KUALA LUMPUR, Aug 10 — With some RM91 billion slashed from the stock market since last Monday (over eight days), Datuk Seri Najib Razak faces yet another global financial meltdown ahead of general elections — due in less than two years.

Although the prime minister was said to be mulling snap polls as early as the end of the year, politicians and analysts say that economic factors are now firmly out of his hands, with him hanging on to his Economic Transformation Programme (ETP) projects only for a rebound next year.

"These projects are his only defence against the storm clouds on the horizon," said Jupiter Securities research head Pong Teng Siew, stating that Najib (picture) will only go to the ballot boxes after the ETP bites.

But DAP's Tony Pua, one of the opposition's top economic spokespersons, said that Najib is "hamstrung" as he heads into the pre-election period.

"In the last two years, he has been able to rely on high oil prices to bankroll public spending but that is not going to happen this time as the global slowdown will hit oil prices and our exports.

"This is Najib's worst nightmare. The perfect storm is brewing and he can only hope to wait it out," the Petaling Jaya Utara MP said.

Chinatown businesses suspicious over MRT acquisition

KUALA LUMPUR, Aug 9 — Traders and shop owners in the historic tourist enclave of Chinatown expressed outrage today over government plans to acquire properties in the area, and are bracing themselves for the destruction of heritage buildings to make way for the Klang Valley MRT (KVMRT) project.

To date, 34 units have been served compulsory acquisition notices to make way for the KVMRT project, which runs along Jalan Sultan and Jalan Petaling, cutting through the arch that bears the name "Petaling Street" in three languages.

"That means they are trying to chak jiu pai (shut down our business) and cheong ngo dei ge fan woon (steal our livelihood)," said Daniel Wong, a trader who owns multiple properties in the area, during the first meeting with the traders last week. "How can we just stand by and watch?"

Bukit Bintang MP Fong Kui Lun met with the traders today at the Lok Ann Coffee Shop, located in a building which will be acquired as well, and encouraged them to step up their protests and be vocal about their dissatisfaction over the acquisitions.

"Chinatown has witnessed the development of KL. It's been around for a hundred years," he said, adding that it was not right for the government to just take their businesses and properties from them. "All we can do now is protest against it."

Petaling Jaya Utara MP Tony Pua, who was also present to speak with the traders, told The Malaysian Insider that there was no reason for the government to acquire the land specifically for the MRT project.

"The MRT station is actually located a block away, so these shops are actually not above the MRT station itself. They are above the tunnel track but because the tunnel is actually 100 feet below ground, there is no reason for the government to acquire these particular shop lots. So the only reason why they would want to acquire these shop lots is so that they can profit from the appreciation resulting from the construction of the MRT system.

"We disagree with this kind of mechanism for the simple reason that when the government builds infrastructure, it's meant to benefit the people in and around the area. You cannot, just because you build the infrastructure, claim that all the profits have to go to the government," he said.

KUALA LUMPUR, Aug 8 — The DAP has accused the authorities of sweeping under the rug the firing of tear gas and water cannons into the Tung Shin hospital compound during the July 9 Bersih rally.

Although Health Minister Datuk Seri Liow Tiong Lai had ordered a "high-level" ministry probe into the incident, publicity chief Tony Pua (picture) said he was informed by the Health Ministry on August 5 that it was now "joining the police in building an investigation report that will be held soon."

"The minister initially delegated his responsibility to his secretary-general. Now the whole ministry is delegating to the police.

"After more than a month since Bersih, all the police have done is release some heavily-edited video clips to show how nice they were. The Health Ministry has got no courage to declare the truth," the Petaling Jaya Utara MP said.

Party international secretary Liew Chin Tong also accused the police of "trying to rewrite history with its own version of what happened."

"It is regrettable that police can still refuse to accept responsibility and admit its mistake," the Bukit Bendera MP told reporters today.

In the aftermath of the rally that saw tens of thousands dispersed by police with tear gas and water cannons, Liow ordered the probe on July 14 after a group of medical consultants had written to the media refuting the hospital board and police who claimed that no gas canisters or water cannons were fired directly into the hospital.

The MCA deputy president had initially agreed with the hospital but then ordered the probe, stating that patient security and hospital safety were paramount.

Pua, Liew, Serdang MP Teo Nie Ching and Zairil Khir Johari, the political secretary to the DAP's secretary general, had offered themselves as witnesses to the Health Ministry, which Liow had accepted and forwarded to the committee.

But Pua said he received a call from Bukit Aman on August 5, asking him to record his statement on the Tung Shin incident and to "bring along the other three."

On the same day, the Health Ministry wrote to him asking him to co-operate in the "inquiry and investigation," which the letter said was now being done with the police.

Police had absolved themselves of any wrongdoing during the July 9 rally after setting up six internal teams to investigate claims of police brutality that followed after nearly 1,700 were arrested, scores injured and an ex-solider died during chaotic scenes in the capital.

However, they admitted on July 21 that Tung Shin was hit with tear gas canisters and water cannons during the rally, but denied shooting directly into the compound.

Federal police internal security and public order director Datuk Salleh Mat Rashid said that shots were only fired "nearby" the hospital compound on July 9, and speculated that the wind caused by the rain probably caused the tear gas and water cannons to enter the hospital compound.

However this statement flies in the face of various video clips uploaded on the YouTube video-sharing site showing water cannons and tear gas fired into the hospital.

DAP to MCA: Contracts given on merit, not race

KUALA LUMPUR, July 30 — DAP rapped MCA today for accusing the Penang government of sidelining the Chinese community in the award of contracts, stressing that the state administration's criteria was strictly merit-based.

In a strongly-worded reply, DAP national publicity secretary Tony Pua charged that Barisan Nasional (BN) parties like MCA were stuck with "archaic" policies where they were only interested in attracting votes from the "respective races" they claimed to represent.

"They fail to recognise their own chauvinism and their total disconnect from ordinary citizens today who are increasingly seeing themselves as Malaysians first," he told The Malaysian Insider today.

MCA had accused Penang Chief Minister and DAP secretary-general Lim Guan Eng of awarding all of the state's Drainage and Irrigation Department (DID) contracts to Malays, Bumiputeras and Indian Muslims, leaving the Chinese community out in the cold.

Penang Wanita MCA chairman Tan Cheng Liang claimed yesterday this was likely because the chief minister was "currying favour" with the non-Chinese community as, according to her, the DAP has realised that it could not rely on support from the Chinese forever.

Tan was referring to a statement Lim purportedly made on Wednesday that the contractors in all five districts in Penang for DID contracts are Malays, Bumiputeras and Indian Muslims, with women accounting for 20 per cent.

In response, Pua today said DAP and Pakatan Rakyat (PR)'s policies were specifically designed from a "merit and needs-based perspective."

"Unlike MCA and BN's model, we are race-blind. If one is poor, he or she will deserve assistance, regardless of race, religion or creed.

"If one is competent and cost-efficient, they will be awarded government contracts and projects irrespective of company ownership," he added.

The Petaling Jaya Utara MP said that since majority of Malaysians below the poverty line in the country were Malays, PR states would therefore ensure that they were ones mainly benefitting from financial assistance.

"Similarly, if the best contractors happen to be Bumiputera companies, there's no reason why they should be penalised just because of their skin colour.

"First Umno calls us anti-Malay. MIC says DAP ignores the plight of Indians, and now MCA says we are anti-Chinese? That doesn't make much sense, does it?" Pua asked.

The Penang administration under Lim's rule has regularly been accused by Umno, MCA's senior partner in the ruling BN coalition, of being racist for allegedly discriminating against the Malay community.

TELUK INTAN, 9 Ogos - Para ahli gerakan Islam khususnya ahli PAS mesti menjadikan penyucian jiwa atau tazkiyah an nafs sebagai rutin hidup tanpa rasa jemu dan penat. Demikian dinyatakan oleh Naib Ketua Dewan Ulama PAS Perak, Ustaz Ibrahim Zakaria semasa menyampaikan tazkirah Ramadhan di Markaz PAS Kawasan Teluk Intan. Beliau telah menyampaikan tazkirah di dalam program Ihya Ramadhan PAS Kawasan Teluk Intan.

Menurut beliau, penyucian jiwa itu sangat penting kerana tugas dan tanggungjawab dakwah dan jihad adalah sangat berat yang memerlukan jiwa yang kental untuk menghadapinya. Selain itu, tazkiyah an nafs diperlukan kerana medan dakwah itu penuh dengan mehnah dan tribulasi serta banyaknya penghalang dan perosak yang mencabar para pejuang agama kebenaran.

Dalam konteks itu, Ustaz Ibrahim telah membacakan sebuah hadis yang bermaksud "Mukmin itu berada di antara lima musuh iaitu mukmin yang mendengkinya, munafiq yang membencinya, kafir yang memeranginya, syaitan yang menyesatkannya dan nafsu yang menggelincirkannya."

Tazkiyah an nafs juga akan dapat melancarkan cita-cita pejuang Islam merebut maqam syuhada dan mardhatillah. Oleh itu, cara menyucikan diri ialah melalui bertaubat, isti'anah dan isti'azah (mohon bantuan dan pertolongan Allah), ibadah khususi, zikrullah dan aurad yaumi (wirid harian).

Turut hadir hadir di majlis tersebut ialah YDP PAS Kawasan Teluk Intan Ustaz Ismail Che Nik, ADUN Changkat Jong YB Hj. Mohd. Anuar Sudin, pimpinan PAS kawasan, pimpinan cawangan serta para ahli dan penyokong PAS.

DHPP TELUK INTAN SERTAI MAJLIS BERBUKA PUASA

TELUK INTAN, 9 Ogos - Sesuai dengan status sebagai sayap PAS, Dewan Himpunan Penyokong PAS (DHPP) Teluk Intan telah menghadiri majlis berbuka puasa PAS Kawasan Teluk Intan. Majlis telah diadakan di Markaz PAS Kawasan, Kg. Padang Tembak dekat sini.
Sdr. Hacharan bersama AJKnya menikmati juadah berbuka puasa.
YDP PAS kawasan Ustaz Ismail meraikan kehadiran AJK DHPP.
Seramai sembilan orang AJK DHPP telah hadir  ke majlis tersebut dengan diketuai oleh Sdr. Hacharan Singh selaku Ketua DHPP Teluk Intan. Turut hadir sama ialah Sdr. Sarguna, Timbalan Ketua DHPP. Mereka duduk bersila menikmati juadah bersama-sama pimpinan PAS kawasan.

Menurut Sdr. Hacharan Singh, antara tujuan kehadiran mereka ke majlis tersebut adalah untuk mengukuhkan tali persaudaraan antara pimpinan PAS kawasan dan DHPP. Selain itu, beliau berharap AJK DHPP yang lain dapat membiasakan diri mereka dengan markaz PAS serta mengenali PAS dengan lebih mendalam.

Menurut laporan The Star bertarikh 26 Julai 2011, syarikat pemaju SP Setia Sdn Bhd bersedia mengambil alih 40 peratus baki saham KL Eco City Sdn Bhd (KLEC) dari Yayasan Gerakbakti Kebangsaan yang dinilaikan sebanyak RM75 juta. Adalah difahamkan Yayasan Gerakbakti Kebangsaan merupakan satu entiti yang dipandu Pemuda Umno dan dipengerusikan Ketua Pemuda Umno.

Cadangan SP Setia ini menimbulkan pelbagai tandatanya, yang mana pihak SP Setia dan Yayasan Gerakbakti Kebangsaan harus menjawab dengan telus dan jujur persoalan-persoalan berikut:

1. Mengapa cadangan pengambilalihan ini baru timbul sekarang walhal usahasama  atau joint venture (JV) antara SP Setia Sdn Bhd dan anak syarikat Yayasan Gerakbakti Kebangsaan, YGP Holdings Sdn Bhd, untuk projek ini telah dimeterai semenjak tahun 2000 lagi? Adakah pengambilalihan ini selari dengan hasrat yayasan untuk meningkatkan taraf hidup golongan miskin di kawasan bandar?

2. Bagaimanakah KLEC memperoleh sebidang tanah seluas 25 ekar di kawasan tanah premium berdasarkan prinsip perkongsian untung pada nisbah 80:20 dengan DBKL? Adakah ianya melalui tender terbuka atau cara lain? Apakah kriteria yang digunapakai Kerajaan dalam memilih KLEC untuk diserahkan tanah milik Kerajaan tersebut?

3. Sekiranya pengambilalihan tersebut terlaksana, ke arah mana keuntungan RM75 juta itu akan dibelanjakan? Kita harus ingat bahawa tujuan penubuhan yayasan tersebut adalah demi membasmi kemiskinan dan mempertingkat mutu kehidupan golongan bumiputera berpendapatan rendah. Maka, bagaimanakah tindakan ini akan menguntungkan golongan sasar, terutama mereka yang telah dipindahkan dari Kg Hj Abdullah Hukum? Atau adakah ini satu contoh menerima keuntungan “atas angin” bagi pihak Pemuda Umno?

Saya berharap SP Setia Sdn Bhd dan Yayasan Gerakbakti Kebangsaan akan dapat menjawab persoalan-persoalan ini, demi ketelusan proses dan kemaslahatan umum.

Misi Kemanusiaan Ke Gaza

Pada 26 Julai saya telah bertolak ke Mesir bersama sahabat dari Muslim Care dan Cakna Palestin. Destinasi akhir adalah Gaza. Surat kelulusan dari kerajaan Mesir telah diperolehi lebih awal, termasuk dari pihak "Special Branch" Mesir. Kami pergi membawa wang tunai sebanyak USD 215,000 yang merupakan kutipan dari rakyat Malaysia semenjak Israel menyerang Gaza hampir dua tahun lalu.

Pada 28 Julai kami memasuki Gaza. Duit diserahkan secara berperingkat mengikut kategori perbelanjaan serta mereka begitu bangga dan berterima kasih di atas sumbangan ini. 29 Julai kami turun bertemu Menteri Kebajikan. Terdapat banyak juga program bersama rakyat miskin diadakan.

Pada keesokan harinya, Perdana Menteri (sah) Palestin, Ismail Haniyya menjemput kami semua ke rumahnya pada sebelah malam. Beliau telah meluangkan masa untuk duduk berbincang pelbagai isu selama hampir 1 jam.

Pada 31 Julai kami dijemput pula ke Parlimen Palestine dan diberikan cenderahati peta Palestin sebagai kenangan.

Selepas 5 hari di Gaza, akhirnya pada 1 Ogos bersamaan 1 Ramadhan, kami kembali keluar menuju ke Mesir. Pada 2 Ogos kami hadir majlis berbuka Puasa dengan para pelajar Al-Azhar di Kaherah sebelum pulang ke Malaysia.

Untuk makluman semua, Ismail Haniyya sampaikan salaamnya pada rakyat Malaysia dan ucapan Ramadhan Kariim. Beliau memohon supaya kita terus mendoakan semoga perjuangan rakyat Palestin akan mencapai kemenangan. Beliau juga turut mengucapkan Jazakallahu Khairun Jazaa' di atas sumbangan yang diberi.

Perjalanan kali ini akan sentiasa dikenang oleh diri saya. Akhirnya, azam saya untuk ke bumi Gaza dan menyampaikan sumbangan termakbul juga, Alhamdulillah. Bersama ini disertakan 5 gambar untuk dikongsi bersama.

MAS-AIR Asia Share Swap Deal Raises Serious Concerns Over Effective Control And Governance

The MAS-Air Asia share swap announced yesterday raises serious concerns over the dominance of Air Asia over MAS and effectively reducing competition between the two. This may lead to a virtual monopoly of the domestic airline industry by in the long run and gives rise to risks and concerns associated with monopolies, more so because of the involvement of cronies and political power brokers.

The swap accompanied by effective participation of Tony Fernandes and his nominees in the board of MAS raises the likelihood of a conflict of interest notwithstanding his purported 'non-executive' position. This is clearly a violation of corporate governance rules and should not be condoned.

More importantly, the deal raises the question as to what is the fate of the GLC Transformation Programmes that had been launched by the Prime Minister Najib Razak with much fanfare and wastage of millions of the rakyat's money. And is the government specifically admitting that the so-called successful turnaround of MAS was a mere charade? The Prime Minister must be held accountable for misleading the rakyat on this.

This deal also raises fundamental issues of transparency because of the secrecy in which it was shrouded. In this regard, the Securities Commission must investigate the possibility of irregularities including insider trading of the shares of both entities.

Above all, I am very concerned that this deal benefits the interests of the minority at the expense of the majority, that is, the employees of MAS who have served our national carrier with selfless dedication and loyalty in spite of having been given such a raw deal and deprived of bonuses for years.

Cadangan SP Setia ini menimbulkan pelbagai tandatanya, yang mana pihak SP Setia dan Yayasan Gerakbakti Kebangsaan harus menjawab dengan telus dan jujur persoalan-persoalan berikut:

1. Mengapa cadangan pengambilalihan ini baru timbul sekarang walhal usahasama atau joint venture (JV) antara SP Setia Sdn Bhd dan anak syarikat Yayasan Gerakbakti Kebangsaan, YGP Holdings Sdn Bhd, untuk projek ini telah dimeterai semenjak tahun 2000 lagi? Adakah pengambilalihan ini selari dengan hasrat yayasan untuk meningkatkan taraf hidup golongan miskin di kawasan bandar?

2. Bagaimanakah KLEC memperoleh sebidang tanah seluas 25 ekar di kawasan tanah premium berdasarkan prinsip perkongsian untung pada nisbah 80:20 dengan DBKL? Adakah ianya melalui tender terbuka atau cara lain? Apakah kriteria yang digunapakai Kerajaan dalam memilih KLEC untuk diserahkan tanah milik Kerajaan tersebut?

3. Sekiranya pengambilalihan tersebut terlaksana, ke arah mana keuntungan RM75 juta itu akan dibelanjakan? Kita harus ingat bahawa tujuan penubuhan yayasan tersebut adalah demi membasmi kemiskinan dan mempertingkat mutu kehidupan golongan bumiputera berpendapatan rendah. Maka, bagaimanakah tindakan ini akan menguntungkan golongan sasar, terutama mereka yang telah dipindahkan dari Kg Hj Abdullah Hukum? Atau adakah ini satu contoh menerima keuntungan “atas angin” bagi pihak Pemuda Umno?

Saya berharap SP Setia Sdn Bhd dan Yayasan Gerakbakti Kebangsaan akan dapat menjawab persoalan-persoalan ini, demi ketelusan proses dan kemaslahatan umum.

Lagi ‘Pengundi Klon’ Dikesan Dalam Daftar Pemilih

Sebelum ini timbul dakwaan wujudnya ‘pengundi hantu’, kemudian penduduk tetap didaftarkan sebagai pengundi – dan sekarang lebih banyak ‘pengundi klon’ pula muncul dalam daftar pemilih.

Sekurang-kurangnya tujuh pengundi didapati telah ‘diklonkan’ dalam daftar pemilih dengan nama dan kad pengenalan lama yang sama tetapi dengan nombor Mykad berbeza.

azlanMenurut maklumat yang diperolehi daripada sistem pengesahan di lana web Suruhanjaya Pilihan Raya (SPR), nama-nama berkenaan muncul dua kali dalam daftar pemilih. Ini menimbulkan tanda tanya sama ada mereka itu layak mengundi sebanyak dua kali.

Dalam kes pertama nombor kad pengenalan lama 1479323 yang dimasukkan ke dalam sistem SPR itu menunjukkan dua kemasukan di bawah nama Sa’ad bin Samsudin tetapi dengan dua nombor Mykad yang berbeza – 380913105681 dan 510913105553.

Laman web itu juga menunjukkan lelaki berkenaan mempunyai dua hak mengundi iaitu di Parlimen Titiwangsa dan Parlimen Setiawangsa.

Kerusi Titiwangsa dimenangi oleh Allahyarham Dr Lo’ Lo’ Mohd Ghazali dari PAS, yang meninggal dunia bulan lalu.

Ketua Dewan Pemuda PAS kawasan Titiwangsa Mohamad Suhaimi Abdul Aziz berkata pihaknya mendapati empat kes yang hampir sama di kawasan itu, membabibitkan:

1. Shodah binti Abdul Rahman (IC lama: 4802777, dua kali didaftrakan di Titiwangsa)

2. Mohamad bin Ismail (IC lama: 8370614, satu didaftarkan di Titiwangsa dan satu lagi di Setiawangsa)

3. Anderson a/l P Arputhanathan (IC lama: A0831847, satu didaftarkan di Titiwangsa dan satu lagi di Setiawangsa)

4. Chellamah a/p Murugesu (IC lama: 7877951, satu didaftarkan di Titiwangsa dan satu lagi di Setiawangsa)

NONENONEBerdasarkan maklumat pembaca,Malaysiakini juga mengesan dua pengundi seumpama itu di Perak dan Terengganu.

Mohd Rashid bin Ismail (IC lama: 6397062) – mempunyai dua pendaftaran di kerusi parlimen Taiping (Mykad: 620108086991) dan kerusi bersebelahannya di parlimen Bukit Gantang (Mykad: 620108086713).

Apabila kedua-dua nombor Mykad dimasukkan dalam sistem online Jabatan Pendaftaran Negara (JPN), keputusannya menunjukkan bahawa kad pertama telah diambil manakala kad kedua sedia untuk diserahkan di pejabat JPN Kuala Lumpur.

Pengundi kedua – Sulong bin Jalil (IC lama: 6290844) – juga mempunyai dua pendaftaran di kerusi negeri Ajil di bawah parlimen Hulu Terengganu tetapi dengan dua nombor Mykad berasingan – 611110015143 and 611110115371.

1.5 Juta PATI, Bukti Kedangkalan Dasar Ekonomi BN – Rafizi Ramli

Jumlah 1,548,798 pendatang asing tanpa izin (PATI) didaftarkan di dalam negara sehingga semalam,membuktikan kedangkalan dasar ekonomi Umno-BN, kata Pengarah Strategi KEADILAN, Rafizi Ramli.

Beliau berkata, jumlah tersebut yang didaftarkan dalam masa yang singkat dijangka mencecah 3 juta orang, tidak termasuk pekerja asing yang berdaftar secara sah.

"Tidak sampai tiga bulan jumlah warga asing PATI dikesan mencecah 1.5 juta menunjukkan anggaran warga asing seramai 2 juta adalah lebih rendah dari jangkaan dan boleh mencecah tiga juta orang," ujarnya kepada Keadilandaily.com.

Daripada jumlah itu, katanya, sebanyak 30 peratus peluang pekerjaan diberikan kepada warga asing iaitu seramai kira-kira 10 juta tenaga kerja dalam negara.

Akibat dasar kerajaan yang membuka pintu seluas-luasnya kepada pekerja asing, menyebabkan kadar pengangguran di kalangan warga tempatan kian bertambah.

"Itu sebab ramai rakyat menganggur di dalam negara kerana peluang pekerjaan 3 juta tersebut telah diambil oleh warga asing," katanya yang juga Pengarah Eksekutif di Pejabat Penasihat Ekonomi Selangor.

Tambahnya, lambakan pendatang asing gagal diatasi dan kini kerajaan tampil dengan sistem pemutihan PATI, kononnya untuk mengatasi dan mengenalpasti  pendatang tanpa izin.

Bagaimanapun katanya, langkah tersebut dicurigai bertujuan untuk melakukan penipuan dalam pilihan raya umum akan datang.

"Jumlah PATI yang meningkat seolah-olah berkait rapat dengan peningkatan jumlah pengundi yang pernah dilaporkan di setiap negeri sebelum ini," katanya merujuk kenyataan Ketua Pembangkang, Datuk Seri Anwar Ibrahim yang mendakwa 200,000 warga Indonesia telah didaftarkan sebagai pengundi.

"Jelas kita lihat terdapat ada kaitan dengan percubaan menyeludup senarai pengundi dengan menggunakan warga asing"

"Oleh sebab itu, dakwaan tersebut perlulah di siasat dan diberi perhatian penuh," katanya.

Rafizi tidak menolak kemungkinan syarikat yang terlibat dalam pendaftaran Program Penyelesaian Menyeluruh Pendatang Asing Tanpa Izin (Program 6P) yang dikendalikan 336 syarikat pengurus, merupakan kroni UMNO.

"Ini lain tidak bukan antara langkah untuk memberi wang kepada kroni UMNO kerana sistem pendaftaran PATI dikendalikan oleh agen-agen tertentu," katanya.

Foreign Affairs Warned of Malaysia’s Record On Human Rights

THE Gillard Government was warned four days before it first announced its asylum seeker deal that some people sent to Malaysia could face canings of “not more than six strokes”.

Legal documents submitted to the High Court by lawyers acting for the Government show that the Department of Foreign Affairs pointed out concerns on May 3.

“Some concerns have been expressed about Malaysia’s record on human rights on specific issues, both internationally and within Malaysia,” one document says.

It refers to canings, jailings and other punishments for “illegal immigrants”.

But other documents submitted show that in July, the United Nations wrote that a deal with Malaysia was “workable” because of human rights safeguards put in place.

They include a provision to give asylum seekers legal status if they arrive from Australia.

The UNHCR wrote that its position “is and remains conditioned upon proper protection and vulnerability safeguards”.

The documents have been made public as part of the Government’s defence against the legal challenge to its Malaysian solution.

The Government wants to “swap” 800 asylum seeker boat arrivals for 4000 confirmed refugees in Malaysia – the first of whom will arrive within days.

Immigration Minister Chris Bowen said he hoped for a hearing before the scheduled date of August 22, warning people smugglers will use delays to get desperate people on boats.

“One of our arguments to the court is that people smugglers will spin this and lie about this and say that this is some sort of green light,” Mr Bowen told the ABC. “It’s not.

“Anybody contemplating coming to Australia on the basis of this injunction should not.”

Mr Bowen told the ABC that the Government was on “very strong ground in this case”, and it will argue that Malaysia is a safe place to send asylum seekers.

“Malaysia is a country which has given commitments to Australia in terms of the arrangement we have with them,” he said.

As asylum seekers remain on Christmas Island in limbo, an airbus hired to deport them to Malaysia will instead be used to fly home the federal police officers who would have removed them.

Almost 40 police known to locals as “the removalists” will go back to the mainland today and riot police and other officers are likely to follow after the High Court challenge.

The Malaysian police delegation sent to observe the removals flew out yesterday afternoon, and was unclear about when it could return.

Mafrel Mahu SPR Bersih Daftar Pemilih Elak Implikasi Ketika PRU-13

Badan Pemantau Pilihan Raya Adil dan Bebas Malaysia (Mafrel) menggesa Suruhanjaya Pilihan Raya (SPR) membersihkan daftar pemilih yang didakwa turut melibatkan kehadiran "pemastautin tetap" yang diragui bagi mengelakkan implikasi besar ketika pilihan raya umum ke-13.

Mengikut perkembangan semasa pilihan raya umum ke-13 dijangka akan diadakan dalam waktu terdekat.

Pengerusi Mafrel Syed Ibrahim Syed Noh berkata, SPR perlu melihat secara serius pendedahan yang dibuat oleh Pakatan Rakyat berhubung isu status kewarganegaraan yang diberikan kepada pemastautin tetap, sekali membolehkan mereka mengundi dalam pilihan raya.

Tegas beliau, SPR perlu menjalankan siasatan itu dengan kerjasama Jabatan Pendaftaran Negara (JPN) bagi membersihkan daftar pemilih.

"Saya rasa kalau pendedahan itu benar, SPR perlu melakukan siasatan segera mengenai apa yang berlaku, apa yang boleh SPR lakukan ialah siasat latar belakang pengundi itu, adakah mereka betul-betul (warganegara), sebab kini terdapat banyak keraguan yang mana pemastautin tetap bertukar ke warganegara dalam tempoh yang singkat.

"Kini lebih banyak keraguan, kita rasa ragu-ragu (tentang daftar pemilih), untuk menghilangkan keraguan ini SPR perlu mengambil tindakan segera dan menyiasat perkara ini dengan kerjasama JPN," katanya kepada The Malaysian Insider.

Bagaimanapun Syed Ibrahim percaya SPR akan memberi alasan tidak mempunyai kuasa, namun beliau menegaskan pembersihan daftar pemilih adalah di bawah bidang kuasa badan pengurusan pilihan raya itu.

"Memang daftar pemilih terletak di bawah bidang kuasa SPR, tidak boleh (kata) tiada kuasa kerana sebagai badan pengurusan pilihan raya SPR mempunyai kuasa itu.

"Sudah menjadi faktor utama yang mana daftar pemilih dan pembersihannya adalah kuasa SPR, kes ini sangat jelas… ini kes faktor yang mana ia jelas bagaimana pemilik kad pengenalan merah memperoleh kad pengenalan biru dalam tempoh singkat, untuk itu, SPR perlu siasat dengan serius," katanya.

Isu daftar menjadi hangat baru-baru ini ekoran pendedahan mengenai tindakan menukar status kewarganegaraan pemastautin tetap kepada warganegara dalam tempoh yang singkat dan ia mendapat bantahan kepimpinan Pakatan Rakyat.

Bagaimanapun perkara itu dinafikan oleh JPN dan SPR.

Berikutan pendedahan itu, Pakatan Rakyat mahu sidang tergempar Parlimen bagi membahaskan isu kewujudan pengundi-pengundi di kalangan warga asing yang diberikan taraf kewarganegaraan.

Tambah Syed Ibrahim, kegagalan SPR membersihkan daftar pemilih akan memberi implikasi yang besar dalam sistem pilihan raya negara.

"Implikasinya sangat besar, sekiranya warga asing dibenarkan mengundi keputusan itu boleh dicabar, kalau ada parti yang tidak berpuas hati… sudah tentu kita tidak mahu perkara ini berlaku.

"Sebab itu saya minta SPR mengambil tindakan segera dengan kerjasama JPN, siasat dengan serius kerana SPR adalah badan bebas," katanya.

Sebelum ini Pakatan Rakyat juga mendakwa Barisan Nasional (BN) mendaftarkan warga asing sebagai rakyat negara ini melalui operasi "MyDaftar".

Operasi itu dikatakan mahu menjadikan warga asing sebagai pengundi yang sah bagi memenangkan BN pada pilihan raya umum ke-13.

Ashamed or Not, Ex-IGP Musa Hassan Refuses to See Anwar Face to Face

For reasons known only to himself, former top cop Musa Hassan does not wish to see Anwar Ibrahim face to face, refusing to proceed with the interview to screen witnesses in the sodomy trial against the Opposition Leader if he was present.

Both Musa and former Malacca police chief Mohd Rodwan Mohd Yusof have insisted that Anwar absented himself during the interview sessions with the defense lawyers, sparking comment that they were too embarrassed to see the man who has accused them of deliberately conspiring to kill his political career.

“Anwar’s presence is needed as he is the person accused, and he has the right to be there. He has to be there as we may need to seek certain instructions. This, I have to emphasise, has never happened before in my legal practice and this is a first,” lead defense counsel Kaparal Singh told reporters on Tuesday.

The 64-year Anwar was accused of sodomising a former aide Saiful Bukhari Azlan at a posh condo in Kuala Lumpur in June, 2008, soon after he announced his plans to make a parliamentary comeback.

Anwar has accused Prime Minister Najib Razak and wife Rosmah Mansor of hatching the scheme, which also involves the Attorney-General Gani Patail, Musa and Rodwan. Like Najib, Rodwan had also met Saiful in the days before the aide lodged the police complaint leading to the current trial.

Too good to be true

On Monday, the judge sprang a surprise when he allowed the defense to interview all 15 witnesses, including Najib and Rosmah, before they took the witness stand.

Many observers had predicted “it was too good to be true” and chances were high the Najib administration would throw all forms of obstacles to get Najib and Rosmah off the hook from having to appear as witnesses.

On Tuesday, Solicitor-General II Mohd Yusof Zainal Abiden, who is heading the prosecution team, said in a text-message that Anwar’s presence was not necessary.

According to Karpal, Yusof also wanted to meet with the trial judge for further directions on the matter.

“We will wait for the prosecution to meet the judge, for they cannot meet him alone. We have to also be present as well,” said Karpal, stressing that it was the prosecution that was intentionally creating the delay.

He pointed out that Saiful’s father had publicly complained and accused Anwar of delaying the trial.

Meanwhile, the interview sessions have been put on hold until the objection over Anwar’s presence is resolved. Another six witnesses had been scheduled to be interviewed tomorrow.

“If at this stage, Musa Hassan and Rodwan are kicking up so much fuss, imagine what happens when Rosmah and Najib’s turn comes,” PKR vice president Tian Chua told Malaysia Chronicle.

The first couple are among the 15 witnesses and have already sounded a warning that they will co-operate only if a subpoena was issued. This has sparked criticism that they were not responsibe or civic-minded citizens as Anwar stands to be jailed for 20 years if found guilty.
