S'wak DAP quits Pakatan

DAP Sarawak regrets that PAS has deviated from the Pakatan Rakyat (PR) common policy framework by pursuing the implementation of hudud law in Malaysia.
The passing of the hudud law in Kelantan and the attempted tabling of a Private Member's Bill in Parliament by PAS President for the implementation of hudud law are not only violation of the Malaysia Agreement and the Federal Constitution, but will ultimately undermine the existence of Malaysia as a country.
In 1963, Sarawak joined to form Malaysia on the fundamental understanding that Malaysia was and will continue to be a secular country. Till this day, Sarawak has no official religion.
The political game played between UMNO and PAS in the Kelantan hudud law episode has shown clearly that Sarawak is no place for the politics of both UMNO and PAS. Such irresponsible political maneuvering by PAS and UMNO will not only lead to the break-up of PR but may also break up Barisan Nasional (BN). It is a blatant disregard of the Treatise in the formation of Malaysia in 1963 and thus may ultimately lead to the break-up of Malaysia as a nation.
If both PAS and UMNO were to persist in pursuing the implementation of hudud law in Malaysia or any State in Malaysia, this will add fuel to the secession sentiment in Sarawak for the simple reason that in 1963, Sarawak did not join to form a nation which implement hudud law.
Therefore, so long as the implementation of hudud law remains the political agenda and aim of PAS, DAP Sarawak can no longer work with PAS as a political party in Sarawak.
As such, with PAS remaining as a component party of PR Sarawak, DAP Sarawak has today resolved and made the painful decision to quit from PR Sarawak.

Let it be known that this resolution of DAP Sarawak is a unanimous decision of the Sarawak DAP State Committee and that under the DAP party structure, Sarawak DAP has the autonomy to make such decision. We believe our decision today is also the wishes of the large majority of the people in Sarawak.
DAP Sarawak has also resolved as follows:
1. We call on Najib not to delay in making his stand and UMNO's stand on the implementation of hudud law in Malaysia or any state in Malaysia given that 12 UMNO Kelantan State Assemblymen have openly supported the passing of hudud law in Kelantan State Assembly.
2. While Najib remains indecisive and silent on his and UMNO's stand on this issue, we call upon all political parties which support secularism in Malaysia and the fundamental principles of the Federal Constitution to explore the possibility of a coalition government to replace the existing Barisan Nasional which is dictated by UMNO.
3. Hudud law is not the one and only issue in the Country. More energy and attention should be channelled to address the economic plights of the people resulting from the implementation of GST, escalating costs of living, depreciating Ringgit and economic slowdown, the rampant corruption in government administration, increasing criminal activities and the deteriorating standard of education.

对于伊斯兰党违反民联共同政纲,一意孤行的欲在马来西亚实行伊斯兰刑事法的行为,民主行动党深表遗憾。
伊刑法在吉兰丹州议会的通过以及伊党主席欲在国会提呈议员私人法案寻求通过落实伊刑法的举动,不止违背了马来西亚合约和联邦宪法,最终也将动摇马来西亚一个国体的存在。
砂拉越于1963年与沙巴、马来亚和新加坡联合成立马来西亚的建国基础是,马来西亚是一个世俗国。直到今日,砂拉越还是没有一个官方宗教。
巫统和伊斯兰党在吉兰丹伊刑法事件所玩的政治游戏很明显的证明,巫统和伊斯兰党的政治,不适于砂拉越这个州属。 巫统和伊党如此的不负责任的继续玩弄伊刑法的课题,不止会分裂民联,也可能分裂国阵。 更甚的是,实行伊刑法的建议,完全违背马来西亚的建国契约。 因此,巫统和伊斯兰党的继续玩弄着课题,最终,极可能也将分裂马来西亚这个国家。
如果伊党和巫统再继续的坚持欲在马来西亚实行伊刑法,它将加剧砂拉越脱离马来西亚的情绪,因为,当年,砂拉越联合成立马来西亚时,砂拉越并没有同意成立一个实行伊刑法的马来西亚。
有鉴于此,只要伊斯兰党的政治斗争和目标仍旧是欲在马来西亚实行伊刑法,砂州民主行动党将无法与伊斯兰党在砂州共事。
因此,既然伊斯兰党现今仍旧是砂州民联的一个成员党之一,砂州民主行动党今日议决退出砂州民联。
在此,我要强调的是,今日砂州行动党的议决案,是全体一致的,以及,在行动党的党结构下,砂州行动党有自主权做出如此的决定。 我们坚信,我们今日的决定,也是大部分砂拉越人民的意愿。
除此之外,行动党砂州委员会今日也议决如下:
1. 我们呼吁首相纳吉,停止卖弄玄虚而不表态他及巫统对于在马来西亚落实伊刑法的立场,尤其是,12位巫统吉兰丹的州议员在吉兰丹州议会公开支持通过伊刑法。
2. 既然纳吉仍旧犹豫不决并保持沉默,拒绝表态是否支持在马来西亚实行伊刑法,我们呼吁所有捍卫马来西亚为世俗国及联邦宪法基本原则的政党,认真考虑合组一个既非国阵,也非民联的新联盟政府,取代由巫统控制的国阵。
3. 我们应该认清,伊刑法并非国家唯一的课题。 大家应该把精力专注在如何解决目前国家和人民所面对的重要课题,如,消费税、日益增加的生活费、马币疲软和经济滑落所带来的经济问题,政府行政的泛滥贪污,日益增加的犯罪活动及不断滑落的国家教育水平。

有鉴于伊斯兰党的"背后插刀"在吉兰丹提呈伊刑法,砂民联的破裂已成为无可避免的现实。
我将在近期召开砂州委员会,做出最后的决定,即,砂行动党是否退出民联。
以目前伊党的立场和路线,砂民联的破裂似乎在所难免。 但是,这是自我于2013年接掌砂州行动党主席之职后,所将做出的最重要的一个决定。 因此,我不能个人做出宣布,必须得到全体州委的通过,才可做出进一步的宣布。
原则上,是伊党违背民联协议,应该是由伊党推出民联。 但是,民联3党目前只有行动党坚持针对施行伊刑法的强烈抗议,在其他友党还没有做出任何表态的情况下,行动党唯有退出此联盟。
无论如何,人民可以看清的一个事实: 吉兰丹伊刑法的通过,也是得到巫统的全力支持,而巫统则是国阵的主干政党。 这是伊党和巫统的合作下所一起通过的法律。
行动党反对施行伊刑法的立场,一贯始终,从来没有改变。
更重要的是,国阵内的"非巫统"政党,也应该强烈和明确的表明反对施行伊刑法的立场,不论是伊斯兰党的或是巫统的伊刑法。
当年砂拉越和沙巴、马来亚及新加坡联合成立马来西亚,其中一个条件就是马来西亚是世俗国。 这也是为什么砂拉越没有官方宗教。 因此,伊党和巫统318的联手通过伊刑法,已违背了马来西亚建国的协议。
因此,我呼吁,砂拉越所有的政党,基于我们建国契约,大力谴责伊党和巫统这两个政党,在破坏马来西亚的建国基石。

In light of the "back-stabbing" by PAS in the tabling of the hudud bill in Kelantan, it is now either PAS or DAP in Pakatan Rakyat Sarawak. Given the said betrayal, DAP Sarawak will have no choice but to consider taking the final step to leave Pakatan Rakyat.
As of now, I see no other option but the break of PR Sarawak.
However, as this is the most important decision to be made since I took helm of the State Committee in June 2013, I shall convene a DAP Sarawak State Committee meeting to decide on the matter and get endorsement from the full committee soon.
Meanwhile, it is to be noted that the Kelantan Hudud amendment bill was fully supported by UMNO, which is the backbone of Barisan Nasional. It is a collaboration of both PAS and UMNO in pushing through this hudud law.
There is no question that DAP shall take a strong stand against the implementation of hudud law in Malaysia. More importantly, all the non-UMNO parties in BN must also make their stand loud and clear, not only to PAS but also to UMNO.
When Sarawak join with Sabah, Federation of Malaya and Singapore to form Malaysia, it is a condition that Malaysia shall remain a secular State. This is especially so as there is till this day no official religion for Sarawak.
The move by PAS, supported by UMNO, has undermined the formation of Malaysia.
Therefore, I call upon all political parties in Sarawak to condemn the passing of the hudud law and any attempt by any person or political party to undermine the secular status of Malaysia, be it by PAS or UMNO.

GST Protest: Time to Reign in the Police?

There is no coup in the country to topple the ruling government. But an outsider, reading news about police clampdown, arrests for peaceful protests and the hauling up of people for sedition, would think there is one happening.

Monday’s arrest of 80 people who held an anti-GST protest is way over the top. My staff is one among those arrested.

The detainees were denied access to lawyers for three hours. They were also denied food. Such blatant abuse of police power to create fear among the protesters and the public is grotesque.

The protesters wanted answers about the controversial tax system, which will burden the already struggling middle class and poor.

Their questions were legitimate. Why lobsters would escape GST is a valid question.

Customs officers could have treated the protesters with dignity and answered all their questions.

When will the government and police understand that it is perfectly acceptable to ask questions about government policies?

When would it hit them that the people in power are answerable to the rakyat?

When will the police learn that they cannot keep going to the mat for the ruling political parties, especially UMNO? And that they are here to protect the interest of the public and not indulge in repression.

It looks as if the police force has gone mad. Kita Lawan protesters were arrested, lawyer Eric Paulsen has been hauled up for sedition twice and DAP lawmaker Tony Pua has not been spared.

There is also no Parliamentary immunity in the country. PKR member of parliament, Nurul Izzah, was detained overnight for reading out her father’s statement in the lower house.

And the police chief takes to twitter ever so often to threaten activists, Opposition leaders and anyone who dares to raise a valid question, with arrest.

This police highhandedness and repression are totally unacceptable.

The rakyat have a right, enshrined in the country’s Federal Constitution, to express their dissatisfaction with the government and demand that justice is done.

The people have a right to demand for an accountable and transparent government.

The people have a right to express their financial hardship and how Barisan Nasional’s half-baked policies like the GST are making it impossible for them to put food on the table for their families.

The government has a responsibility and that is to listen to its people and implement policies and measures that allow their right to a livelihood.

What it cannot keep doing is to instruct the police to arrest anyone who dares to rise up against tyranny.

Motion to protect rights of 200 Orang Asal families submitted

The Sarawak Government must stop the policy of giving land away cheaply to its cronies while the people receive nothing in terms of compensation.


KUALA LUMPUR: Bandar Kuching MP Chong Chieng Jen on Tuesday submitted to the Speaker a motion under standing order 18 (1) to ask Parliament to give immediate consideration for the protection of the human rights and welfare of over 200 Orang Asal families in Bintulu "to avoid any serious conflict and fighting".
One hundred and ten families in the Sebatang area, Tg. Kidurong road, Bintulu have been given until Wednesday to vacate the land or their houses will be demolished.
A company, which has been given the land by the Sarawak Government, has been seen going around the affected homes . "The affected folks said that it's not that they do not want to move but they really do not have a place to move to," said Chong.
A High Court Judge has set April 21, 2015 to hear the case of another 91 families in the same area who are defendants. The defendants had been brought up to the Bintulu High court to vacate the land Lot 3113, Kemena Land District where they had been staying for decades.
The second group of affected families are being represented by Padungan MP Wong King Wei.
Kidurong Assemblyman Chiew Chin Sing called on the government to step in and "allocate a place for the over 200 families to move to and resolve the situation amicably before it is too late".
He said that it was ironical that the Sarawak Government should sell the 200-acre property for RM27.8 million in 2012 to a private company while the Orang Asal who had been staying there for decades received nothing and had to leave.
"The premium for the 200 acre land is RM27.8 million or RM139,000 an acre while the value of the land there is easily ten times that," he said. "It is high time the Sarawak Government stop the policy of giving land cheaply to its cronies while the people continue to be neglected by it."

Chong: House prices will definitely rise after GST

Sarawak DAP chief Chong Chieng Jen is certain that the prices of houses will definitely rise with the implementation of goods and services tax (GST) on April 1.

"I can assure you that the prices of houses will rise due to the prices of building materials, such as cement and steel bars, which are subject to the six percent tax," Chong told the media.

He said he found it amusing or even strange that Sarawak Housing Minister Abang Johari Openg and his deputy Abdul Karim Hamzah have been issuing contradictory statements on the impact of the GST on the prices of housing after its implementation in April.

Chong yesterday showed a newspaper clipping dated Oct 13, 2014, to reporters, which quoted Abang Johari (left) as saying: "After the implementation of GST, house prices should fall, unless my maths is very poor.

"Prospective house buyers in Sarawak should not fall for the claims by developers that property prices would increase following the implementation of GST on April 1, saying that buyers would not be burdened by the six percent GST as developers would enjoy an input tax deduction for the building materials they used.

"They have to pay GST for the materials, of course, but at the end of the day the building process chain, developers can claim GST back on what they had purchased.

"The price of houses cannot be higher than what it is now. At the moment you are paying 10 percent government tax, plus six percent sales tax. If it imposed at six percent, then it should be lower. That's the logic," Abang Johari had said.

'Year-to-year prices will appreciate'

Chong who is the MP for Bandar Kuching and Kota Sentosa assemblyperson, then showed another paper clipping dated March 7 this year which quoted Abdul Karim as saying that after the implementation of GST, house prices would increase by three to four percent.

"It (price) might probably be a three to four percent increase, but then it is still subject to market forces. Year-to-year the prices will definitely appreciate," Abdul Karim had said.

Chiding Abang Johari for his 'poor maths', Chong told newsmen that he agreed with Abdul Karim for the fact that a lot of building materials are not subject to sales tax, but when GST is implemented, prices of building materials, such as cement and steel bars, would be subjected to the six percent tax.

Abdul Karim was correct to say that house buyers could expect to pay more for house prices after April 1, citing a terrace house as an example.

He said that a buyer who went for a terrace house which was worth RM350,000 would be expected to pay another RM30,000 for the total cost of GST.

张健仁抨击阿邦佐 消费税言论混淆人民

(本报古晋13日讯)行动党国州议员张健仁抨击砂房屋部长拿督阿玛阿邦佐哈里和砂房屋助理部长拿督阿都卡林在"消费税导致房屋涨价与否"一事,发表不同的言论,令人民感到混淆!
他吁请州内阁部长在发表任何言论之前,都必须清楚了解整体情况。
身兼古晋区国会议员及哥打圣淘沙区州议员的张健仁于今日召开新闻发布会时,发表是项谈话。

他披露,阿邦佐哈里于2014年10月13日发表"消费税实施将促使房价下跌,除非我的数学很差",并说明消费税只有征收6%税务,销售税则是征收10%,因此房价必然会因着消费税而降低。
他继称,但是阿都卡林于2015年3月7日则表示"消费税将导致房屋价格调涨3%至4%。"

他声称,房屋部长和房屋助理部长发表不同的言论,令人民感到混淆,是非常不妥当的做法。
他认为,部长应该了解实际情况之后,才发表言论。
与此同时,他表示,个人认为阿都卡林的言论比较正确,原因是建筑材料目前并没有被征收10%销售税,然而从今年4月开始必须被征收6%消费税,因此房屋建筑成本会提高,房价也会调涨。

(本报古晋13日讯)砂行动党将于来临的砂州立法议会提呈一项动议,要求州政府以"达雅"字眼取代官方表格内种族栏的"土著"(Bumiputera)或"其他"(Lain-lain)。
该党欢迎国阵州议员同样提出类似的动议,或是"骑劫"该党的这项动议。

该党国州议员张健仁于今日召开新闻发布会时,如是披露。
他表示,本身以古晋区国会议员身份日前在国会中提问中央政府在此课题的立场,获得首相署部长拿督约瑟恩都鲁的回答。
他指出,约瑟恩都鲁声称东马少数土著技术委员会已被政府委派进行探讨工作,收集达雅民族的意见,于2015年2月份在诗巫、美里和古晋,跟达雅非政府组织进行对话交流,大部分认同应以"达雅"字眼取代官方表格内种族栏的"其他"(Lain-lain)。
为达雅同胞争取权益
"部长表示,有关委员会已在2015年3月5日提呈相关建议予中央内阁,寻求政府的批准。"
他要求中央政府尽快给予批准,不要耗时良久来处理此课题,毕竟这是达雅族群的意愿。
与此同时,也是哥打圣淘沙区州议员的张健仁披露,该党将于来临的砂州立法议会提呈一项动议,要求州政府统一以"达雅"字眼取代官方表格内种族栏的"土著"(Bumiputera)或"其他"(Lain-lain)。
他呼吁所有朝野州议员都支持这项动议,为达雅同胞争取权益。
他笑称,国阵州议员也可提呈类似的动议,或是"骑劫"该党的这项动议,该党无任欢迎。

Motion to recognise Sarawak natives as ‘Dayak’ on government forms to be tabled in next DUN sitting

KUCHING: Kota Sentosa assemblyman Chong Chieng Jen will table a motion in the next State Legislative Assembly (DUN) sitting, calling for an amendment to the Sarawak Interpretation Ordinance 2005 to classify natives in Sarawak as 'Dayak' on official government forms, rather than the current 'Dan Lain-lain' (DLL).

Chong, who is also Bandar Kuching MP, also urged the federal cabinet to adopt the recommendation of the Minority Bumiputera Technical Committee to classify natives in Sarawak as 'Dayak'.

"We call upon all ADUN (assemblymen and assemblywomen) in Sarawak to support our motion but if they want to put in the motion before us, or they want to put in the amendment to the Interpretation Ordinance before us, they are most welcome to do so," he told a press conference here yesterday.
Chong, also national DAP vice chairman and the party's state chairman, pointed out that the tabling of the motion would be what DAP could do at state-level.

At the national level, he said a written reply he received from the Parliament on Wednesday (March 11) stated that the government had entrusted the technical committee to conduct studies into the subject matter.

Based on the reply, he noted that the committee had met up with Dayak professionals and non-governmental organisations (NGOs) here, as well as in Sibu and Miri last month – with all those concerned unanimously agreeing on classifying the natives in Sarawak as 'Dayak' instead of 'DLL' on all official government forms.

The reply added that a meeting on March 5 had decided on submitting a proposal to the federal cabinet to replace 'DLL' with 'Dayak' on official government forms, he said.

"We call upon the federal cabinet to adopt this recommendation of the technical committee of Sabah and Sarawak," he said, adding such move was to finalise and legalise the term Dayak as a race.

Chong said with the government adopting the recommendation, it represented a small step towards the recognition of the term Dayak to describe the natives of Sarawak.

State DAP to file judicial review against EC

KUCHING: Sarawak DAP will be filing a judicial review against the Election Commission (EC) within the next 14 days for its refusal to grant a public hearing over the re-delineation proposal that affects the Bandar Kuching parliamentary seat.

Its chairman Chong Chieng Jen told a press conference yesterday that the letter dated Feb 18, 2015, to deny a public hearing was only received by the party headquarters here last week.

The letter stated that the re-delineation proposal would not affect the Bandar Kuching parliamentary seat.

However, Chong said he was surprised as to why the EC did not grant them a public hearing even though they had satisfied the EC's condition of getting 100 objections from 100 voters in Bandar Kuching.

"Nevertheless, our lawyers are now compiling the paperwork for a judicial review," Chong said after chairing a state party committee meeting.

He did not say when the judicial review would be filed in court.

Chong, who is also Bandar Kuching MP, said the constituency currently had about 80,000 registered voters, an increase of 28,000 voters since the last re-delineation exercise carried out more than 10 years ago.

Meanwhile, the state DAP will help their federal counterpart in a signature campaign to urge the Ministry of Education to amend the National Education Blueprint (2013 to 2025).

Among the issues raised yesterday was shorter time for Chinese schools to teach Mandarin classes, while more time is allocated to teach Bahasa Malaysia classes.

The campaign is also to get the ministry to give due recognition to Chinese middle schools in the blueprint.

"Currently, around 900,000 signatures have been collected in Peninsular Malaysia. We (the state DAP) will take it to one million signatures," said Chong, who is also Kota Sentosa assemblyman.

长期扎根基层 行动党务实参政

(本报古晋8日讯)行动党砂州联委会主席张健仁指出,该党长期来都在要出战的30个选区展开基层工作,以更实际行动为民服务!
针对询及来届选举是否与公正党与伊斯兰党合作,他并未给予正面回应,仅强调目前行动党将继续着重于基层工作,尤其在30个将出战的选区。
他认为,与其一直在报章上讨论要出战哪一个选区,不如长期的基层工作来得更实际。
张健仁今午在砂州联委会会议后召开的新闻发布会上表示,对于该党而言,该党向来的政策是在要出战的选区上长期经营及服务,同时也有信心攻下。
他说,该党是以脚踏实地及务实的态度去看待出战一个选举与否。

(本报古晋8日讯)就砂行动党针对选区划分提出的投诉及建议,已符合了宪法条例,即超过100名当地选民反对,然而,却遭选举委员会驳回,因此,该党决定透过法律途径,将此事告上法庭!
行动党砂州联委会主席张健仁今午在召开砂州联委会会议后,针对砂行动党就选区划分提出的投诉及建议遭受选举委员会反驳一事,对媒体如是透露。
他说,该党在上个星期接获选举委员会拒绝展开听证会的信件,尽管该党已经符合宪法条例,即超过100名当地选民提出反对。
鉴于此,他批评选举委员会违反了宪法条例,并决定采取法律途径,将选举委员会提告至法庭。
他解释说,砂选委会日前拒绝召开选民听证会的理由非常简单,那就是"你的选区没有受到影响"。对此,他认为,有关理由很牵强,让该党无法接受。
理由牵强难接受
张健仁感到奇怪,为何选委会害怕行动党要求进行相关听证会?
他说,行动党早前向选委会所提出的建议包括,将浮罗岸州选区内的两个投票区,即马吉(Market)和老巴刹(Bazaar)转为砂督州议席,即将浮罗岸选区的5000名选民划分至砂督选区。
此外,行动党也建议将部份朋岭和峇都林当州议席的一些投票区划出来,联合成立一个新的州议席,并将其命名为"达闽"州议席。
与此同时,该党还建议将古晋市和实旦宾国会议席的一些地区重新划分,成立一个新的国会议席,并将之取名为盐柴港(Sungai Maong)国会议席。
