Antara Teori Dan Amalan Perjalanan Pilihanraya Malaysia

Undang-undang pilihanraya Malaysia menyatakan bahawa alasan pembatalan sesuatu pilihanraya hanya boleh dibuat oleh hakim pilihanraya melalui seksyen 32 Akta Kesalahan Pllihanraya 1954. Seksyen 32 menggariskan lima alasan [ 32 (a) hingga (e)] bagi pembatalan pilihanraya oleh Mahkamah Pilihanraya.

Contohnya jika calon A yang kalah dengan majoriti 1000 undi dapat buktikan wujudnya perlanggaran undang-undang misalnya dakwat tidak kekal di jari pengundi, calon A kena buktikan 1001 pengundi yang dakwat dijari mereka tidak kekal dan kesemua 1001 pengundi itu kena

PENGERUSI Suruhanjaya Pilihan Raya (SPR) Tan Sri Abdul Aziz Mohd Yusof berkata mereka yang tidak berpuas hati dengan keputusan pilihan raya umum ke-13 (PRU13) boleh memohon semakan supaya pilihan raya diadakan semula dengan mengemukakan petisyen selepas pewartaan keputusan oleh SPR, mengikut undang-undang.

"Selepas diwartakan dalam tempoh 21 hari, mereka boleh buat petisyen, itu yang betul dan kalau bukti-bukti itu jelas serta lengkap dan pihak hakim mengakui wujudnya perlakuan rasuah, penipuan atau menyalahi undang-undang, maka mungkin Hakim Mahkamah Tinggi berkenaan akan memutuskan bahawa keputusan pilihan raya itu tidak sah," kata Aziz.

Sentimen yang sama juga diluahkan oleh Presiden Umno Najib Tun Razak. Najib menyatakan Umno akan terima apa sahaja keputusan mahkamah. 

Inilah skrip basi SPR dan Umno. Bagi kedua-dua tokoh ini penyelesaian kepada kepincangan sistem pilihanraya adalah mahkamah. Hujah Najib dan SPR ini hakikatnya satu lagi bentuk penipuan halus pihak berkuasa untuk mengelirukan mereka yang jahil tentang petisyen pilihanraya.

Saya ingin nyatakan dengan tegas petisyen piliharaya dan mahkamah bukan penyelesaian kepada kepincangan pilihanraya. Alasannya cukup mudah. Mahkamah pilihanraya (election court)  beroperasi dalam ruang lingkup undang-undang pilihanraya yang digubal oleh rejim BN yang korup dan penipu. Jadi bagaimanakah undang-undang yang digubal oleh rejim yang penipu dapat menyelesaikan pilihanraya yang sarat dengan penipuan !!!

Ibarat yang mudah adalah bagaimanakah kita boleh mengharap kambing selamat dari serigala jika yang jaga kambing adalah serigala !!!

Dalam undang-undang pilihanraya, alasan pembatalan sesuatu pilihanraya hanya boleh dibuat oleh hakim pilihanraya melalui seksyen 32 Akta Kesalahan Pllihanraya 1954. Seksyen 32 menggariskan lima alasan [ 32 (a) hingga (e)] bagi pembatalan pilihanraya oleh Mahkamah Pilihanraya.

Najib dan SPR arif dan tahu berdasarkan seksyen 32 (a) hingga (e) Akta tersebut hampir mustahil untuk membatalkan sesuatu pilihanraya. Bagi memudahkan faham mari kita lihat bagaimana seksyen 32 (b) Akta tersebut digubal oleh rejim BN.

Berdasarkan seksyen 32 (b) tersebut sesuatu pilihanraya hanya boleh dibatalkan jika mahkamah pilihanraya berpuashati wujudnya perlanggaran undang-undang pilihanraya namun perlanggaran itu mestilah dalam masa yang sama menjejaskan keputusan pilihanraya.

Sebagai peguam yang banyak terlibat dalam petisyen pilihanraya saya ingin nyatakan membuktikan perlanggaran undang-undang atau peraturan pilihanraya bukan suatu yang susah kerana Umno dan SPR  seringkali langgar undang-undang pilihanraya. Malahan banyak kali kami peguam PAS dapat membuktikan hal tersebut.
Yang sukarnya hingga ke tahap hampir mustahil adalah membuktikan perlanggaran undang-undang oleh Umno dan SPR boleh menjejaskan keputusan pilihanraya.

Hakim–hakim di negara ini sehingga sekarang memilih tafsiran kuno tentang maksud menjejaskan keputusan pilihanraya. Di negara maju seperti di England para hakim di sana berpendapat jika berlaku perlanggaran undang-undang secara substantif maka pilihanraya adalah tidak sah tanpa mengira perlanggaran itu menjejaskan atau tidak menjejaskan keputusan pilihanraya.

Jika tidak dibuktikan meskipun calon A boleh buktikan penggunaan dakwat yang tidak kekal adalah bercanggah dengan undang-undang namun pilihanraya yang langgar undang-undang itu masih dikira sah dan tidak boleh dibatalkan.

Itulah yang hakim-hakim di negara ini akan putuskan. Jika hakim putuskan begitu Najib dan SPR secepat kilat akan berkata "lihatlah mahkamah telah pun memutuskan pilihanraya adalah sah..jadi mengapa Pakatan Rakyat masih tidak puas hati?"

Bagi saya ini satu muslihat licik Umno untuk menggunakan saluran mahkamah untuk menjustifikasi penipuan!!!

Sebab itu saya tegaskan mahkamah atau petisyen bukan jalan penyelesaian kepada kepincangan sistem pilihanraya. Mahkamah rakyat adalah penyelesaiannya.
Bagi rakyat jika SPR atau undang-undang kata dakwat yang digunakan adalah kekal maka SPR kena pastikan dakwat itu benar-benar kekal. Jika tidak kekal maka SPR tipu. Undang-undang juga tipu.

Inilah perbezaan mahkamah pilihanraya dan mahkamah rakyat. Di mahkamah pilihanraya hakim tidak boleh batalkan pilihanraya meskipun SPR tipu kerana hakim terikat dengan undang-undang yang digubal oleh rejim penipu.

Sebaliknya di mahkamah rakyat keadilannya lebih tulen. Jika SPR dan undang-undang tipu maka pilihanraya yang BN menang adalah pilihanraya tipu. Maka PM dan Menteri yang dilantik juga dikira oleh rakyat dikira sebagai PM penipu dan menteri penipu !!!!

Why Declare Assets only to MACC?

DAP elected representatives are prepared to declare assets publicly if the ruling is made an act of law but we are not agreeable to only a secret declaration to MACC

The Malaysian Anti-Corruption Commission's (MACC) Consultation and Corruption Prevention Panel has proposed that all elected representatives in Parliament and state assemblies should declare their assets to it every three years, "to ensure integrity in government administration".

In principle, the DAP completely agrees that the declaration of assets by elected representatives of the parliament and state assemblies is a positive move "to ensure integrity", to increase scrutiny and to curb corruption.

However, given MACC's complete lack of credibility and its penchance to act as the cat's paw of the ruling Barisan Nasional government, we cannot agree to the terms to rely on MACC as the sole arbiter of whether an elected representative is living beyond his means.

The MACC has proven over the past 5 years that it is not competent in investigating and uncovering corruption among the 'big fishes' entrenched in the ruling party.  Worse, the MACC has been completely impartial in its actions by targetting only Pakatan Rakyat representatives.  The MACC went on a witch hunt in Selangor, seizing files from the state government and raiding the offices of it state assemblymen without basis or justification in the hope of securing evidence of corruption or abuse of power.

The assistant of state executive councillor Ean Yong Hian Wah, Teoh Beng Hock was even hauled up with his rights denied overnight on the 14th floor of the Selangor MACC office over the purchase of Malaysian flags for the amount of RM2,400.  While MACC has closed the files because there was absolutely no case against Ean Yong, Teoh's life has been sacrificed as a result, having been found dead on the 5th floor of the MACC.  What is most galling is the fact that the officers directly responsible for Teoh's death have since been promoted for their deeds.

There was also the attempt by MACC to tarnish the image of Selangor Menteri Besar, Tan Sri Khalid Ibrahim just before the Hulu Selangor by-elections.  The then MACC Chief Commissioner, Datuk Seri Ahmad Said Hamdan had declared publicly that the MACC had evidence of the Menteri Besar's corruption.

The cases were so incredulous, where Tan Sri Khalid was accused of corruption because of donation of cattles to local mosques to celebrate Hari Raya Haji as well as petrol claims for using his personal vehicle as the official state car.  The accusations have since been withdrawn, and the MACC has cleared Tan Sri Khalid Ibrahim of any wrong-doing.

In fact, Datuk Seri Ahmad Said Hamdan was forced to apologise publicly to Tan Sri Khalid for his false accusations which have damaged the latter's reputation.

It is clear that the MACC, while "independent" on paper, serves only the political interest of Barisan Nasional.  As a result, any declaration of assets solely to MACC is a pointless exercise as MACC will only scrutinise the assets of Pakatan Rakyat representatives and not that of Barisan Nasional.

The elected representatives of DAP are not fearful of public scrutiny and are prepared to declare assets publicly. We challenge the MACC Consultation and Corruption Prevention Panel to advice the Prime Minister to require all elected representatives to declare their assets.  And if the Panel finds such a requirement too onerous, it should at the very least require all Federal Ministers as well as State Executive Councillors to declare assets publicly.

All DAP elected representatives have signed an Integrity Pledge on the 11th May 2013 at our National Conference of Elected Representatives, which included a clause for the "public declaration of assets once appointed to executive positions of Government" whether in the Federal or State levels.  I for one, am prepared to declare assets publicly because I know whatever assets that is in my possession is earned honestly without a single sen obtained from the tax-payers' money via corrupt means.

Anything less that a commitment to a blanket public declaration of assets by the Prime Minister as well as the MACC will prove that they lack the sincerity to tackle corruption, particularly by those in power in this country.

Police must act against thugs who tried to disrupt the right of Malaysians to hold a candlelight vigil demanding the release of student Adam Adli Abdul Hamid. A group of pro-BN supporters physically manhandled the candlelight vigil, attended by some 30 people in front of Universiti Sains Malaysia that included two journalists Malaysiakini Low Chia Ming and Nanyang Siang Pau Brian Lai.

The Penang state government condemns the BN supporters for such violent behaviour. Police reports were lodged by the journalists. It is sad that police Special Branch officers were present but they did not take any action against the thugs. I will write to the Chief Police Officer Dato Abdul Rahim bin Haji Hanafi to press for action against these thugs.

Amoral To Allow Rapists Of Underaged Girls To Escape UnPunished Because No One Should Be Off From Rape Charges Merely Because They Married The Rape Victim.

The Penang state government is shocked that the BN Federal government AND Attorney-General appears to condone rapists marrying their underage victim to escape criminal prosecution for statutory rape.

The Sabah statutory rape case yesterday where charges against the rapist may be withdrawn because he married the 13 year old victim, is unacceptable because a crime is a crime and must be punished severely.

Allowing a rapist to get off scot free from raping a victim and getting off scot-free by marrying her is not only morally outrageous but completely amoral. What safeguards and protections are there left for minors and young underaged girls then from rapists?

The reason that there is a criminal provision for statutory rape is to protect young girls below 16 who had consented to sex without knowing the consequences of their actions. If men can escape statutory rape by marrying the young girls, will this escape clause be extended to all rape victims by encouraging rapists to marry their victims?

It is morally repugnant to allow the rape victim to marry the rapist so that the rapist can avoid paying the penalty for his heinous crime. This is punishing the victim not the rapist. Both rapist and rape victim may marry in future as is within their right but no one can use that as an escape clause.

As parents of daughters, we are concerned that young underaged girls and minors are being taken advantage of. What is the use of having rule of law, if laws can not protect them? I hope that the relevant authorities will be shamed into pressing for action against all cases of statutory rape- which is a crime regardless whether the rapist married the victim or not.

Membenarkan perogol gadis bawah umur bebas tanpa dihukum adalah amat keji. Tiada sesiapa patut terlepas daripada tuduhan merogol hanya kerana mereka mengahwini mangsa.

Kerajaan Negeri Pulau Pinang amat terkejut apabila Kerajaan Persekutuan BN dan Peguam Negara kelihatan merelakan perogol mengahwini mangsa rogol bawah umur bagi mengelak dakwaan jenayah kerana merogol gadis bawah umur.

Kes rogol bawah umur di Sabah semalam di mana pertuduhan terhadap si perogol boleh digugurkan kerana dia mengahwini mangsa berusia 13 tahun itu sangat tidak boleh diterima kerana jenayah tetap jenayah dan mesti dihukum dengan berat.

Membenarkan seorang perogol untuk bebas daripada pertuduhan merogol hanya kerana mengahwini mangsanya bukan sahaja amat keji malah sangat-sangat tidak bermoral. Apa lagi perlindungan yang ada untuk anak bawah umur dan gadis muda daripada perogol?

Tujuan diwujudkan peruntukan undang-undang jenayah untuk kes rogol bawah umur ialah untuk melindungi gadis bawah usia 16 tahun yang telah rela melakukan hubungan seksual tanpa menyedari akibat daripada tindakan mereka. Jika para lelaki boleh bebas daripada tuduhan rogol bawah umur dengan mengahwini anak gadis muda, mungkinkah klausa pengecualian ini dipanjangkan kepada semua kes mangsa rogol dengan menggalakkan perogol mengahwini mangsanya?

Adalah amat meloyakan untuk membenarkan mangsa rogol mengahwini si perogol supaya perogol boleh mengelak daripada menjalani hukuman di atas jenayahnya yang cela. Ini sudah menghukum mangsa dan bukan pelaku. Kedua-dua perogol dan mangsa rogol mungkin boleh berkahwin di masa akan datang kerana itu hak mereka, tetapi tidak boleh dibenarkan sesiapa pun menggunakan alasan itu untuk meboloskan diri daripada dihukum.

Sebagai ibu bapa kepada anak-anak perempuan, kita sentiasa runsing dan takut anak-anak bawah umur kita diambil kesempatan. Apalah gunanya mempunyai kedaulatan undang-undang sekiranya undang-undang tidak boleh melindungi mereka? Saya harap semua pihak berkuasa berkaitan akan berasa malu sehingga mesti mengambil tindakan terhadap semua kes rogol bawah umur – yang merupakan jenayah tidak kira sama ada perogol mengahwini mangsanya atau tidak.

昨天的沙巴州法定强奸案,因施暴者愿意与13岁的受害者结婚,控状或许被撤销一事,是不能被接受的,因为犯罪就是犯罪,必需严惩。

允许一名强奸犯在强奸受害人之后逍遥法外,允许强奸犯娶受害者而不受处分,不只是道义上离谱,更完全颠倒道德的是非。这么一来,我们还能用什么来保障和保护未成年人及未成年少女,免于受强奸犯的侵害?

法定强奸案刑事条文的设立,是为了保护那些不知自己性行为所带来的后果的16岁以下的少女。如果男人可以借娶被他强奸的年轻受害人为妻而逃脱法定强奸罪名,那这项例外,会否在往后延伸至鼓励所有的强奸犯,借迎娶受害人过门而逃脱罪名?

允许强奸犯娶受害者,以逃脱他犯下滔天罪行所应受到的惩罚,是道德败坏的。此举是在惩罚受害者而不是施暴者。施暴者及强奸案受害者可以在往后结婚,因为这是他们的权力,但是没有人可以把这当成一个逃脱罪名的条款。

作为一个女儿的父母,我们关心未成年少女及未成年者被人占便宜。如果法律不能保护他们,我们要法治来做什么?我希望有关当局能因蒙羞而施压,采取行动对付所有的法定强奸案件,不管施暴者是否有与受者者结婚,罪案就是罪案。

Is Ahmad Zahid Hamidi Willing To Engage In A Public Debate With Either Me, Lim Kit Siang Or PR Leader Dato Seri Anwar Ibrahim Whether His Extremist And Divisive Remarks Is Democratic And Part Of National Reconciliation After The General Elections?

Will Home Minister Dato Seri Ahmad Zahid Hamidi prove his courage and willingness to face DAP leader and MP for Geylang Patah Lim Kit Siang's censure motion by giving a full day parliamentary debate? Lim Kit Siang had announced that he would move a censure motion against Ahmad unless the Home Minister apologises for asking Malaysians not wanting to accept Malaysia’s existing general election system and preferred another system to migrate to another country.

It is meaningless for Ahmad to state that he is willing to face DAP or PR in Parliament if insufficient parliamentary time is given. Ahmad is only arrogant or brave in front of BN media and TV cameras when threatening hapless Malaysiakini journalists. Is he willing to engage in a public debate with either me, Lim Kit Siang or PR leader Dato Seri Anwar Ibrahim whether his extremist and divisive remarks is democratic and part of national reconciliation after the general elections.

Malaysians recorded a historic voter turnout of 80% in the 13th General Elections to defy and defeat money politics, fear and lies. Despite PR increasing our popular vote by nearly 4% in winning the popular vote of 51% compared to only 47% for BN, BN won government. The victory margin was even larger in Peninsular Malaysia of 53% for PR against 45% for BN. PR won 55% of the popular vote in Perak yet lost power.

Malaysia has a minority BN government in Putrajaya, a minority BN Prime Minister and minority BN Perak Menteri Besar. The people have a right to ask what type of democracy is there in Malaysia that permits a minority to rule over a majority. Instead of responding to public calls for polls reforms to respect the "one-person, one-vote, one-value" principle, Ahmad Zahid is taking an autocratic and hard-line approach to crack down on dissent.

Instead of getting the police to focus back on their core business of fighting criminals, Ahmad prefers the police to arrest PR leaders who have not stolen or harmed the rakyat. Where is press freedom and freedom of expression when Utusan Malaysia journalists can physically harass Hata Wahari not just with boos and racist abuse but also hurled two packets of fried bihun at him ?

Utusan Malaysia should adopt the right of any citizen to disagree and allow Hata to continue with his peaceful protests stated in a large banner with the words, ‘Message to Utusan chief editor: Stop irresponsible reporting. Uphold journalistic ethics. Don’t spoil Utusan’s future for self-interest. Don’t be a racist reporter’.Utusan Malaysia no longer believes in press freedom except the freedom to lie against PR. I have brought many legal defamation suits against Utusan and have won every case against them.

From a paper that once fought for freedom, Utusan Malaysia has now shamefully degenerated into becoming an enemy of press freedom, racial harmony, truth and fundamental human rights of freedom of expression. How can a journalist physically harass another journalist? Only in North Korea can Utusan Malaysia be welcomed in suppressing, oppressing and repressing press freedom.

Lim Kit Siang telah mengumumkan bahawa beliau akan mengemukakan usul celaan terhadap Ahmad Zahid kecuali sekiranya Menteri Dalam Negeri itu meminta maaf kerana meminta rakyat Malaysia yang tidak mahu menerima sistem pilihan raya sedia ada di Malaysia dan mahukan sistem yang lain untuk berhijrah ke negara lain itu.

Tidak ada makna bagi Ahmad Zahid menyatakan bahawa beliau berani berdepan dengan DAP dan Pakatan Rakyat di Parlimen sekiranya masa yang diberi tidak mencukupi. Ahmad Zahid hanyalah bongkak dan berani di depan media BN dan kemera TV apabila mengugut wartawan Malaysiakini. Adakah beliau berani untuk berdebat secara terbuka dengan saya atau Lim Kit Siang atau pemimpin Pakatan Rakyat Dato Seri Anwar Ibrahim bagi menunjukkan sama ada kenyataannya yang ekstremis dan memecahbelah itu bersifat demokratik dan sebahagian daripada rekonsiliasi nasional selepas pilihan raya umum.
Rakyat Malaysia mencatatkan jumlah keluar mengundi bersejarah sebanyak 80% dalam PRU ke 13 demi melawan dan mengalahkan politik wang, ketakutan dan pembohongan. Walaupun Pakatan Rakyat berjaya meningkatkan undi popular sebanyak hampir 4% sehingga menang undi popular sebanyak 51% berbanding hanya 47% di pihak BN, BN masih memenangi kerajaan. Margin kemenangan malah lebih besar di Semenanjung Malaysia dengan 53% mengundi Pakatan Rakyat berbanding 45% untuk BN. Pakatan Rakyat menang 55% undi popular di Perak, tetapi tetap tidak memenangi kerajaan.

Malaysia mempunyai kerajaan minoriti BN di Putrajaya, Perdana Menteri minoriti BN dan Menteri Besar minoriti BN di Perak. Rakyat ada hak untuk menyoal demokrasi jenis apa yang ada di Malaysia yang membenarkan kekuasaan minoriti ke atas majoriti. Sebalik memberi jawapan kepada tuntutan umum terhadap reformasi pilihanraya supaya menghormati pinsip 'satu orang, satu undi, satu nilai', Ahmad Zahid mengambil pendekatan autokratik dan keras bagi menghukum mereka yang berani bertingkah.

Di sebalik meletakkan fokus pihak polis terhadap kerja asas mereka untuk membasmi jenayah, Ahmad Zahid lebih suka sekiranya pihak polis menangkap pemimpin Pakatan Rakyat yang tidak pernah mencuri ataupun menyakiti rakyat. Jenayah telah meningkat menjadi sebuah krisis yang amat serius hatta rumah saudara mara Timbalan Perdana Menteri Tan Sri Muhyiddin Yasin di Petaling Jaya dan Ketua Polis Negara Tan Sri Khalid Abu Bakar di Mantin, Negeri Sembilan pun telah menjadi mangsa jenayah pecah masuk dalam hujung minggu lalu. Masanya telah tiba untuk pihak polis memerangi jenayah dan bukan mengambil bahagian dalam peperangan BN terhadap Pakatan Rakyat.

BN masih tidak belajar daripada kekalahan mereka dalam PRU ke 13 dan enggan mendengar suara hati nurani rakyat, dan memilih untuk bergantung kepada ketakutan, kebencian dan penipuan untuk terus menindas dan membungkam aspirasi rakyat yang mahukan kebebasan, harapan dan peluang saksama. Menggunakan kaum dan agama sudah tidak lagi berkesan kerana setiap orang Malaysia tahu bahawa itu hanyalah suatu topeng untuk menutup korupsi besar-besaran BN.

DAP sangat terkejut dengan tingkah laku samseng yang diperlihatkan wartawan utusan Malaysia terhadap protes sendirian bekas wartawan senior Utusan Malaysia, Hata Wahari di depan ibu pejabat bekas majikannya semalam. Di mana kebebasan akhbar dan kebebasan bersuara apabila wartawan Utusan Malaysia boleh membuat gangguan fizikal terhadap Hata Wahari, bukan sahaja dengan olokan dan ejekan perkauman malah melontar dua bungkus bihun goreng kepadanya.

Utusan Malaysia patut menerima hak mana-mana individu untuk tidak bersetuju dan membenarkan Hata untuk meneruskan protes aman beliau yang diletakkan dalam ayat-ayat kain rentang beliau, 'Mesej untuk ketua pengarang Utusan, hentikan kewartawanan tidak bertanggungjawab. Julang etika kewartawanan. Jangan rosakkan masa depan Utusan demi kepentingan sendiri. Jangan jadi wartawan rasis'. Utusan sudah tidak lagi percaya dengan kebebasan akhbar kecuali kebebasan untuk berbohong terhadap Pakatan Rakyat. Saya telah membawa banyak saman fitnah terhadap Utusan dan telah memenangi setiap satu saman tersebut.

Daripada sebuah akhbar yang pernah memperjuangkan kebebasan, Utusan Malaysia telah dengan begitu memalukan mereput menjadi musuh kebebasan akhbar, keharmonian kaum, kebenaran dan hak asasi manusia untuk bebas bersuara. Bagaimana boleh seorang wartawan membuat gangguan fizikal terhadap wartawan lain? Hanya di Korea Utara sahaja Utusan Malaysia mungkin boleh dialu-alukan untuk membungkam, menekan dan menindas kebebasan akhbar.

大马人创下历史,高达80%的选民在第13届大选挺身而出拒绝及击败金钱政治、恐惧与谎言。民联虽然在本届大选的总得票率增加了4%,并且以51%赢得了选举的总得票率,但是相对只获得47%的国阵却赢得了执政权。在马来半岛的胜利差距更为显著,民联获票高达53%,国阵则只有45%。在霹雳民联赢得了55%的州总得票率,但仍然失去执政该州的权力。

马来西亚在布城拥有一个少数政府、少数首相及少数霹雳国阵州务大臣。人民有权力质问在马来西亚允许少数统治多数,到底是哪门子的民主。阿末扎希不去听从人民意愿进行选举改革,以尊重"一人、一票、一等值"的民主原则,反倒过来以独裁及强硬的态度对付异议。

阿末不去要求警方回归他们的正业,专注打击罪案,反倒过来选择要警方逮捕不偷不抢的民联领袖。治安问题已经成为危机,即使是副首相丹斯里慕尤丁及全国总警长丹斯里卡立双双的胞妹也分别在八打灵再也及森美兰文丁的住家被入贼行窃。如今,警方是时候打击罪案,而不是帮国阵打战以对付民联。

《前锋报》是新闻自由及言论自由基本人权的敌人。

国阵仍然无法从第13届大选的失败中吸取教训,拒绝聆听人民的声音,反倒过来以恐惧、仇恨及谎言来压迫、镇压及压制人民祈求自由、希望及平等机会的愿望。利用种族及宗教对大马人民来说已经没有效,因为大马人已经知道在这些伎俩都是为了掩饰国阵严重的贪污。

民主行动党对于《前锋报》媒体从业员以流氓行为针对其前资深记者哈达达哈里感到震惊。哈达昨天在其前雇主《前锋报》总部前展开个人示威,竟然不只遭到《前锋报》媒体从业员以嘘声及种族主义奚落及污辱,还被他们丢两包炒米粉攻击他,请问《前锋报》的新闻自由及媒体自由在哪里?

《前锋报》理应允许任何公民的反对权力,让哈达继续以他写着"致《前锋报》总编辑:"请停止不负责任的报导,秉持媒体伦理操守,别为了个人利益毁了《前锋报》未来,别成为一个种族主义的记者"的大布条进行和平抗议。《前锋报》根本已经不再笃信新闻自由,他们只会自由妄为地撒谎对付民联,这可从我多次控告《前锋报》诽谤,全部都胜诉获得证明。

从一家捍卫自由的报章,《前锋报》如今羞耻地沦落到成为新闻自由、种族和谐、真相及言论自由基本人权的敌人。一个媒体从业员怎么可以肢体侵犯另一个媒体从业员呢?看来也只有朝鲜才会欢迎《前锋报》这种压制、压迫及镇压新闻自由的做法。

Ambiga: Bersih’s ‘People’s Tribunal’ a ‘Moral Force’ to Investigate Electoral Fraud

KUALA LUMPUR, May 21 — Bersih 2.0's "People's Tribunal" may not have any legal standing but will serve as a "moral force" to investigate allegations of electoral fraud, said Datuk Ambiga Sreenavasan when defending the polls watchdog's final attempt at proving wrongdoing in the May 5 polls.

The renowned civil rights activist told The Malaysian Insider that Bersih 2.0 will soldier on with its plan to set up the tribunal which, she said, should be announced in two or three weeks' time, despite earning condemnation from polls regulator Election Commission (EC).

"It is true that it is not set up under any law or statute. That is why it is called the People's Tribunal," she said.

"It will be an evidence-gathering tribunal and what we have is the moral force to examine the allegations. That is its main aim — to gather evidence," she added.

On May 6, a day after the tumultuous 13th general election, Bersih 2.0 announced its plan to set up the tribunal to look into the hundreds of reports of alleged cheating that took place during the polls.

The coalition of over 80 non-governmental organisations insisted that the polls results had favoured the ruling Barisan Nasional (BN) largely because of these irregularities, and said it would not recognise the outcome until it had verified all allegations of fraud.

In the polls, BN continued its half-a-century unbroken rule and emerged victors yet again despite winning with a significantly smaller seat majority in the 222-seat Parliament.

The ruling pact snapped up 133 seats this time to Pakatan Rakyat's (PR) 89, failing yet again to recapture the coveted two-thirds parliamentary majority that it first lost in the 2008 general election.

PR refused to accept its losses, however, pointing to the fact that it had won the overall popular vote by scoring 51 per cent of votes cast, while BN only took 48 per cent — an outcome reminiscent of the 1969 polls when the ruling pact first lost the popular vote.

The federal opposition pact of PR has since confirmed plans to file election petitions to challenge the results in 27 federal seats where BN had won with marginal majorities, allegedly due to electoral fraud.

PKR strategy director Rafizi Ramli has also said that the same complaints will be brought before Bersih 2.0's "People's Tribunal" where, he said, PR's evidence was likely to be treated with more seriousness than in any court of law.

Ambiga told The Malaysian Insider that the tribunal will be presided over by a five-member panel, which will include individuals of repute and who will not be members of any political parties or even from Bersih 2.0 itself.

She said the panel will likely come up with a set timeframe to conduct its probe, apart from deciding on appropriate terms of reference before commencing any hearing.

"We will then expect some sort of recommendations or findings to be made. This will be presented to all the relevant authorities, including human rights bodies like Suhakam," she said.

"For Bersih... our role is just to facilitate the setting up of the tribunal. Further to that, we will not get involved. It must be completely independent," she added.

Ambiga also explained that the setting up of the tribunal was taking longer than originally planned due to the complexity of its scope of investigation, as well as the selection of its panel members.

"We originally wanted to have it done by June but it looks impossible at this point. We should announce the panel within two or three weeks' time.

"But as to when the panel will begin their hearings, that would be entirely up to the members to decide," she said.

Despite widespread protests against its handling of the 13th general election, the EC has insisted that it had conducted the polls fairly and successfully, citing the higher turnout of voters at a whopping 84 per cent as evidence of voters' confidence in the Malaysian electoral system.

"We have conducted a successful polls, there was an 85 per cent turnout… we have good job as you can see from the turnout," EC deputy chairman Datuk Wan Ahmad Wan Omar said last week.

PR has been organising mammoth rallies across the country to prove voter dissatisfaction against the polls, which PR de facto chief Datuk Seri Anwar Ibrahim has insisted had been stolen from his pact.

Model GST Singapura Tak Relevan Untuk Malaysia, Hanya Bantu Orang Kaya

PETALING JAYA, 21 MEI: Menjadikan pengutipan Cukai Barangan Dan Perkhidmatan (GST) di Singapura sebagai model tidak bersesuaian berikutan pendapatan perkapita rakyat negara ini jauh lebih rendah berbanding Singapura.

Mengenakan GST sebanyak tujuh peratus seperti yang dibayangkan Menteri Di Jabatan Perdana Menteri, Datuk Seri Idris Jala baru-baru ini juga membimbangkan kerana bercanggah daripada kadar empat peratus seperti yang dicadangkan Kementerian Kewangan sebelum ini.

"Menjanjikan penurunan cukai korporat dan cukai pendapatan untuk off-set GST hanya membantu orang kaya.

"Dalam erti kata lain, plan GST BN adalah regresif dan pada dasarnya akan melihat majoriti rakyat membayar lebih cukai daripada minoriti kaya," kata Pengerusi Biro Perdagangan dan Pelaburan PKR,  Wong Chen dalam sidang media di ibu pejabat PKR di Merchant Square semalam.

Menurut Wong Chen, Idris juga gagal memaklumkan keadaan sebenar Singapura ketika melaksanakan GST pada 1994 tidak terus mengenakan tujuh peratus, sebaliknya hanya mengenakan tiga peratus, dinaikan kepada empat peratus pada 2003 dan hanya 13 tahun kemudian pada 2007 barulah mencapai tujuh peratus.

Menurut Wong Chen yang juga merupakan Ahli Parlimen Kelana Jaya itu, kerajaan sepatutnya menumpukan usaha membaiki kelemahan asas cukai yang lemah, pembaziran perbelanjaan dan rasuah sekaligus mampu mengurangkan defisit negara.

Menurut beliau kelemahan asas cukai berpunca daripada fakta bahawa pendapatan majoriti rakyat Malaysia adalah masih rendah sekaligus berada di bawah paras had pembayar cukai.

Pada April tahun lalu, kerajaan menangguhkan lagi bacaan Rang Undang-Undang GST buat kali ketiga selepas pertama kali dibentangkan di Dewan Rakyat sejak tahun 2009.

Langkah penangguhan tersebut diambil dipercayai disebabkan kebimbangan BN akan ditolak dalam Pilihan Raya Umum Ke 13 (PRU-13) baru-baru ini.

Bagaimanapun BN selepas mencapai kemenangan dengan majoriti merosot berbanding PRU-12 sebelumnya, dijangka tidak akan teragak-agak untuk melaksanakan GST selepas diluluskan dengan sokongan wakil rakyat BN di Dewan Rakyat nanti.

Xavier, Wong May Be Dropped From Selangor Exco Lineup

PETALING JAYA (May 20): PKR's Dr Xavier Jayakumar and Elizabeth Wong have accepted the possibility that they may not been reappointed to the Selangor state executive council.

This is apparently because the new lineup will feature six Malays and four non-Malays, as requested by the Sultan of Selangor to better reflect the racial composition of the assembly members.

With three or four of the non-Malay exco positions going to DAP, PKR will at the most have only one non-Malay representative in the lineup.     

Wong, when contacted today, said she is committed towards working for her Bukit Lanjan state constituency and addressing environmental issues irrespective of whether she gets an exco post.

"Yes there is a possibility (of not being re-appointed) but it won't affect my resolve to represent my constituents and my work on the environment," she said.

"We place our trust in MB (Menteri Besar Tan Sri Abdul Khalid Ibrahim) to make the best decision on this matter (exco line-up)," she added.

Xavier told fz.com that PKR had agreed to include a non-Malay assembly member in its exco list but the decision was not final.

'There are a few names. We will have to wait and see," he said.

In previous discussions, Selangor Pakatan Rakyat leaders had agreed that the 10 exco positions would be equally distributed between Malays and non-Malays, with PAS representatives holding three posts (in addition to the speaker's post), DAP holding four posts and PKR holding three posts (as well as the menteri besar's post).

DAP had already mooted former speaker Datuk Teng Chang Khim and Seri Kembangan assembly member Ean Yong Hian Wah to fill two exco positions.

Teng was known to have thrown his name in the hat for the exco position even before the May 5 polls.

Also, DAP won more seats in Selangor compared to PKR. DAP and PAS each won 15 seats while PKR won 14 seats.

However, in a surprise announcement on Saturday, Abdul Khalid revealed the ratio of positions between DAP and PAS had switched.

According to a PKR source, the reason behind this was due to a proposal from the Sultan of Selangor for Malay elected representatives to assume six exco positions while non-Malay representatives will assume the remaining four exco positions to better reflect the racial composition of the newly elected state assembly.

Out of 56 state assembly members, 37 are Malays and 19 are non-Malays.

The previous exco lineup had five Malays and five non-Malays. 

If Pakatan were to accede to the ruler's proposal, and maintained DAP's ratio of four exco positions, then PKR would have to nominate its Malay elected representatives for the exco posts and exclude  Wong and Xavier.

The Pakatan leadership is now in discussion to solve the kerfuffle over the exco line-up.

Wong had previously championed environmental policies and worked on the drafting as well as implementation of the Freedom of Information legislation.

She had tabled an amendment to the National Forestry Act 1984 which calls for a public inquiry compulsory before a forest reserve can be de-gazetted. It was passed by the state assembly during its sitting in April 2011.

She also worked closely with orang asli communities, and embarked on a first attempt in the administrative history of the Selangor government to use geo-mapping
technology in order to delineate orang asli villages and native customary land in the state.

Wong also worked on the No Plastic Bag on Saturdays campaign which was successful in the state.

Xavier is known to champion Indian community issues.

He has worked on various matters, including the relocation and construction of Tamil schools, ironing out land matters affecting Tamil schools and improvement of Tamil school education via a committee made up of Selangor Pakatan leaders.

He also administered the relocation of Hindu temples as well as facilitated talks between former plantation workers and landowners for relocation.

Xavier also facilitated administrative matters to solve flooding woes in Taman Sentosa, with the construction of a water retention pond slated to begin soon.

Upgrade of Lebuhraya Thean Teik (Phase II) is now 70% completion

(槟城21日讯)预料今年7月在第二阶段道路加宽工程完成后,槟城天德园大道的交通将会更为顺畅。

在该大道第二阶段的道路加宽工程完成后,从发林新市镇驶出,采用该大道的车辆,将可直接转左,通往钟灵中学方向的亚依淡路。

为了让车辆能通行无阻的直接转左,该大道与峇都兰樟巷交界红绿灯左侧长约350米的道路将从现有的60尺加宽至100尺,即加宽40尺。
在该加宽道路工程完成后,从上述交界至发林新市镇巴刹的两边道路,都将拥有三条车道。

已完成约70%

该大道的第二阶段加宽工程于今年3月经已动工,目前工程已完成大约70%,并预料在2个月时间内,于7月间,全部工程将竣工。

该项道路加宽工程耗资在100万令吉以下,由位于该地点附近一发展计划的发展商Jiran Bina承担所有的兴建费用,因为这是槟州政府通过槟岛市政局在批准该发展计划时所施加的附带条件,即进行该大道第二阶段的道路加宽工程。

天德園大道擴建 次階段7月竣

(檳城21日訊)從今年3月開始展開的天德園大道第二階段擴建工程,預計7月就能通路。

天德園大道是於2011年開始擴建工程,將原有的4條車道增至6條車道,雖然工程進行期間曾面對天德園居民及邱公司不滿,但在經過多次商討後已經將問題解決。
 
由佳景集團負責的首階段計劃是在2012年2月完成,第二階段的擴建工程是由Jiran Bina有限公司負責。
 




料能紓緩塞車

黃漢偉週二與Jiran Bina有限公司董事王思勇巡視天德園大道的第二階段擴建工程時說,根據數據,該大道在上班高峰期時的交通數量每日平均2300輛,下午時段則平均1500輛。

"擴建工程完成後,預計能紓緩該區長期面對的交通阻塞問題,惠及該區的道路使用者。"

Penang mulls a commission on election bribery complaints

GEORGE TOWN (May 13): The Penang government has found reason, supported by legal provisions, to set up a commission of enquiry on incidences of election pay-outs and related malpractices being made in the state.

Chief Minister Lim Guan Eng said based on the advice of constitutional lawyer Tommy Thomas, the state wants to have a commission so as to have findings and actions with statutory force.

The commission, he said, would work in parallel with any investigations by the Malaysian Anti-Corruption Commission (MACC) and the police and if appropriate action is taken by the authorities, there would be no need to continue operating the commission, Lim said.

"We actually do not have much faith in the MACC and Election Commission (EC)," he said. "Let the commission be formed and let them come up with the findings. I don't want to make any pre-emptive comments."

 The Penang state executive council (exco) under Pakatan Rakyat will deliberate over the idea at its first meeting for the new term tomorrow.

 Lim said the meeting will also hear the input of newly minted exco member and lawyer by profession Jagdeep Singh Deo and Andrew Yong who is special legal officer of the Chief Minister.

Jagdeep, until his appointment to the exco last week after successfully defending his Datuk Keramat state seat, ran the legal firm of his father – DAP chairman and Bukit Gelugor MP Karpal Singh.

In a statement, Thomas explained that Section 2 of the Commissions of Enquiry Act 1950 gives power to both the federal and state governments to appoint such commissions.
 Section 2(3) reads:
 "The state authority of any state other than Sabah or Sarawak may issue a commission appointing one or more Commissioners and authorising them to enquire into –
 (d) any other matter in which an enquiry would, in the opinion of the state authority, be for the state's public welfare and which does not directly concern the public welfare of any state.
 "The expression 'public welfare' found in Section 2(3)(d) is also found in

Section 2(1)(d) relating to the Agong's power to appoint at the federal level," Thomas noted.

 He stressed if the Penang government was satisfied that "the public welfare of Penang has been engaged by reason of the dishonest manner in which the election campaign had been carried out," it is empowered, under the section, to appoint a commission of enquiry.

Thomas explained that the chief minister would have to seek the Yang diPertua Negri's approval for the establishment of the commission and the latter will make its appointment.

He said the appointment cannot be challenged in court because it is "non-justiciable" and also because no party has the 'locus standi' to institute legal proceedings in court, Thomas added.   

He cited Section 3(1) of the Act which provides the state the authority to specify the terms of reference and practical directions of how the commission can carry out its duties, while Section 3(2) provides for the appointment of a number of Commissioners.

The idea was mooted after Pakatan Rakyat representatives reported of alleged pay-outs in numerous occasions, around the state.

Before the 13th general election, DAP's Wong Hon Wai received a tip-off of such
incidence at a coffee shop in Reservoir Gardens in Penang.

Wong, who was candidate for the Air Itam state seat, called the police and rushed to the site but claimed that the activities stopped upon his arrival.

"The queue was still there, and after an hour the organisers asked the people to go off," Wong said, then lodging a police report and another with the MACC the next morning.

A few days ago, he and Pakatan Rakyat component members were shocked to hear of widespread pay-outs being allegedly made for voters in constituencies where Pakatan had lost to Barisan Nasional (BN).

Wong visited the MACC again today, this time with several PKR candidates who wanted to furnish evidences of similar cases in their own areas.

 Wong learnt that his report was still "under observation." "No action was taken, no witnesses called... I am expecting them to make arrests!" Wong said.

 "It is not an isolated case. It is a widespread vote-buying scheme to manipulate the outcome of the general elections," he alleged.

 "If MACC does not take any action, in five years this kind of thing will happen again, and on a bigger scale," Wong lamented.

Ten PKR hopefuls who lost in Penang – many by thin margins – also began the process of reporting alleged incidents of pay-outs in their respective constituencies to the MACC.

Their spokesman, Bayan Baru MP Sim Tze Tzin, said the public vouchers were given out during the 1Malaysia free 'charity dinner' and at other places during the campaigning period.

Sim said PKR members had all gathered evidences and want the police and MACC to investigate whether the events where the vouchers were given out were related to pay-outs.

 Sim cited the Balik Pulau parliamentary constituency where PKR and PAS lost in three state seats. He said money was being dispensed at three locations.

 "The pay-out amount was between RM120 and RM200 to each person," he said, adding that voters in constituencies where Pakatan Rakyat parties won were turned away.

Sim said he lodged a report at the Sungai Nibong police station on May 10. He cited Section 10A of the Election Offences Act 1954 where bribery related to voting is spelled out as an offence "before, during or after an election."

He claimed that at one site they saw "hundreds of people" queuing up in front of an entrance that had a cardboard displaying the official EC-designated numbers of the constituencies the BN had won.

"Some people said to us that if you produce your IC (identity card) photocopy and you are a voter you can take the money. They (those handing out the money) had the voters' list where they marked that you had taken the money," he said.

Acting on a tip-off, Sim and PKR members did a spot-check at a location in the Pulau Betong state constituency, but the persons who were giving out the money left when they arrived.

 "If this (pay-out) is legal, why are you running away?" Sim said, suspecting a continuous effort as many areas on the mainland had yet to receive their payments.

Kerajaan negeri Pakatan Rakyat Pulau Pinang amat kesal dan membantah tindakan beberapa Pertubuhan Bukan Kerajaan (NGO Melayu) diterajui Persatuan Pengguna Islam Malaysia (PPIM) yang menyeru umat Islam memboikot barangan keluaran syarikat milik Cina yang berstatus halal.



Jelas, tindakan itu menunjukkan mereka separuh matang dan kebudak-budakkan, hanya sebagai membalas tindakan majoriti masyarakat Cina menyokong Pakatan Rakyat dalam pililihan raya lalu.



Lagipun, soal sokongan mana-mana pihak dalam pilihanraya bukan menjadi kesalahan di sisi undang-undang. Bahkan ia juga bukan suatu kesalahan jenayah sehingga mereka perlu bertindak ke tahap itu.



Sebagai sebuah persatuan pengguna, sewajarnya mereka bergerak memperjuangkan hal-hal kepenggunaan sahaja. Sebelum ini PPIM diketahui umum begitu aktif dalam hal-hal kepenggunaan yang melibatkan halal haram atau tidak sihat sesuatu barangan itu kepada pengguna. Namun, apabila PPIM menyeru orang Melayu memboikot barangan keluaran syarikat Cina atas faktor politik, menunjukkan PPIM telah terkeluar daripada landasan perjuangan yang sebenarnya. Tindakan itu, tidak ubah seperti perjuangan pelampau Melayu - Perkasa.



Ketika kesedaran pengguna dan pengusaha semakin meningkat berkaitan status halal, PPIM bertindak sebaliknya dengan memberikan imej buruk tentang Islam. PPIM seharusnya membantu kerajaan pusat atau negeri dalam memperjuangkan hal-hal kepenggunaan khususnya berkaitan status halal.



Selaku Pengerusi Halal Penang (PIHH) dan Exco Hal Ehwal Agama Islam, sejak tahun 2008 kerajaan negeri telah berjaya meningkatkan syarikat dan barangan berstatus halal di Pulau Pinang sebanyak 605 peratus. Ini bagi memenuhi sebahagian tuntutan persatuan pengguna Islam, demi kepentingan semua pihak, khususnya kepada pengguna Islam.



Sebagai sebuah negara majmuk seperti Malaysia, di mana masyarakat Cina lebih menguasai pengeluaran produk pengguna, sebagai pengguna, tidak mungkin kita dapat mengelak daripada menggunakan barangan bukan Islam.



Selaku Pengerusi Hal Ehwal Pengguna saya menyeru PPIM menfokuskan isu halal haram dan barangan pengguna yang diragui masih banyak perlu diperjuangkan. PPIM sewajarnya memperjuangkan isu ini, lebih daripada memperjuangkan politik adu domba yang akan memecahbelahkan keharmonian kaum negara ini.
