the followings:

4-Storey Shopping Complex (with 2 blocks of 18 storey Hotel & Condominium)

Estimated sale price of RM830,000,000

2 Blocks of 18-storey Office/Soho Tower (Total area of 270,000 sq. metre)

Estimated sale price of RM1,350,000,000

600 units of 4-storey Shophouses

Estimated sale price of RM720,000,000

12 Blocks of 12-18 storeys Condominium

(900 units with average selling price of RM500,000 per unti)

Estimated sale price of RM450,000,000

29 Blocks of 18-storey Apartments

(4000 units with average selling price of RM350,000 per unti)

Estimated sale price of RM1,400,000,000

227 units of 2-3 storeys Terrace and Semi-detached Houses

Estimated sale price of RM150,000,000

Comparison of Benefits to the State Government

The following is a table of comparison of the benefits to the State Government from selling the Said Land to SPD on the one hand and selling the Said Land to Purchaser A on the other hand:

By the proposal of this Purchaser A alone, the State Government will derive a benefits which is almost 5 times that offered by SPD, or an extra RM505 million more than what SPD is offering the State Government.

Therefore, no sensible Government will reject such offer by Purchaser A, unless there is something hanky-panky going on between the BN leaders and SPD.

Adenan Urged to Walk the Talk

Since Adenan became the Chief Minister of Sarawak, he has been talking about good governance.

Sadly, this Agreement was signed by the State Government 9 days after he became the Chief Minister. Therefore, he cannot disclaim any responsibility for the impropriety of such agreement.

The fact that the Said Land was sold to SPD at RM115 million and now there is a company who is willing to pay RM620 million for the Said Land is clear evidence of impropriety and smacks of some element of corruption in the dealing with SPD.

If Adenan is really sincere about "Good Governance", he must cancel the Agreement for the sale of the Said Land to SPD, otherwise, his talk about "Good Governance" is mere lip service and no action.

The fact that Adenan has openly challenged to me in Sarawak DUN to find a purchaser who is willing to pay more than RM550 million for the Said Land means that Adenan has the power to cancel the Agreement with SPD.

Now that I have found a purchaser who is willing to offer RM620 million, will Adenan eat his words, or will he honour his pledge.

TWO MORE PROPOSALS COMING

I will forward the proposal and my letter to Adenan on Monday (8-6-2015).

I have also informed Adenan in my letter that there are 2 more proposals coming from other prospective purchasers and such proposals will be given to me in about 2 weeks' time. I will upon receipt thereof, forward the same to Adenan in due course.

As this matter concerns hundreds of million Ringgit of public money, there should be no urgency for the Government to make any decision EXCEPT to immediately terminate the Agreement with SPD who has taken the Government and the people of Sarawak for a ride.

促阿德南，取消前朝政府贱卖政府地政策

（古晋7日讯）民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁今日透露，第一位要买MJC对面267.15英亩政府地的买家所开出的条件，将可让砂州政府收益6亿2000万令吉。

张健仁指出，相比州政府以1以1500万令吉的廉价售卖这一大片政府地给国阵朋党Standard Parade Development有限公司，接触张氏的第一位买家所开出的条件，砂州政府将可得到总值6亿2000万令吉的现金和产业，比SPD有限公司所给予州政府的，多出5亿500万令吉。

事关，砂州政府于2014年3月8日，与Standard Parade Development 有限公司签署一份卖地合约，将座落在古晋石角路MJC商业中心对面的一片267.15英亩的政府地，以超便宜的价格，出售给这家SPD有限公司。整片267.15英亩的黄金地段，政府只以区区的1亿1500万令吉出售给这家SPD有限公司，即，平均每英亩售价只是43万令吉，虽然那里的地段市价是介于一英亩约200万令吉。

即使售价已如此的便宜，但，根据这份不公平合约内的条文，这家SPD有限公司也不需要还这1亿1500万令吉现金。它是以物物交换的方式偿还这1亿1500万令吉，即，该SPD有限公司将在沐胶和老越建两间孤儿院和在Bako路建一所"部长夫人俱乐部大厦"。

"更甚的是，只要SPD有限公司正式签署建这两间孤儿院的合约，及对于那座部长夫人俱乐部大厦开始动工，砂州政府就要在21天之内，发出这267.15英亩的地契给这家SPD有限公司。"

"基本上，这家SPD有限公司不需花费超过50万令吉的钱，就可得到价值超过5亿令吉的土地了。"

因为张健仁暴露了砂国阵政府这份不公平合约给朋党自肥，砂州首长阿德南于今年4月的州议会，公开挑战张健仁若可找到买家愿意付还州政府5亿5000万令吉，砂州政府将取消与SPD有限公司签署的合约，并将这片地转让给这新的买家。

张健仁今日在记者会上公布第一位买家所提出的价格和建议，并表示将于明日致函给首席部长，并附上该份发展图和建议书。

他透露，第一位买家所提出的条件如下：

1. 完全按照砂州政府和SPD有限公司所签署的合约，替砂州政承建两间孤儿院和一间"部长夫人俱乐部大厦"。

2. 除此之外，这第一位买家也将付给砂州政府，其在这片土地上所建筑的所有产业所卖出的售价的10%。根据目前产业市价的估计，以及这第一位买家所建议的发展图，这片267.15英亩的地段，可发展至总价值约49亿令吉的房屋、商店、公寓和租屋。 49亿令吉的10%既是4亿9000万令吉。这也意味着，砂州政府可多收4亿9000万令吉的钱。

3. 另外，这第一位买家再替州政府建一间小学和一间中学，总价值约1500万令吉。

张氏指出，若拿这第一位买家所给予砂州政府的条件和SPD有限公司所给予砂州政府的条件做个比较，简直就是天渊之别：

	· 付还给州政府整个发展计划所卖出的房产店屋等售价的10%。以目前市价的估计，总发展价值是约49亿令吉，则砂州政府可得到4亿9000万令吉。
	· 一间设备齐全的小学和一间中学，总价值1500万令吉。

张健仁表示，除了致函给首席部长之外，他也将随函附上该第一买家所绘的发展图和所建议建的房屋、商店、公寓和租屋，即：

1. 4层楼的商业购物中心及两栋18层楼的酒店和高级公寓

· 预计售价是8亿3000万令吉

2. 2 栋18层楼的办公楼大厦（总面积是27万平方米）

· 预计售价是13亿5000万令吉

3. 600间4层楼的店屋

· 预计售价是7亿2000万令吉

4. 12栋12-18 层楼的公寓（约900个单位，每单位售价50万令吉）

· 预计售价是4亿5000万令吉

5. 29 栋18层楼的租屋（约4000个单位，每单位售价35万令吉）

· 预计售价是14亿令吉

6. 227间排屋和半独立房屋

· 预计售价1亿5000万令吉

"这些预计售价是根据目前那一带产业的售价行情所做出的预算。其总数是49亿令吉，10%既是4亿9000万令吉。因此政府将可额外多收4亿9000万令吉。况且，古晋房地产的价格只有涨没有跌，相信到时价格还会提高一些。若价格提高，则这第一买家所将还给政府的10%售价的钱，也会相应的提高。"

张氏表示，现在他已成功找到第一个买家，并可让砂州政府受益6亿2000万令吉（比SPD有限公司所给予砂州政府的1亿1500万令吉，多出将近5倍）。大前提是，砂州政府需原则上批准这第一位买家所提呈的发展计划。

"如果阿德南有诚心要施廉政，他没有理由拒绝眼前这个可令砂州政府受益6亿2000万令吉的建议，而选择平白无故的把整片267.15英亩的政府地，以1亿1500万令吉的贱价，卖给国阵朋党SPD有限公司。"

阿德南有权力取消SPD有限公司的合约

张健仁也在信中指出，既然阿德南敢在州议会公开挑战张氏找买家并表示只要张氏可找到买家出价5亿5000万令吉，他将取消砂州政府和SPD有限公司所签署的那份合约，这挑战很明显的说明，砂州政府是有权力取消那份不公平合约的。问题在于，阿德南是否愿意取消该份合约，还是选择继续前朝政府贱卖政府地的政策。

张氏也指出，这份不公平合约是于2014年3月8日签署的，也既是阿德南成为首席部长9天后所签署的。因此，阿德南不能推卸这"贱卖政府地"的罪行。

张氏敦促阿德南，基于砂州人民的利益，运用其首席部长的权力，取消该份合约。

他也说，政府也没必要急于一时的批准该片土地给予张氏所提呈的第一位买家，因为，还有两位买家也正在绘图及计算发展价值。他们将会在多一、两个星期后，提呈他们的计划书。

"这第一买家所提出的计划，最保守估计，砂州政府将多收4亿9000万令吉的现金。这笔钱若好好利用，可造福许多砂州子民，包括在全古晋提供免费公共巴士服务还绰绰有余。更何况，该计划中还包括4000个单位的中价租屋（35万令吉），是许多中下阶级的上班族有能力购买的范围之内。而且，多了这4000单位的中价租屋，也可有效的减缓房地产不断涨价的趋势。"

The problem of deforestation in Sarawak is not due to illegal logging but the excessive logging concessions issued to the Big 6.

The following is the gist of the answer that I obtained from the Government in Sarawak DUN sitting in April.

I have asked for the list of all the timber licences and the respective acreage covered thereunder that are held by the big 6 logging companies in Sarawak, namely WTK Holdings Sdn Bhd, KTS Holdings Sdn Bhd, Rimbunan Hijau, Ta Ann, Samling and Shin Yang groups and their subsidiaries or related companies.

The answers are as follows:
1. Ta Ann Group of Companies -- 433,003 Ha. / 1,069,935 acre
2. RH Group of Companies -- 1,001,877 Ha. / 2,475,604 acre
3. Shin Yang Group of Companies -- 500,904 Ha. / 1,237,716 acre
4. Samling Group of Companies -- 1,288,389 Ha. / 3,183,565 acre
5. KTS Group of Companies -- 144,485 Ha. / 357,017 acre
6. WTK Group of Companies -- 357,017 Ha. / 882,176 acre

In total, the Big 6 holds 3,724,675 Hectares (or 9,203,545 acres) of timber concession.

Sarawak's total land mass is 12.4 million hectares, out of which there are 10 million hectares of forest. Out of the 10 million hectares of forest, 1 million hectares of totally protected areas and 4 million hectares reserved for agriculture and other uses (including oil palm plantation).

There is thus left with about 5 million hectares of forest for timber production. Of these 5 million hectares of forest for timber production, 70% is already given to the Big 6.

It is thus no wonder that in the year of 2013, out of the RM7.16 billion of export earnings of timber and timber products from Sarawak, 75% is contributed by the Big 6, while in the year of 2014, out of the RM7.25 billion of export earnings of timber and timber products from Sarawak, 76% is contributed by the Big 6.

Given the huge 3.7 million hectares of legitimate timber concession areas controlled by the Big 6, where the Big 6 can legally chop down trees and destroy the natural forest, the illegal logging referred to by Adenan Satem is just a drop in the oceans.

As such, if the State government truly wishes to stop deforestation in Sarawak, the State government should review and reduce these timber concession licences issued.

On a second note, this information reveals that there is an over-concentration of the timber resources in the Big 6. Such concentration of natural resources in a few companies is not good for the economic development of the general ordinary Sarawakians.

This also shows that the actual problem with the Sarawak's economy is not that we have insufficient resources, but the inequitable distribution of these resources.

呼吁联邦政府和砂州政府重新检讨砂州参组马来西亚合约条文及联邦宪法

（古晋26日讯）古晋市国会议员兼哥打圣淘沙州议员张健仁呼吁联邦政府和砂州政府重新检讨砂州参组马来西亚合约条文及联邦宪法第九附录有关联邦和州的权限事项，以归还教育、医药、警察事务和税务自主权给砂州。

张健仁是于昨夜在国会下议院参与《第11大马计划》辩论时，做出如是呼吁。

张氏说，近年国家局势的发展，如1马发展公司丑闻、种族关系日逾恶劣、国家领袖诚信问题、教育水平的日益下降，已令许多砂州人民对联邦国阵政府的政策和领导失去信心。更何况，今日的联邦制度所制定的政策，往往不适合砂州情况。

张健仁也在辩论中提出，行动党建议，为了砂州人民的利益，教育、医药和警察事务应由砂州政府自己接管。要真正拥有这3领域的自主权，50%所有在砂州收收到的税收及20%石油天然气开采税，应归还给砂州政府，以便可以资付这3个领域的开支，包括教师的薪金、建学校、医务人员的薪金、医院及警务人员的薪金等。

由于辩论时间的限制，张氏针对这4领域的砂州自主权的课题，昨夜只大略的提出一项课题，即，中学教学的课程。

张健仁指出，由联邦教育部所编写的教学课程，完全忽略砂州的历史、经济、人文的发展。

他举例，教会学校对砂州发展的贡献是非常大的。目前砂州内阁部长，全部都是来时教会学校，但是，历史课里面，完全没有提到教会学校对砂州的贡献。这种教科书，根本就不适合砂州子弟就读。

"州政府应该有教育自主权来编写砂州中小学的课程。在砂州教导的历史课程，应该注重砂州的社会、经济历史和人文的发展，以加强新一代，各个不同种族、宗教和文化人民之间的互相尊重精神。"

张氏也说，各族互重的精神，在西马就是极致缺乏，教育课程是导致这种种族紧张关系现象的主要原因之一。砂州若要避免这种文化渗透砂州，那砂州政府就应该拿回教育自主权，由砂州政府自己编写砂州中小学的历史课程，加强砂州经济、历史、人文发展的元素。

"唯有由我们自己编写中小学课程，这才能真正捍卫砂州各族融洽生活的状况，不会被巫统政策，透过中小学教科书，所影响而变质。"

砂国阵应退出联邦，有效为砂民争取权益

（古晋26日讯）砂国阵应退出联邦国阵，以便能更有效的为砂州人民争取权益。

古晋会议员兼哥打圣淘沙州议员张健仁昨日在国会下议院参与《第11大马计划》辩论时表示，砂州国阵应该退出联邦国阵，不然的话，国阵歧视砂州的政策还是会没完没了的持续下去。

张氏说，《第11大马计划》，和过去的10个大马计划一样，虽然首相提呈时都讲得天花乱坠，但最终，砂州的发展，和西马比较，差距越来越大。国阵这种歧视或忽视砂州的心态和政策，经过50年，10个《大马计划》，至今都还是没有改。

他指出，目前国阵在国会下议院有134位国会议员，包括25位砂州的国阵国会议员。如果这25位砂州的国会议员退出国阵，西马国阵和沙巴国阵的国会议员加起来只有109位。在现今国会议席只有222席的情况下，109位国会议员的国阵只能够做一个少数政府，连要通过《第11大马计划》都成问题，需要砂州议员们的支持。

"砂州国阵只需退出联邦国阵就好，也不需要加入民联。它可以自立为一个独立的阵线，在某些课题上选择支持国阵的政策与否。这才能真正发挥'造王者'的优势。"

张健仁表示，若砂国阵退出联邦国阵的话，砂州政府就不需要如此每年低声下气的向联邦政府乞求拨款，到时，反而是联邦国阵倒转过来要求砂州政府支持他们所提出的财政预算案。

张氏说，若砂国阵退出国阵，不只每年的财政预算案联邦政府都必须得到砂国会议员们的同意和通过，就连砂州政府要取回教育、医药、警察事务和税务的自主权，都有很大的成功机会。

他也说，抛开各别政党的区别，纯粹以砂州人民的利益为出发点，砂国阵退出联邦国阵对砂州人民百害而无一利。这样，国阵的大哥巫统才不会继续鄙视或忽视砂州人民的权益。

在反驳哥打三马拉汉国会议员打岔表态支持联邦国阵时，张健仁称，这问题他会直接和砂州首席部长阿德南商讨，这事也由不得在场的砂国阵国会后座议员决定的。

Unfreeze the Accounts, Go for the Ministers

The freezing of the bank accounts of more than 500 companies by the MACC is merely a drama played up by the MACC in its desperate attempt to redeem its dented image. It is merely trying to sensationalise the whole episode of "war against corruption in logging industry".

Such tactic of "freezing all accounts first then investigate" is not only against the basic due process of the law but it will not give any added assistance to the MACC in the investigation of any case of corruption.

DAP supports all anti-corruption action, but this is not the way to do it. This is merely dramatizing the whole exercise without having any added impact on the true culprits. Worst of all, innocent traders and companies are victimized along the way.

Is such tactic deployed at the MACC's own accord or is the MACC receiving instruction from the State Government?

With the accounts of 500 companies frozen, how many investigating officers is required to be deployed to carry out the investigation and how long will the investigation last. Does the MACC have enough investigating officers to do the job within two weeks or one month?

To thoroughly investigate a company's account, the MACC needs at least 3 – 5 officers full-time investigating the company for at least 2 – 3 weeks, more complicated cases will need more officers and time. How many investigating officers have the MACC deployed to investigate these 500 companies, bearing in mind that these officers must at least have some basic accounting knowledge.

In fact, there is no necessity to freeze the accounts of the companies for the purpose of investigation. All money transactions of the accounts are in the record of the banks. With or without freezing the accounts, the records will remain there for investigation by the MACC.

The only valid and acceptable reason for freezing a company's account is when there is already sufficient evidence to prosecute the company in Court for corruption. It is only then that the MACC has valid grounds to freeze the account of the company in question.

What the MACC is doing now is just casting a big net and hope to get something out of it. This is clearly an abuse of its power under the law and this will cause unnecessary hardship not only to the companies, but all the employees, contractors and suppliers of these companies and their family members. Ultimately, it will put Sarawak's economy in jeopardy.

Just because the Chief Minister of Sarawak, Adenan is now declaring was on illegal logging and corruption in logging industry, therefore the MACC carry out the blanket order to freeze the accounts of almost all those involved in the industry. This is "persecution", not "fighting corruption".

If tomorrow Adenan were to declare war on corruption in the property development industry, will the MACC then freeze the accounts of all the developers? Who will be next? Legal firms, accounting firms, hardware stores, common traders? It smacks of tyranny where rule by man prevails over the rule by law.

As such, I call upon the MACC to unfreeze all the accounts of the companies which at present the MACC has no sufficient evidence to prosecute in Court. This drama should be stopped. The due process of the law must be put in practice.

I further call upon the MACC that if it is serious about fighting corruption, the targets should be on:

1. the Ministers and Assistant Ministers who have assets or money in bank accounts beyond their means. They are the ones who are not supposed to have other sources of income apart from there ministerial allowances;

2. the immediate family members of the Ministers and Assistant Ministers and their companies, whereby government contracts were awarded without open tender and land alienated at far below the market values;

3. high-ranking government officers who has the power to approve contracts and alienation of state land and whose assets and bank accounts are beyond the means of their salaries.

张健仁今日文告中指出，反贪污委员会今次如此的大动作，根本就是在"演戏"。如此大阵仗一次过冻结500多间公司的户口，只是在戏剧化打贪行动，对调查贪污案件没有多大的实际帮助。更甚的是，它已违反了正常的法律程序，使许多无辜的公司也因此殃及池鱼。

张健仁质问，反贪污委员会如此的一次过冻结500多家公司的户口，到底是反贪污委员会本身的决定，还是受到州政府的指示。

他也质问，如今500多家公司的户口被冻结，反贪污委员会有多少位查案官对这500多间公司进行调查？整个调查行动要进行多久？

"若要真正详细调查一间普通公司的银行账目来往，最少都要3 -5位调查官，调查2 – 3个星期，而且这些查案官必须拥有查阅公司账簿的基本知识。如今，有500多家公司的银行户口被冻结，反贪污委员会到底调动了多少查案官？"

张健仁说，如果反贪污委员会要认真调查一间公司的银行户口来往账，它根本就不需要冻结其户口。这些账目的记录全部都有在银行的电脑档案里，按几个键就能得到全部的记录，之后针对那些有疑问的来往项目再深入调查。这才是真正的调查贪污。又何必如此大动作的冻结500多家公司的户口。

张健仁指出，如今冻结了500多家公司的户口，反贪污委员会根本就没有足够的调查官能够在2星期或1个月之内完成全部调查。最后的结果不是使到这些公司因周转不灵而倒闭，就是反贪污委员会敷衍了事。

张氏敦促反贪污委员会认真调查贪污，不要只是为了哗众取宠，或取悦阿德南而演戏，使许多无辜的公司受冤枉。

"过去反贪污委员会一直强调说，抓贪污要低调调查，才能抓到真正的贪污者。那为何如今却如此高调，甚至不分青红皂白的'先冻结，后调查'？"

因此，张健仁呼吁反贪污委员会立刻解冻这500多家公司的户口，除非是那些反贪污委员会已经掌握足够证据提控上庭的。

张氏严厉警告，反贪污委员会的这种行动，不只是对那些被冤枉的公司经理董事股东不公平，遭受无妄之灾的人士也包括这些公司的职员、他们家属、这些公司的承包商和供应商。影响范围的广泛，最终也将打击砂州的整体经济。

张氏也指出，今天阿德南说要打击非法伐木和涉及伐木业的贪污，反贪污委员会就如此不分青红皂白的冻结大部分涉及伐木的公司。那如果明天阿德南要打击发展业的贪污，反贪污委员会是否也将冻结全部发展商的银行户口？接下来又是谁？银行业（因为大部分钱都是经过银行转账）？律师馆？会计师公司？五金业？甚至普通商家？

"这种作风不是打击贪污，而是'迫害'民众。马来西亚是一个法治的国家，不是人治的国家。不是因为一个领袖的喜怒和决定，整个执法机构就会不分青红皂白的乱抓人。应该是有足够的证据了才抓人。"

张氏表示，如果反贪污委员会真的有决心打击贪污，反贪污委员会应该是针对以下3组人展开调查：
1. 那些财产和银行户口的存款，远远超越他们薪金的部长和助理部长，因为他们除了部长和助理部长的收入，不应该有其他的收入了。
2. 那些在没有公开招标的程序下得到政府工程和政府地的部长和助理部长的直系亲属。
3. 那些财产和银行户口的存款，远远超越他们薪金的政府部门高官。
